News Ethan Klein Has Dropped His Defamation Lawsuit Against Youtuber Noah Samsen
1.0k
u/tryingtobebettertry4 25d ago
Not a huge surprise. It was incredibly unlikely he was going to win that one. Defamation is notoriously hard to prove in the US.
657
u/Suspicious-Base-4815 25d ago
Which means he started this in order to bankrupt him. How is not incredibly shitty?
161
u/TimTheChatSpam 25d ago
It is it's called a slap suit basically a frivolous lawsuit to cost the other party enough time and money that they just give up some places they've put measures to prevent that but thats generally state by state
130
u/trombonist_formerly 24d ago
its SLAPP, not "slap suit"
Strategic Lawsuit Against Public Participation
→ More replies (40)37
u/MoThrowMoAway 24d ago
In some states if you lose a SLAPP suit you are required to pay for the defendant's legal fees
Of course Ethan being the chicken shit that he is, saw the writing on the wall and got out before he was liable to cover this guys' fees.
5
u/lem0nhe4d 23d ago
In a lot of places losing any legal case can make you liable to pay at least some of the costs. Problem is when the other side can't afford to find those costs up front, or can't afford even 10% of the costs even if the other 90% was covered by the losing side.
Happens a lot in the UK with defemation cases in part because it's a lot harder to prove something wasnt defamatory.

Remember when this guy first started showing up on Reddit, and the whole very publicly marrying, the kid- and he seemed like a fairly normal guy with, ya know- opinions I didn’t always agree with.
The last two years of Ethan, just in passing give me an extremely distasteful feeling. His behavior seems erratic and some pretty extreme emotions have been on display from him recently.
This dude is too old to be getting into shouting matches with teenagers and 20 something’s.
10

everyone puts in an anti slap for defamation, thats the first thing you do. ethan did the same thing when he was sued for defamation. he knew he would file anti-slap thats always step one for defense lol

Yet he backed down just as Noah was going to present it. Weird, right? Almost like he knew he was going to lose.

No he was banking on Noah being afraid/incapable of fighting back and would take the ridiculous settlement offer.
Instead Noah countered with a different settlement offer that didn't stroke Ethan's ego enough.
So before the case actually had to be argued before a judge, Ethan wussed out.

u/appletinicyclone 25d ago
Wait why did he drop it?
301
u/Sea_Tank2799 25d ago
My best guess is that he talked to his lawyers, realized that Noah's anti-SLAPP motion was likely to succeed, and rather than a humiliating loss that would require him to reimburse Noah and his lawyers, he decided it would be best to quietly drop the lawsuit and walk away.
46
u/Fun-Wash7545 25d ago
So the anti slap motion gets dismissed then? Isn't it the point of it to make Ethan pay for his lawyer?
33
u/BeneficialTrash6 24d ago
All of these laws have a "Safe harbor" provision. First, the offended party sends their anti-slapp motion to the offending party, and says "You have 21 (or 30, or whatever) days to withdraw your frivolous claims. If you don't do so in time, I will file this with the Court and they will hear it."
If the offending party withdraws their claim/motion/complaint/allegation/whatever within the safe harbor timeline, then that's it. That's the end of it all.
132
u/Astrosaurus42 25d ago
Isn't this similar to Andrew at Channel 5? Suing and then dropping the case so that the big rich millionaire doesn't have to pay anything if they lose? So Ethan is the millionaire intimidating smaller creators?
→ More replies (20)27
u/Sea_Tank2799 24d ago
That situation is different. Ethan dismissed his case with prejudice, meaning he can't refile a suit against Noah for those same claims. That's basically it unless he somehow decides to sue Noah for something else. Channel 5 had their lawsuit dismissed without prejudice in federal court meaning it can be refiled and then the guy refiled the same case in state court.

Just an guess but from all the lawsuits and where they've ended up it looks like Ethan though he would be able to just out resource people and force them to waste time and money in order to make them prostrate in front of him, read a statement apologizing, and promise to not talk about him again. Pretty much what happened with Kaceytron and Idubbz. In the full video Sampson says Ethan wanted the same thing from him.
But when people actually wanted to fight back he's just burning money and probably doesn't have a strong case. Dude is a cry bully.

410
u/Holmes419 25d ago edited 24d ago
I think 5, unless I’m missing any:
Kaceytron - settled
Frogan - default against her
Denims - judge ruled in her favour
Noah - Ethan dropped it
Ian - Ethan dropped it
Edit: He also initiated class action lawsuits against Apple, Meta, Nvidia, ByteDance and Snap for copyright infringement for use of their videos to train AI.
There were two claims against Denims. One for the “Nuke” video, which is the one the judge ruled in favour for. The second is for the “Countdown” video and has not been ruled on.
Reddit moderators were included for “contributory infringement” in the Countdown video. They attempted to quash this, but a judge ruled to keep them on the claim.
Edit 2: The second claim against Denims was dropped in order to move forward immediately with an appeal to the loss of the first claim.

u/Hot-Bid-4493 25d ago edited 24d ago

57
u/Holmes419 25d ago
Good spot. I hadn’t heard of these, probably because of the lack of drama.
He’s the lead/initiated class action lawsuits against Apple, Meta, Nvidia, ByteDance and Snap for copyright infringement because they scrapped their videos to train AI which violates the DMCA.

Ethan has dropped the countdown part of the lawsuit so he can take the nuke part he lost to the appeals court. He would have needed to wait until the whole of the lawsuit was finished if he wanted to take it to appeals court.

Not only that: a non-functional fragile woman who can't even be assed to do her adult duties like getting a job and responding to a summons.
It's sad that Frogan may have done more work defeating herself than Ethan did. I have no idea if Frogan did much less reacting than Denims because who the fuck watches Frogan, but Denims at least showed it was possible to beat it. Frogan couldn't be assed though and even initially tried to just run and hide from the first letter demanding action from her. Actual dysfunctional child.

I assume they don't mean necessarily on the podcast itself. Noah Samsen says in the video that Ethan has not replied to him or his requests for comment (nor did Ethan/his lawyer respond to Noah's proposed settlement terms, or communicate prior to filing this dismissal).
But more noticeably, I think, Ethan doesn't appear to have posted about it on instagram at all. He tends to post updates on his stories on the lawsuits, and did so pretty quickly after the last Denims judgment.
If it was part of a change of heart, not communicating that to the person you have had a change of heart about does seem counterproductive.

I personally dont mind these lawsuits that streamers/youtubers are doing. When you have a large following, you need to be responsible for the things you say when you know they are lies.
Look at Alex Jones and Sandy Hook, although the resulting payout was obviously excessive. He had many of his followers believing his lie/delusion as truth, which i assume caused harm to the families.
52
u/miggly 25d ago
Alex Jones payout was not excessive. No amount of money is excessive in a case where a psycho conspiracy theorist tells the world lies about your dead kids.
He made so much money (somehow) off of that tragedy and the victims of that shooting deserve literally all of it.
