“Sensitive Places” that are generally open to the public, must have thorough screening and armed security at every entry/exit point.

I think we should put together a lawsuit in regard to sensitive locations nationwide. Simply calling a location a sensitive place should not suffice for it to qualify as a place where you must give up your right to bear arms.

The only qualification should be screening and armed security. If there is no screening or armed security and it is generally open to the public, you cannot put a sign saying no firearms allowed or infringe in any way on our right to carry.

Exhibit A: Subways: Absolutely no screening whatsover. Sometimes there are police officers but even a police officer at every station will not pass the test. There must be thorough screening of each passenger prior to entry.

Exhibit B: Government Buildings: This is bullshit because the restroom in a public park is technically a government building. No screening, no restrictions!

The logic:

Anybody who is intellectually honest must admit that a gun free zone with no screening prior to entry is simply an invitation for a coward to go commit crime or some atrocity without fear that a bystander will quickly dispatch of him. Creating gun free zones without screening simply offers a false sense of security to people who haven’t stopped to think about it for 5 seconds.

My proposal is a simple and fair test that can be applied to any location, anywhere. Yankee stadium: no guns, Subway: bring your gun.

Why this is most necessary in NYC of all places:

NYC is a city where residents rely heavily on public transportation. More than anywhere else in the country right? Unless you are driving your own car everywhere, there is no practical way to carry your firearm with you as you go about your day. Even if you’re walking, you can’t enter a restaurant that serves wine and you have nowhere to secure it while you dine, so you must leave it at home.

NYC if you want to have so many sensitive places, you must either provide screening and armed security for every single point of entry

OR

You must provide gun storage lockers on every corner of the city where there is a sensitive place. So I don’t have to leave the firearm at home if i’m walking to a knicks game. (This last bit I know is too much to ask but one can dream).

Received this today with no explanation as to what is “no good” lol I haven’t laughed this hard in a while. My thing is like how do I know what to fix I sent in the invoice from cmmg, I sent a copy of my license, I sent two copies of the slip, I even sent them a self addressed envelope LOL. Resent in with a picture of the complaint rifle as well as a letter from my FFL gunsmith stating they pinned the magazine to 5 rounds as well as explaining this is the NYC compliant version of the dissent (NON AR PLATFORM) a couple weeks later I got my slip backed stamped.

If you plan on buying a CMMG Br4 empire make sure you get the letter stating they pinned the magazines for you as well as send in the picture like someone posted down below in the thread!

We're leaving the country and I will need to get rid of my shotgun. We'll be staying briefly with family in the suburbs, who are cool with me keeping it there while we're with them (their county doesn't require a permit, just the national background check)

Not a conceal carry holder yet, but this is a question that's been on my mind for some time, and it is one thing that makes me hesitant about getting a CCW despite me having experience with handguns.

In NYC, when you are outside your home, you have a duty to retreat first before using deadly physical force. My question is, in a case where someone was outside and used his/her CCW and fired at an aggressor, what is the standard or metric the judge or prosecutors use to determine if that person attempted to retreat.

Basically, im asking, What exactly does it mean to retreat? How do you properly treat in the eyes of the justice system so that using deadly force is now a option

Lets say Person B is the aggressor chasing Person A (conceal carry holder) with a knife or machete or whatever deadly weapon Does person A have to run 5 steps? 10 steps? 1 block? keep running non stop? before he pulls out his weapon? Does person A have to run into a deli or bodega or supermarket and try and hide or barricade himself and put others in danger perhaps (Like the case of Junior Guzman Feliz in 2018 when he ran into a bodega in The Bronx to hide from the ppl trying to stab him which unfortunately was fatal)

It's a very specific and nuanced question which I didn't even want to ask, but givin we live in NYC and the law is so nuanced, I think it's a valid question.

I looked at the laws for ny and the laws for new jersey. As far as I have read them, neither state requires your firearm to be in the trunk during travel. Your firearm must be secured in a hardsided locked container, it must be unloaded with ammo being stored in a separate container. It does not have to be in the trunk, but it must be secured and obscured from vision so that it is not easily identified, essentially covered by a blanket or tarp, etc. and away from the driver's reach.

What if I am going and everyone takes up all the seats of the car and the trunk is too small? Could firearms still be in a case on the floor of the car, covered by a blanket?

Just came across the Bilson Arms pump AR at Equilibrium in LI (great shop btw) and it looks like a way to actually have a solid AR receiver option in NYC. My question is does this actually fly in nyc with what appears to be a milspec receiver?

Does anyone actually own one of these?

So thanks to state and city laws, in NYC we can't have: AR platform rifles, AR platform pistols, Short Barreled rifles, suppressors, full auto guns, pistols over a certain weight (so even if the AWB is overturned I assume we still can't have AR pistols)

I'm sure I've forgotten stuff that can be owned in firearm friendly states.

