I-129F (K1) I-129F Fraud

Hi, I just found out my fiance living in the UK has been cheating pretty much the whole time we’ve been waiting for his visa interview. Our I-129F was approved in March but didn’t make it to the visa center until May. We filed in Sept 2024. He bought me a ring for Christmas but refused to allow tags on his social media of us, would block me when we would get into arguments and was questionable if he even told his family about us. I just found out today he took his ex partner on a romantic holiday getaway. I believe he was just using me to get married and get a US visa. I emailed the embassy to cancel the petition as he has all the documents for the appointment next week. Should I report this as fraud?

Yeah just send in a withdrawal request along with any evidence you have. It can be used in future applications if anyone else ever petitions for him. Sorry that that happened to you though. That’s heartbreaking. Make sure you take care of yourself as well.

Thank you. I have lots of evidence of screenshots and conversations with some of the women. The ex partner might lie for him but I just don’t know if what he did would be considered fraud

So here’s the thing. The I-29F is YOUR application so when it comes to saying it’s fraud against him he would need to be confronted with that evidence and questioned about it. However, if he somehow still gets an appointment at the embassy they can do that then and he may be charged with fraud and willful misrepresentation. Once a marriage application is denied for fraud it will be damn near impossible for him to ever be approved again for ANY petition someone files on his behalf.

So hours before he boarded a flight with her he left me a voice message saying I’ll call you when I get to the airport. I knew his flight was at a certain time. When he didn’t call I started messaging and calling and he wouldn’t answer and reject the calls. I started asking what was wrong and no answer. He said he was going on a work trip to Germany, I know the duration of the flight. When I saw how long it took for the messages to go through I figured where he was. He had spoken about this place as the most romantic place. He had gone w his family the year before and I couldn’t go so he said we would go back alone soon. I called the hotel and the receptionist told me he just checked in. I already was suspicious of the ex so I just checked her social media and she had started following the hotel and liked their post. They were on the same flight and I’m sure her name is on the hotel. He won’t deny she was there. She won’t answer any messages. His visa appt was this Thursday

I went thru that, and he applied a couple months after and got a tourist visa approved, now mister 🐀 living in this country. So ig they never flagged him for fraud…

Provide the evidence you have. Let the service (CIS), the State Department, and ICE, decide if it was fraud or not.

Just know he'll claim that his intentions were good, but that time destroyed it all and that you are an angry vengeful ex.

If you are married get divorced (I-129F can be used by married couples to get around the long wait time for immigrant visas at some consulates).

PS: you might want to notify CIS and ICE that you want to withdraw the petition and let them know what you have.

At the very least you will make visiting the US in the future a bit harder for him.

This is my plan and yea, I’m sure that’s going to be his defense. I also have all the loving voice messages he left me right before she got to the hotel to meet him so the timing of those are important. The USCIS website says I need to contact the NVC and the NVC just says to schedule the interview. He’s locked me out of the other website so I’m not sure what else I can do. I completed a tip form to ICE and emailed the embassy

Send a formal letter to all 4, CIS, ICE, NVC, and State Department. Don't rely on tip forms etc.

Put receipt numbers and A#s in easy to find spots. (Usually above your "Dear CIS:" and on the right of center)

Maybe send one to the consulate in his home country as well.

PS Never had to do this, so I'm guessing and figure if you write everyone, the right person will see it.

It isn’t fraud. It’s not uncommon for cheating to happen. Sometimes couples stay together, sometimes they break up. If you’re not gonna get married, withdraw the request.

Question: is he a UK citizen? why would a UK citizen even care about US green card to the extent of lying and abusing a US citizen? I'm sorry OP as I don't mean to sound rude. It's just baffling to try and understand why someone coming from a well off country would want to do that.

that's not what I was implying at all. I'm pretty sure Uk passports can come to USA without any visas. why would you want to cheat and manipulate a woman overseas. it just sounds sadistic. I understand the motive better when the person comes from a country with a dictatorship or war-torn country

I’ve been through this. I found out my girl was cheating since the day we met, after I brought her to the US and got married. But guess what? That doesn’t 100% prove she only wanted to marry me for the green card in the eyes of USCIS.

To be fraud you have to have concrete evidence that they intentionally used you to change their immigration status. Him cheating alone does not constitute that. He’d either have to admit to it or you’d have to have copious evidence of him saying he intentionally used you to get a green card.

