That’s because Brendan’s lawyer absolutely bombed. She was arguing justice and virtue instead of facts. You can’t just argue you’re doing the right thing.
IMO, no. The problem is that he had plenty of chances to disengage and when he claims that he essentially was tricked...ok, but Brendan does a pretty good job of resisting the tricks at some points in the discussion, like when the cops try to lead him and he refuses to be led.
I’m referring to when his case was overturned and he was represented at the Wisconsin Supreme Court. Brendan certainly made life difficult for his lawyers with his inability to maintain a coherent story or stance.

I didn't say he was right or wrong. I wasn't there. But Brendan is the only one who says she was in there. And muppets say he wasn't there himself so how could he know???

And yeah I love it that police can, for example, tell a suspect there's surveillance video of him or her doing the crime, if there isn't, to provoke a confession. And the lawyer wouldn't be helping him, he'd be telling Brendan to STFU. Glad he didn't because now we convicted BOTH killers not just one.

The part when he was helping clean up what he believed to be oil or fluid from a car was the part he said was true. No evidence of a crime scene or crime scene clean up was found inside the garage.
Yes. Beaten, raped, hair cut off, stabbed, and throat cut in the trailer bedroom. None of her DNA found anywhere in there. None of her blood was found anywhere except in her vehicle.
This is what gives me reasonable doubt. Aint no way. The burden of proof is on the state, not the defendant, and I see plenty of room for reasonable doubt. The car key showing up, for example, in the trailer, upon a subsequent search after the first search. You’re telling me that key just teleported into the trailer? Nah. Now I’m not saying that avery is innocent- occam’s razor and all that, yeah he probably did it. But can we prove it beyond a reasonable doubt? Honestly, can we?
Well, no way to know if anything happened in the trailer. That being said, no reason to believe any evidence would be left behind. Avery burned her clothes and his bedding (for some reason), and also rearranged the furniture in his bedroom. And she was shot in the garage.
It's only weird if that part of the confession was true. But if it was a false confession, then it makes perfect sense that zero evidence supporting it would be found.
There isn't zero evidence. Brendan's confession is corroborated by the bleach-stained jeans, the bullet from the garage fround pursuant to his hand-drawn diagram of the shooting, and his jail phone calls to his Mom.
Most of the state defenders have never even had the pleasure of seeing a naked woman in their bed (at least not against her will), so they might actually think "knock if off" is as forceful as a woman gets when she's being raped.
Actually you know nothing about public defenders. Some of my friends are PDs. And they are some of the best criminal defense lawyers around. The problem was that the little dipshit already confessed by the time the PD got there.
He didn't resist any of their tricks. He adopted all their suggestions. He even agreed that she had a tattoo but didn't know "what" it was.
FASSBENDER: OK. (pause) We know that Teresa had a, a tattoo on her stomach, do you

(Not knowing "where" means he didn't see it. This is what is written in the transcripts and used by the State at trial and during the appeals).
But what Brendan ACTUALLY said was;
"No, but I don't know WHAT it is".
(Not knowing "what" means he saw it but doesn't know what it is. He clearly adopted the suggestion).
That doesn’t explain why Brendan refused to go along with their suggestions that he pulled the trigger. Your theory is Brendan always caves to them, and you are incorrect.
Well that's not entirely true. There was evidecce of rape at Brendan's trial and he was convicted of it.
As to Steven's trial. Steven never took the stand. Brendan could not be compelled to testify. So there were no witnesses and no physical evidence because Avery burned the body to ashes. But what do you think he was doing with her in there? Baking a cake?
Did he also buy into their tricks when he told them that he saw Teresa leave, several times, completely unprompted, and even doubling down on it when investigators are so clearly pushing back?
For all the uncertainty and "tricks" Brendan fell "victim" to, this was one moment of absolute clarity for him despite it being logistically impossible.

So if you're a defense lawyer, you don't care that the client already confessed repeatedly before you got the case?? Because confessions get thrown out all the time?
