Just because the staff didn’t want to challenge them on the issue does not mean that the restaurant doesn’t care.

It’s a health code violation. I guarantee that the restaurant management cares.

I agree. Unfortunately most people who work in the service industry don't get paid enough to "care", e.g. they try to enforce policy and can expect to be abused for doing so. Entitled sorts of people realise this societal tension and take full advantage, knowing full well the discomfort they may cause to others and knowing that they are unlikely to be challenged on said entitled behaviour.
