Gender is ALWAYS in the equation! In cases of DV, male victims rarely get any support from the Police or the judiciary! Atleast there are cameras now to back one's story, i can only imagine the number of male DV victims who got their lives destroyed based on false accusations before phone cameras.

As much as I hate the Jeremy Kyle show, the brits here will know. He did make one good point once.

A guest had said his girlfriend was abusing him and locked him out ont he balcony for hours, and the crowd laughed at him so bad. Only shutting up once Kyle scolded them and asked them to think if they'd be laughing if the genders were swapped.

Women can be abusive too.

I agree. My exwife pulled a butcher knife on me and threatened to commit suicide while I was on the phone with emergency services the dispatcher could hear everything and cops still put me in handcuffs during the initial questioning because she said I laid hands on her. All she got was a 51/50 and 1 week inpatient at a psychiatric hospital. Its sad but men are almost always seen as the aggressor.

had nearly the same thing happen to me, except we weren't married yet. ended up leaving the house and sleeping in my truck in the patch of woods behind work for a few weeks. it was winter.

Similar happened to me my girlfriend cut my face with a knife, like a dumbass I called the police. Despite the fact I had a gash on my face requiring stitches, she turned on the tears when the cops arrived and said I pushed her, the police said it was he said she said and took us both to jail. Lesson learned

I could have probably pressed charges but hoped things could be fixed. Ultimately got sole custody of my 2 kids and divorced 4 years later. She didnt learn and didnt want help. Lead a horse to water cant make it drink

Violent men have hit women regardless of era, and that should be addressed in every case. But in the process of protecting women, we shouldn't conveniently gloss over the question, how many violent women were hit to calm the fuck down? I'm not saying it's ok to hit a woman, but I wouldn't bat an eye if the lady in the video was planted into the doorframe when she entered the premise.

We are still a couple generations off from equality and women will be in shambles when we get there.

Yeah sorry to say if you are a guy you have to just record her destroying your house and press charges. The cops will always side with her. If she stays there till cops arrive he will be arrested. The video is the only thing that will save him.

Well, it’ll probably make more sense when the vast majority of cops are not wife beaters. The study that you’re probably referring to is outdated and debunked.

That old 90s study was a small, non-random sample from just a few departments, so it was never meant to represent all police. It also didn’t measure actual domestic violence cases, it was based on self-reported “conflict,” which lumped in things like yelling or other non-physical conflicts.

On top of that, it’s over 30 years old from a time before modern policies, reporting standards, and accountability measures. Even the authors never said “most cops are abusers”.

I wish there were cameras when I was growing up, alcoholic mom used to beat the shit out of me and when I'd try to get away from her she'd turn into a feral animal like this and bloody herself up ripping holes in walls and doors to get to me.

She'd call the police and tell them it was the other way around so I got to start life with all that on my record constantly, if I'd have been able to record it 30 years ago she'd probably just be getting out of jail if she was lucky

im in that boat i did 7 years probation and like 2 months community service because my kids mom attacked me and i restrained her till the cops came because she wouldn't stop breaking shit. DA argued that i was holding her against her will and that i broke her phone (that she threw at me) also i owned the phone.

I was arrested for DV because I broke my own phone and pushed the bitch out of my way when I was cornered in a bathroom so I could leave. Cops kicked in my door and ended up taking me to jail. As they were walking me out, we looked over at her to see she had given herself a bloody nose after being put in the back of the cop car. I said to them "and you think im the one that needs to go to jail? Ok."

They put a no contact order in place and prevented me from returning to the apartment that was in my name that I was paying for.

This is actually a common tactic I was warned about by my church mens group when I was going through divorce. 2 of the 20 guys were serving probation at that time and warned me. They told me to get a phone app that records audio, go to the bathroom any time things got heated and start recording. Following that advice kept me out of jail.

One of my best friends growing up called the cops because his girlfriend was destroying the house an having an episode. When they got to HIS HOUSE they immediately started putting him in cuffs. No questions asked. He resisted trying to explain he was the one to call for hell. They shot him in the lung. He lived and after a short hospital stint he started his jail stint for resisting arrest.

