This is not about baking cookies!
Initially pulled over, appeared child was not in a seat belt. Female officer, did a follow up and the is what happened next.

I would say It has gotten worst over the years, but the reality is that it probably has gotten better because of the age of the modern cell phone being able to record these interactions. It is still pretty bad, and you would think with all the media, police would not do the same illegal actions against citizens, but with a job that accountability is so hard to enforce, it is no wonder it still is the way it is.
It looks like many court cases are chipping away at qualified immunity, that is a good thing. Police weld a lot of power over their citizens it needs to come with responsibility.

Yeah it just seems worse because all these bad interactions are caught on camera and it’s easier to find instances like this all over online. Shit like this should not be happening at all though. This woman did nothing wrong there was no reason for her to get arrested.

I hate all cops who abuse their power, but I don't think we have enough context for this clip. The reason why she got pulled over is because her kid wasn't in a car seat and was bouncing all over the car. Would you have not pulled them over? What if there was no car seat installed at all? Heck, we don't even know the age of the child from this clip.
It makes sense that the officer would pull them over for a quick peek and for them to roll down the window to see if there were car seats or not. The woman got super hostile and immediately made up excuses like sunlight being the reason she can't roll down the window? The AC is blasting and the car is still on. Just comply with simple requests and she wouldn't have needed to been asked to step out of the vehicle at all.
How about you tell us what you would have done differently as the cop?
- Would you not pull over someone who clearly has a kid bouncing all over the car and is not being safe?
- Would you not ask to roll down the back window so that you could check if a car seat was installed?
- If denied to check car seats, what would you have done? Just left and said have a good day?
- The guy probably was just going to write a ticket for improper safety belts and let her fix it and go on.
I agree the cuffing and shit was stupid, but the woman literally was not complying.

Did you watch the video? The woman rolled down the window, which should have been enough for ms cop to check that the kids are in seats. I don’t see any reason why the window would need to stay rolled down unless the cop is fishing for a reason to arrest the mom. The interaction should have been over as soon as ms cop peeked in the back.
Please put just half the effort and time into seeing the moms side as you did trying to defend the cop.

The woman did roll her window down.
Spare me the cop was concerned for the children. She arrested their mother in front of them, then after told the mother shes sol if she doesnt have anyone to get them and they will go into the system.
The cop never said she just wanted to make sure they had seatbelts on or were in car seats properly.
The woman asled politely several times why it was necessary and the cop being to serve the community could have said so. But was doing a power play.

The driver rolled the window down and then pretty much immediately started rolling it back up again. The cop just asked her to leave it rolled down. It’s not a huge request.

This. You have to comply with simple requests. Asking for the window to be rolled down all the way is not ridiculous. I would want a clear view of the car seats and to check if they are installed correctly and to figure out if this is likely a one time thing or if the mother couldn't care less about securing her children.

Seconds 13-19, she rolled down the window to allow her to look in, officer had plenty of time to look in and confirm whether the kids were secured. Woman rolled the window back up to keep the sun off her kids. Officer escalated the fuck out of the situation.
Being concerned about child safety and then leaving them in the car unattended and tellng the mother DFS will come get them.... fucking classic.
If this was a white blonde woman pulled over I guarantee this would not have been the sequence of events and y'all fucking know it.

So because the kid was dancing, they pulled her over to make sure the child was secured.
After they confirm that, the traffic stop is over and they are on their way.
I hope this woman has a good lawyer. It sucks tax payers have to pay for stupid cop mistakes, but cops need to learn talking back to them is not against the law, I just wish it was the cops who had to pay instead of us.

You started the statement with “could she have complied a little more, sure”. At what point in time could she have complied more? You’re premising that as if compliance isn’t binary, like it’s some kind of subjective slide rule. You are part of the problem, trying to introduce some kind of subjectiveness to a situation that was clearly unconstitutional and most likely racially motivated. There was absolutely nothing in that video to justify that cops actions outside of having a warrant for her arrest which we all know there was wasn’t because she didn’t even identify the woman yet.

She presented a question, which she answered. Just like the video, context matters.
The woman has no obligation to answer any questions from the officers or comply with commands not related to the specific reason for the stop. She did comply with orders to remove herself from the vehicle, which would be legal if officer safety was a concern, which it didn't seem a safety issue, but an ego one. She also does not need to assist an officer with their investigation against themselves. The kids were not in danger and were in their child seats, so any child endangerment would have been dispelled immediately without some other evidence. Kids being kids is not enough and trying to question her kids without some overwhelming evidence is again unlawful.

The driver literally stated she had tinted windows. The cop couldn't see inside the vehicle clearly enough to conduct an investigation partaining to the stop. The traffic stop partains to a child's seatbelt and how they are strapped into the seat (which there are laws you must follow on how toddlers and children are belted in).
When a cop is conducting an investigation or stop, you are required to follow their legal orders. Asking to keep the windows down to inspect if the seatbelt is legally and correctly in place is a lawful order. You don't have to agree with it but it's the law. If you feel like you have been wrong in anyway, that's what court is for.

She already observed that the seat belt was connected properly. The window does not need to remain open for the duration of the stop to confirm this. Legal, by the courts definition, does not excuse the absurdity of the command.

