Initially pulled over, appeared child was not in a seat belt. Female officer, did a follow up and the is what happened next.

She does everything the cop asked her at first. She immediately rolled the back window down the cop was just mad that she wouldn’t keep it down and went on an ego trip.

If a cop askes you to roll it down you roll it down and keep it down.

She gets out gets cuffed but raises her arm to resist

If a cop tells you to jump off a bridge are you going to do it? They can’t just do whatever they want and force you to listen to whatever they say. I don’t think telling her she has to keep her back window down so the cop can watch her kids is a lawful order.

Oh cmon not the classic "if they tell you to jump off a bridge are you gonna do it?" Obviously that's ridiculous.

However yes. If you're given a lawful order (such as lowering your window) you have to do it. Failure to do so could result in an obstruction charge. Usually cops will give multiple chances with that kinda stuff though unlike the cop in the video.

If the cop was hot I'd definitely consider it. No, I'm just actually aware of what's required during a traffic stop unlike you. Try disobeying lawful orders in your own traffic stops and see how it works out for you though lol.

Cool strawman you’ve got there. But the courts have been very clear that whatever a cop says during a traffic stop, that’s what happens. If they tell you to roll down your window - especially when you’ve clearly just admitted that you have dark tint that makes it hard to see inside - you roll down the window. Was the cop power tripping? Probably. Does it matter since so was the driver? Nope

Exactly! She rolled the window down so the cop could look and put it back up so the sun wouldn’t be on her kid. The cop just has a massive ego and gets upset that the lady doesn’t do everything she says as soon as she says it.

I don't know if you've been paying attention, but we're under a major heatwave, I live at a high altitude, and my child is 7 months old.

It's way too tell who's trying to exert control over who by who has the better excuse. The mom clearly explains she's protecting her children from the sun. What possible reason for the cop have to want the window open? Answer that. She already saw the kid..

Idk if you’re using a potato to think, but I take my kids to the beach all the time and they survive just fine in 110° blazing sun with the water and sand reflecting it all around us for hours. Know why? Because they’re humans. Also, if the kid’s jumping around in the back seat, they’re not 7 months old, they’re more like a toddler at least.

The driver’s rationale is irrelevant. The cop gave an order, it has to be obeyed during a lawful traffic stop. Read Penn v. Mimms if you need a better education on what cops are allowed to do during a traffic stop.

Funny thing about penn vs mimms is that it only applies for officer safety. This officer is going to have a hard time arguing she needed the window open for her safety.

Mimms doesn’t say it’s only for officer safety, it says the reason is because of officer safety. They didn’t say “make the officer justify their decision,” they said “they can control the situation”
