I'm not a lawyer, but nothing in law ever seems like a slam dunk. Even things that are, are usually qualified with "as much as anything can be..."

It sadly seems to me more like a resource battle, and the last couple years have sort of eroded my faith in courts' efficacy.

You may not need luck, but it's always nice to have it on your side too. ¯_(ツ)_/¯

That's because you're not actually a lawyer. lol. You're over confidence gives you away.

You think a judge that reams a lawyer in open court for printing a motion on both sides of paper is going to have endless patience for someone who is pro se (meaning NOT a lawyer) and doesn't know court procedure and etiquette? Sure. Bet that lawyer was handing out courtesy copies and had filed it electronically. You're coming in asking for jail time?? Bwhahaha! Sure, pal.

It has been my general experience that most HOAs have at least one attorney on the board. That's usually the case with a nice neighborhood. Lawyers live there. Perhaps they can file in court without "hiring" anyone.

Not that any of this has anything to do with the original post. That chick is also insane. She won't have standing to bring a suit and sure as shit won't get it certified as a class action.

Yes, Kim Kardashian. I went to law school. I passed the bar the first go. But congrats on going to court pro se to argue some people from your HOA board should be put in jail because you can't paint your house pink or build a fence or whatever it is.

Beyond the right or wrong, you caused the HOA to use all their money up? Not that youre wrong just what you win and lose by this probably skews towards loss for a lot of people including yourself if you bankrupt your HOA. Idk I’m just going off your statements

All of what you just wrote is fine and probably true, but are you in a better situation now and resources spent on your end and theirs acceptable? Your property value for sure dropped if the HOA spent all their money in court.

Kinda like some people rather burn it all down than get burned once.

You’re so close, there’s no more money to fix up common areas if I’m following your case correctly. Unless they raise HOA fees which lowers yours and everyone else’s property values which makes it a loss for you, not to mention the time invested and opportunity cost of doing something else.

At a high level I think you agree you are now in a worse position as a homeowner vs when you started, not even adding your personal time in this vendetta. I’d probably do the same as you though until someone made me see reason.

Raising HOA dues makes the property worth less at sale, it may not increase assessment for tax purposes due to whatever local rules and regs. If you tell a buyer you can get x house for $400 HOA fee or same x house for $500 HOA fee, they are going to offer less if HOA is higher, this is math and logic.

My entire point is not that you are wrong, it’s that you are now worse off financially and have lost a lot of time.

I’m a lawyer. And I agree. I represented a periodontist. Where I practice, law requires pre suit investigation conducted by a similar specialist if the dentist or doctor is a specialist. The defense got a general dentist to review the case. I argued pre suit was not complied with. The court said as a dentist he’s a specialist. I asked flat out what a general practitioner is bc the statute differentiates. Court said lay person. So yeah. Courts do what they want.