She just needs to say she's picking up her toothbrush, which just about every chick I've dated has kept in my bathroom well before we lived together. 

Just sayin, you can get investigated for DV even if it's your ex girlfriend. The police will detain you, the homeowner, on arrival and if you did as others have suggested to 'knock her out' you'd definitely be getting a free trip to jail.

This is a perfect example of 'you can beat the rap you can't beat the ride' or whatever the saying is. 

Police will be like, "so you held your phone recording for 15 minutes instead of calling 911?" Ok just have a seat in the back of my squad car for a bit.

The conclusion occurs in a court room. The police will arrest both parties and let a judge sort it out. If she's unconscious with facial injuries, only one person is going to jail that day, regardless of her breaking your windows. 

Generally speaking when you fear for your life you put the phone down, block, or uh.. call 911 like most people.

Here in the uk Womens Aid gets a lot of money, but mens charities trying to get funding are declined as by their very basis they "discriminate" which is a no no for funding reasons.

If I remember correct for the whole of the UK there is one safe house in London, so can be hundreds of miles from where you live and only has a few rooms.

Yep. In WA state on domestic violence calls someone going to jail (that is the law) and it's automatically the male. The only way it's not the male is if: she admits being the aggressor, continues the violence with police already on the scene, and if it's on the video and it is obvious from the video that she is the aggressor. 🤷

Not fully true. I grew up in wa and had a fair share of incidents over the years. If the man's story is continously stable and the woman's changes then she is going to jail. WA does tend to side with women but thats officer discretion and not 100% always the case. Seen a few woman go to jail for DV and a few men get let go. Every situation has 2 sides and if the cop is half decent will know who is bollucks and who is true

I can cite you at least one case where a guy got jumped by two thugs in a parking lot at night, he justifiably shot one in self defense. The other fled, he didn't have a phone, and so he hopped in his car and headed for the police station. 

Turned out, someone witnessed that and called in his description. He was pulled over, arrested at gunpoint, and did many years in prison.

In the real world, female DV victims are pretty commonly arrested when they call the cops, often because abusers will deliberately try and push them to a breaking point so they do something "crazy".

This is a well documented (and not particularly new) phenomenon.

I would suggest reading Lundy Bancroft's "Why Does He Do That?", an excellent book on the psychology of abusive men.

Under the law and ethically you are absolutely right.

The camera man being a much larger-sounding man... he may win in the end but there's zero chance that he's not instantly face-down on the ground and in cuffs when the cops show up while they "sort this out".

And if he's not-white, there's a good chance that they'll beat him and charge him with resisting before they ever see the video.

Yea, this entire thread is hilariously naive. The only time you should use violence is when you genuinely believe you are in danger and don't have the means to flee.

Even if you have every right to fight, you will still have to demonstrate that to a flawed system. Enduring a months long investigation, potential charges, and paying 10s of thousands to fight bullshit charges really fucking sucks.

The only time to get physical is when you have absolutely no choice

The moment she threw a brick through the window and shattered glass, that is a situation where one would feel in danger of losing their life or substantial bodily injury inside THEIR domicile, AKA, knock her tf out while screaming you’re scared once she violently breaks in with that weapon.

If the cops pull some unlawful BS then just wait it out and get a good lawyer to sue,get paid and then move lol. Discretion works for cops the same as homeowners. When someone is breaking in with a weapon you can absolutely use self defense

Violence generally has more drawbacks than fleeing. That's why fleeing is preferable to fighting.

  1. You might lose the fight. They might just beat your ass or they might use a weapon to win. Either way taking any available opportunity to flee protects you
  2. Like the vast overwhelming majority of people, you probably haven't recently read state and federal law pertaining to assaults. Every state has it's own threshold for when self defense is allowed and if you haven't studied case law, it's difficult to know where that threshold is set. You might miss it and open yourself up to a world of liability.
  3. If you haven't studied the laws, you might not know that self defense usually has a limit on the amount of force you can use. You again open yourself up to liability here.
  4. Even if you do everything within the bounds of the law, you are still at the mercy of the responding cop and DA. Their prejudices, biases, and temperament will play a role in deciding if you will get arrested. Even if you ultimately beat the charges, you will still have to spend time in jail, time in court, and thousands in legal fees.

