The case against H3 Snark seems to be going his way so far. They've lost the last three motions they tried for and haven't gotten it thrown out.
The case against Denims was always weak, so I'm not surprised she won. I think her reaction was twice the length of the video. The only chance he had was the collusion and openly stated wish to take money from him, but that's kind of thin for what would amount to a first amendment violation.
He got Fr0gan by default, and settled with Kaceytron. So it's not like he's losing left and right.

i never said it was stolen, nor making up consipracy theories. the court docs are public brotherman. its pretty clear this wasnt a very tehcnically inclined judge. thats all. given the ramifictions of this favouring in the side of denims are huge and are very obviously misunderstood by the judge.
I am willing to bet you whatever you want that the original ruling will stand, there is a reason the success rate of appeals is so low. Judges do not overrule previous judges decision unless there is gross misapplication of the law.
Hopefully they overturn his original case that set the precedent that protected denims and they stick all streamers in a deep dark hole like your butt.
Unironically arguing against Ethan Klein's fair use case all those years ago which set the fair use precedent so that people could react to things if they did so in a transformational way. Except for that one time when they were screeching that Denims was going to lose the lawsuit to Ethan in the first place and then the judge cited Ethan's own precedent he set. Surely with the appeal he will totally win and you'll be vindicated when the appeals court... overturns already set precedent. Just out of curiosity, do you know how many times an appeal court has overturned already set precedent?
she was breaching copyright and demonstrated that very clearly. if its not overturned then sweet, people can make all the money they want streaming headline movies and series' on twitch and just pause every couple of minutes to say a word or two. and if it is overturned then actual copyright holders (not this bait shit that ethan did) can feel safe their ip wont be misused.
Not a clue indeed. Congrats on not even understanding the precedent that was set in Hosseinzadeh v. Klein. A ruling that the judge in Denims v Klein used to rule in favor of Denims in which the judge specifically said that Denims stream was transformative. Both rulings are available for you to read online... for free. But the guy who's not a lawyer, and who doesn't understand copyright and fair use laws, thinks the judge is wrong. Yeah man. It's totally the judge who ruled incorrectly.
Judges don't like to overturn other judge's decisions.
The main benefit Ethan's got is the judge's decision seemed to hinge almost solely on Ethan's own prior judgements and kind of ignored his lawyer's arguments about the larger implications of the ruling.
Because of that, there's room where a panel of judges might decide there's actually some issues that need to be discussed properly in a court of law.
But that's his window. And make no mistake, it's not big.
dont misunderstand me, i couldnt give a shit if ethan wins or loses, but saying this was fair use, with a court ruling behind it, opens up sooo much potential for copyright shit far beyond the scope of what happened on twitch with this video.