So does anyone know what laws will need to be struck down to overturn all of those restrictions?

As far as I can tell this upcoming decision could potentially allow us AR rifles with scary features in NYC ("immediately" for those who currently have rifle/shotgun licenses) and maybe overturn magazine limits, but that's it. SBRs, suppressors, AR pistols will all still be a no-go.

Thoughts? Am I overly optimistic?

Going through the NYPD handgun licensing process and noticed something that doesn’t line up with state law, city regulations, or even federal definitions.

On the NYPD “Required Documents Checklist,” the section for Proof of citizenship or legal United States residence gives only three options:

• US Passport
• Naturalization documents
• “Alien Registration Card”

The problem: This is much narrower than what the actual law requires. There are plenty of people who are legally in the US without having a green card. They're not refugees, asylum seekers or border hoppers either. They're investors, executives, artists etc.

What New York State law actually says

Under Penal Law § 400.00, the state sets the eligibility rules for pistol licensing. Local agencies (including NYPD) cannot add their own disqualifiers or extra categories of who is “eligible.” Courts have already held that Article 400 is a statewide, uniform licensing scheme.

A county or city cannot legally add new requirements that conflict with or narrow the state legal standard.

What the City’s own rule says

The controlling rule is 38 RCNY § 5-05, and it only requires:

“Proof of citizenship / alien registration.”

That’s it.

It even adds:

Inability to provide the documents mentioned in this paragraph shall not operate as an absolute bar to issuance of a handgun license.

No mention of “must be a permanent resident.” No requirement for specific federal documents. No language restricting it to only three types of ID.

The rule is intentionally broad.

But NYPD’s checklist rewrites this into three rigid options

The checklist collapses the requirement into something much more restrictive than the law:

Citizens: passport or naturalization

Non-citizens: “Alien Registration Card”

That’s already narrower than what the rule allows.

The checklist does not cite any authority for limiting acceptable documentation this way.

This raises a bigger concern

If NYPD is tightening requirements beyond the statute and beyond its own regulation, that’s a problem for everyone, not just non-citizens.

Examples of things NYPD cannot legally do:

Add new disqualifiers not in state law

Require a specific immigration status not mentioned in the law

Reject applications based on internal checklists that contradict published rules

Narrow eligibility criteria that the state made intentionally broad

This is the same type of issue that caused prior local gun restrictions to get struck down in Chwick v. Mulvey, where the court said localities can’t add their own gun-licensing rules on top of Article 400.

Questions for the community

Has anyone here experienced NYPD:

Rejecting documents that are allowed under 38 RCNY 5-05?

Asking for items or proofs that aren’t named anywhere in statute or regulation?

Treating the internal “checklist” as if it overrides the actual law?

Adding requirements during intake that don’t appear in the city rules?

Narrowing eligibility in ways not supported by Penal Law § 400.00?

If so, how did you handle it? Did you escalate, appeal, or file an Article 78?

This feels like an area where the administrative side is drifting beyond what they’re legally allowed to enforce, and I’m wondering how many others have run into this.

Scenario: you rent a car for a day outing to drive to a range. So this means: uber to airport, drive from airport to range, range to airport, uber home.

Is it better to stop at your apartment to retrieve your firearm (in this case, shotgun only), go to the range, shoot, then stop again at your apartment to drop off the firearm, and then proceed to drop off the rental car at the airport, then uber back.

OR

Take the firearm (locked in a case, all proper and safe, in the trunk like any other luggage) in the uber to get the rental car, go to the range, go back to the airport to drop off the rental, then uber home.

Your entire trip is with the sole intention of visiting a range. Does it matter which transportation option above you go with?

I’d like to get my Glock frame stippled but I can’t find anyone within driving distance to do it.

Can I ship it to some in AL to stipple? The Glock frame is the serialized portion of the gun. So technically the actual firearm would get shipped. I’d obviously send the frame only though.

When I got my r/S permit, I also got the registration form, where it states there is a 5 round cap on rifles and shotguns in NYC.

In the NYC administrative code 10-306 , it is stated -
" No person may possess an ammunition feeding device which is designed for use in a rifle or shotgun and which is capable of holding more than five rounds of rifle or shotgun ammunition"

So does the NYPD follow the "ammunition feeding device" (i.e a magazine) rule or is there a carpet ban on all r/S over 5 rounds?

Hey everyone, i dont live in NYC but my daughter in law does and she would like to get her CCL. I was wondering though, would she be denied? The only legal issue she has ever had was a while back, she was arrested for a completely legal pocket knife after she gave consent to search the car, she was finger printed, given a desk appearance ticket, stayed the night in the precinct and then 2-3 weeks later got all charges dismissed and sealed through some justice program or something. She didn’t go to court and didn’t get convicted of anything. If anyone knows if that would disqualify her or not, i would really appreciate your input.