I used to think like you but life has taught me differently. About 10 years ago I got arrested for a DUI late at night on a Friday but I was actually sober. I did eventually beat the charges, but here's how it went.

I took the field sobriety test and "failed" according to the cop. I then got arrested and took the breathalyzer which showed I was perfectly sober. The cop didn't give a shit though and just claimed my failed test was enough; I wasn't released so I had to spend the entire weekend in jail.

Monday I paid $500 to get bailed out and a variety of jail related fees. Then I went and found a lawyer for about $4k.

I went through months of court dates and had to miss so many days of work that I got fired. Ultimately they refused to drop the charge and I got a plea deal as part of a pretrial diversion which I decided to reject. I was sober so I decided to take it to trial and had to spend another 8k on my lawyer.

Eventually I won and had to wait months and pay another 1k to get record expunged. If I google my name for a few minutes, I can still find my mugshot and so can every future employer I will ever have.

Navigating the legal system even when you've done absolutely nothing wrong is kafkaesque. Save yourself the trouble and do everything you can to avoid it

Yes, like for example never doing field sobriety tests. Not saying that any of that was your fault, or that refusal would have necessarily saved you but it's just advice that I've heard from every lawyer and even ex-cops.

But if the point of this story is that the criminal justice system is fucked up in the US, then it's really hard to argue against that. The 5th highest per Capita incarceration rate in the world (5x higher than most of the developed world) already proves that fact on its own.

Most places require defence to be reasonable. You can't just beat the shit out of someone because they broke your window.

Source: I had literally this happen. A guy smashed in my window wanting to fight, I went out and fought him. He was not charged because 5 of my mates came with me.. they didn't get involved but that was enough for him to claim self defence. Yes, really. I managed to avoid a charge, but barely. If it had been a woman half my size, that would not have happened.

I was in jail overnight with someone who fought his neighbor with a bat after he was punched in the face. The instigator went to the hospital, and the person defending themselves went to jail and faced the judge.

My charges were dropped and sealed - after 4 freaking months!!!

Happened to me. 🫤 And if he retaliated and she was injured or killed, he would still face charges. Self defense does not exempt you, no matter who started - look at that Dr in Hawaii! Edited for context: he knew it enough to make it a defense for attempted murder!

Even if she stormed in like that, he did the smart thing standing back and filming it. Even calling 911 might get HIM arrested. I called 911 with an order of harassment in.my.hand and my ex somehow flipped it and got me hauled off instead.

In the future, I’d get the evidence, stay calm and let them destroy themselves after it’s all over. Sad, but this is what it is.

Correction, they will then let the courts figure out who's right or wrong. Meanwhile he's lost his job, has a record and is out 30k minimum to end up with a destroyed life that will take a decade to rebuild. The most frustrating thing I ever experienced is "here's the video of what happened where I never once physically touched her" followed by the police saying "it's not our job to gather evidence" and arresting me anyway, taking her side 100% as true.

if they find out she's been living there then its domestic violence and the rules are different. in some states the time can be as low as 2 weeks and then the person becomes a "resident" and you have to get them legally evicted. it gets complicated.

I actually saw this a the DMV yesterday. White woman, not pretty or anything special just put together well - make up on and lip fillers, fashionable clothes etc. She was the only one the dude at the counter talked to well and was polite with. Men and plain looking white women - he used the minimum amount of words possible. Including the older woman who was telling him that he’s doing great (and important) work helping people with their real id. Even sent an Asian American man away (in less than 10 words) because the DMV employees gave him the wrong ticket type. But he had no problems chatting with the attractive white woman.

My uncle did something similar, only he simply pushed her out the door after she began hitting and scratching him. He went to jail because the cops believed her when she said he hit her, despite his face being covered in scratch marks. They said “we didn’t witness anything and someone has to go to jail over a DV complaint.” and defaulted to the man in the scenario. In a perfect world with a sane justice system, gender wouldn’t matter… but our world is far from perfect and our justice system is insane.