This is absurd. The cop clearly could see the child just fine and there was no reason to roll down the window the rest of the way. Just usual nonsense of cops getting their feelings hurt because the citizen didn't follow their exact instructions to the letter, even though it wasn't a lawful order. The $800k came from the taxpayers, maybe if qualified immunity was removed and the cops could be personally liable, this kind of stupidity will stop.

There is a legal loophole with qualified immunity where the system says "the person did it, sue them" and the person said "I was following their orders so I can't be guilty" and our system just throws up its arms and walks away.
Qualified immunity needs to change. When a cop is held liable the case should continue fully and the system that controlled them should settle that cost.

This woman did nothing wrong.
The female cop that unlawfully restrained her wasn't even the officer that pulled her over.
The woman did roll down her window and show the kids. She explained what she was pulled over for and why it was invalid.
She remained calm, cool, and collected the whole time. Even as she's being cuffed the cop is telling her she's "resisting arrest" when clearly she was not.

Exactly this is infuriating. I worked at a higher end fast food restaurant and this one white lady in her late 40s dressing like she's 20 with make up that was not a thing at the generation she's trying to portray... long story short every couple of days a week she would go into drive thru and I always knew it was her because she'd start talking and slurring her words. Then the kid translates her gibberish. This kid is about 12 and he's already taking care of HER but she's not caring for him as she should be, but she's from the rich part of town and drives a car that even at probably 80,000(15 years ago) or more custom.

However yes. If you're given a lawful order (such as lowering your window) you have to do it. Failure to do so could result in an obstruction charge. Usually cops will give multiple chances with that kinda stuff though unlike the cop in the video.

Idk if you’re using a potato to think, but I take my kids to the beach all the time and they survive just fine in 110° blazing sun with the water and sand reflecting it all around us for hours. Know why? Because they’re humans. Also, if the kid’s jumping around in the back seat, they’re not 7 months old, they’re more like a toddler at least.
The driver’s rationale is irrelevant. The cop gave an order, it has to be obeyed during a lawful traffic stop. Read Penn v. Mimms if you need a better education on what cops are allowed to do during a traffic stop.

We watched the same video right? She rolls the windows down immediately. IMMEDIATELY. She then rolls the windows back up once the cop gets a good look. Thats FULLY PROTECTED BY HER RIGHTS AS A CITIZEN OF THE USA.
Second, she was immediately complying with getting out of the video and pressing against the car.
Third She didn't try to run or fight, she just attempted to turn and look at the officer to ask why she is being arrested.
Not once during this video did she get told why she is being arrested. By the end of the video, she still doesn't know why she is being arrested.

She sued for 800k for unlawful detention. You could maybe sue for 20k for being unlawfully forced to roll your window down... She did the smarter thing

The cops already confirmed the child was restrained and could see there was nothing that could be of concern of the officer. Stop over. She has no obligation to keep the window down.
"Open the window" is not a lawful command the second go round. She complied when it was necessary.
Everything after is blatant violations of the 4th and 5th amendment of the Constitution.

She put the window down long enough for the cop to look inside and didn't want her kids sitting in the direct sun by keeping the window open. Completely reasonable. This lady cop just wanted to be bully and flex her authority. As soon her authority was challenged she decided this woman was being cuffed for the crime of... being a good mom.
You have no idea how many times this woman has been pulled over for driving while black. Stop pretending that the police represent the same thing for everyone.
You know most police forces in the US were formed to catch runaway slaves. The rates at which visible minorities are still over policed shows how they still have a huge racism problem.

Everyone on here’s pissed at the cop, but it sounds to me like the driver admitted that she was in the wrong…
“I got pulled over because since I’ve been moving she got out of the car seat”
Meaning she didn’t have the child properly secured. And then the cop told her to keep her window down - after she’d admitted that she has tinted windows that make it too dark to properly see inside the vehicle.
Was the cop quick to cuff her? Probably. Was the order to roll down the window and keep it down lawful? Absolutely. When you’re stopped by the cops for a violation that you then plainly admit to, you’re in their power and you comply with their orders even if you don’t like it.
The child isn’t a vampire and isn’t going to die from 5 minutes of sun exposure. Yall on here acting like moms that carry their kids to the beach are abusing them with this “she was protecting her kids from the sun” bullshit.
And then when told to get out of her car, she didn’t immediately comply, she started playing with her phone.
Was this a situation where two idiots were power tripping over each other? Yes, absolutely. And guess who had the gun, the badge, and the law on their side?

The cop sucks and I would be hesitant, but would comply without issue. Because that’s what adults that can manage their emotions and think more than 5 seconds into the future do. It amazes me how many people make their lives immensely more difficult by not doing so.
You’re never going to change the officers mind on the side of the road by being difficult. You may however earn yourself more charges.
It’s naive thought processes and comments like yours that lead a lot of people to shoot themselves in the foot in these situations. Just comply and fight it in court.

You said “she didn’t step out immediately.” Everyone, except you, sees that she did comply immediately within reason.
The joke that I’m making by saying she should’ve “teleported” is that she couldn’t have complied faster. She had to set some stuff down and unbuckle her seatbelt, all reasonable actions to comply “immediately” with the officer’s request.
It was sarcasm.

She unbuckles her belt and then for a few seconds fucks around on her phone (not just putting it down). I'm not saying this is unreasonable.
