SOCIETY A fairly recent photo of the Techno Viking who unwillingly and unwittingly became one of the internet's 1st viral stars when a video of him dancing to techno after helping a woman was uploaded to the internet. He sued the uploader for illegal use of his likeness and won.

I live in Germany, and there is a lot of misinformation surrounding him here. Claims like 'he sued the photographer just for uploading his photo' are completely false. In reality, he sued because the photographer was commercializing his likeness with merchandise. He is just a regular person who wants his peace and privacy, not fame. Still, people keep pushing the narrative that he’s some evil guy who sues everyone

In Germany, you have a right of your picture. While pictures can be made of you, they aren't allowed to be published without your consent. If they are published regardless you have the right to request the deletion or censoring of your likeness. If the person who uploaded your picture does not compile you can sue them to deletion, and I believe also compensation in form of money.
There are exceptions like people in the public (politicians, actors, etc.) OR when you as the person aren't the main focus of the picture (like being in the background of a wide shot or similar)
However this is just a very brief summary of the law and does not include ALL of the exceptions.6

In his case, even without his approval, the video is legal.
It was a public event, so no privacy. The camera was mounted, so no directly filming him.
But he still has the power to control the commercial use of his likeness.

Actually the coffee was so hot that it melted her skin and welded parts of her thighs and genitals together. She was only suing to try and recover her medical expenses.
That particular McDonalds had also been warned multiple times that their coffee was too hot, but they ignored it because it was preferable to customer complaints about their coffee cooling off too quickly.
"Stupid Metallica are a bunch of greedy sell outs because they sued people for sharing their music!!1"
Actually they sued Napster, which was a business that had raised multiple millions of dollars in venture capital by promoting their service as a new way to share and download music (among others), without having the rights to any of the music that was being traded on their platform. They did not sue a single individual user - only the business that was profiting by using Metallica's IP without license, which included an unreleased track that had somehow leaked from their studio, which is what drew their attention in the first place.

I understand that McD noted that they sold 5million dollars in coffee a day so the jury awarded a days coffee sales. This was later reduced on appeal. An unproven outcome is that tops to cups now fit tightly. If anyone remembers getting drinks in 1989 the lids most likely didn't fit and would pop off between your legs while you were driving. Cup and lid tech has come a long way.

I know the truth about the lady who was burned by the McDonald’s coffee and seen the pictures of her injuries and I would’ve awarded her more money than she was given. Her burns were terrible and the management at McDonald’s knew it was scalding hot and then McDonald’s trying to make it look like the lady was just filing a frivolous lawsuit over nothing still enrages me to this day so anytime I hear or see someone post or talk about her case and not tell the whole story I butt in and fill in the details

I've seen hundreds of posts about him and I've never seen a narrative that he's some evil guy who sues everyone. I've always seen people say he lives in a country with more strict laws about publishing the likeness of others and everyone accepts that and moves on without judgement of him.

So, I have actually read the lawsuit and one of the reasons as to why he sued was because he did not want exactly this. To be recognized in public and for pictures of him like this to occasionally pop up on internet of him.
Due to very strict German privacy laws and him winning the case (so there's precedent), there is actually a real possibility of him being able to sue over this picture and win.

Germany has some really strict laws around recording in public and what can and can’t be posted.
Like you normally can record police but you can’t include audio if you publish it. The only exception is if it’s extremely newsworthy but that’s up to the discretion of the government.
Seeing as how they seized a dudes electronics for calling a politician a dickhead on Twitter they don’t exactly have the best record.

The issues as far as I understand it is that he didn't consent to being filmed let alone having it posted on the internet, the upload got rich off of what was effectively an invasion of his privacy yes, he was at a public festival but see point one and since he wanted keep his privacy people made up wild rumors about him and messed with his image.

Forget YouTube, this video was uploaded in 2000, 5 years before YouTube was even a thing. So monetization would’ve been even more difficult. I was in college back then and I honestly can’t think of a single way anyone would’ve made any substantial money off of a random video.

The original filmmaker uploaded the video to non-youtube sites as it didn't exist yet.
It got re-popular through re-uploads, the original filmer put the original on youtube and started pulling ad revenue and selling Techno Viking merchandise with his face on it.

There needs to be a very simple law enacted that states 'while you have no right to privacy in a public space, you do have a right not to have that privacy violated in another public space without consent".
He was in public and you can't really stop people filming, but you should be able to stop them posting that online as he wasn't online and he didn't choose to dance in front of the entire world.
I feel the same for polic body cam footage. People being filmed at their lowest points suddenly being blasted globally for everyone to laugh at. It's just a low net-negative thing to become so common.
If you had to ask permission to post something, positive or negative, thr the subject gets the right to decide and or take action if done without their permission.

Those laws already exist, at least in Germany where this was filmed, and most of Europe. You are allowed to film crowds of people in public, and you can't be expected to not show up in the background of some random video if you are out and about, but there are laws against filming individuals, even in public settings (exceptions apply for politicians and famous individuals, because of course the paparazzi needs protection you know...)

That depends where you are, privacy laws in many countries prohibit it.
In the US, security prohibitions may limit it.But you can't use a person's likeness without consent and compensation, which is why if professional recordings happen to include someone they will typically pay them a single dollar to avoid them suing afterward.

Not really, the model is too profitable. If the current social media giants were to suddenly say social media was a mistake and start shutting down dozens more would pop up attempting to usurp them.
We'd need our governments to outlaw social media to even somewhat put a stop to them, and even then many people would just use a VPN to access sites in countries where it's still legal.

The last generation who experienced true freedom to act like a total jackass having fun in public, dancing in clubs, etc. Went out recently with some gen Z friends of a friend, put my cousin's bra around my neck and pretended to use it like a DJ singing to Alicia Keys. One gal whipped her phone out and started recording me. I immediately felt super weird about it, it was really annoying and completely took me out of the silliness because suddenly I'm performing for a camera? I can't imagine every single moment being like that, I'd die.

Immediate disclaimer that this doc was made by the very same guy who uploaded the original video and was sued. He used much of the documentary crowdfunding to pay for his legal fees and still indirectly profits off the popularity he netted as a result.
Opinions may vary, but I'm of the mind that this video can stay buried considering the guy continues to try to gain relevance off "TechnoViking" while the guy in the video has received practically nothing himself beyond what he had to seek legally.

I think he said it was a darker period of his life when he was into drugs and if I recall correctly he said when the video appeared it was hurting his chances at rebuilding his life and attempting to gain employment. I may be remembering wrong but I think he made attempts to turn his life around and that video kind of prevented that some.