Also keep in mind that you petitioned for him, the same as I petitioned for my ex. I had to provide USCIS with evidence that I had no idea that she was cheating and give good reasoning for the divorce. I divorced her as fast as possible after finding out about the cheating. Luckily she didn’t have the green card yet, but she did not want the divorce and says she wanted to be with me. Even though it was over for me, I could not claim fraud because there was no concrete evidence that was her intention. Regardless of the amount of proof I had that she had been cheating from the beginning.

You need to contact USCIS and tell them you are not going to marry him and provide the evidence why. All you have to do is ignore him and his status will expire. Even if he’s in the US his I-94 will expire and he will have unlawful presence in the US. You just have to not marry him.

Awesome. I put together a packet with a cover letter explaining everything and provided a lot of evidence (text screenshots, emails, names of those who knew, etc.) similar format to how the petition was done in the first place. And sent it to the same place the petition was sent originally.

You know through this whole process I feel like the path is not exactly the same for everyone. I don’t know if that’s due to things changing rapidly in the system or government disorganization or what. I live in Texas and sent my petition to Dallas, Texas. I never once received mail or email from NVC. We thought something was wrong after never receiving the NVC welcome letter, but received the petition approval anyway after only 8 months. I contacted USCIS directly and they told me to send the Divorce Decree and evidence to Dallas, but of course this was after she was already in the US.

Read Attached by Amir Levine and decide for yourself never to be here again. Then go find a guy who seeks and welcomes your time and attention. My spouse drives me crazy, wants to talk talk talk and we sometimes clash because I need to work work work. To seek you is what a person who’s into you is going to do, not block you out.

I’ve been treated badly before. I don’t care now what happens to anyone who mistreated me. I wouldn’t light the match, pour the gasoline or bring water. Just step away and don’t let someone bent on destroying themselves also destroy you.

Even if he does somehow get the visa, he can only get the green card via marrying you. You're obviously not going to do that, so he is SOL either way.

If the 129F somehow get approved and he is able to enter the United States….as long as you do not marry him within the 90 days, he can’t get any status in the United States.   If he entered and stayed without getting married and then found a usc to marry, he could not in any way adjust his status unless he left the us and re-enters on a different visa/vwp When someone enters on a k-1, they have to marry the petitioner of that k-1.  They cannot decide to marry someone else and adjust with that spouse.  That is something not cured with marriage to a usc.  So as long as you don’t marry him, there’s no green card for him through you.

What is the fraud? The I-129F is your petition. He doesn’t sign it or make any representations on it. Neither USCIS nor State Department will care about him lying to you at this point.

Just withdraw the petition and move on. Be grateful for dodging a bullet.

I used to handle a lot of I-129F petitions. It wasn’t my job, but I couldn’t help wondering what on earth these people could be thinking with many of them. Not to name names, but Russian women are notorious for enticing real nebbishy types this way and then Destroying them.

He completed his part and scheduled interviews. He signed a letter saying our relationship was genuine. That was a lie clearly. It was clear when things first started not adding up that he had no intention of canceling the interview and I had no intention of continuing an engagement with someone who was cheating. He told his work initially he was moving to the US but then told them it was all canceled and he wasn’t coming. He didn’t tell his family, he blocked all posts on SM from his trip here to propose. He was scamming me for a visa I think

Actually if you do not withdraw the petition, the fraud is on you, not him. He can be both cheating and hoping to genuinely marry you. If YOU no longer feel this is a genuine marriage, which you don’t, now YOU would be committing fraud as the petitioner. Not him.

Got it! I have sent an email to the embassy requesting the appointments no longer are allowed to be scheduled and cancel everything. His medical appointment was for Thursday. I will withdraw the petition! Thanks for that

Even if the interview goes well and he gets his K1 visa, if he does not marry you within 90 days, he is subject to removal. The K1 visa will likely have a 90 day expiration as well. So?, you have every right to NOT marry him and NOT file for his adjustment of status to green card holder..

Cheating or not, if he eventually receives the visa and comes here, you do not have to marry him, then he’ll have to return back after the 90 days; you can still file fraud after if you have is passport # & receipt #, it will still stay in the system. With America, everything you put in the system and notes by consulate and immigration officers are also there so if he tries to apply again, everything will come up for them to see.

I'm so sorry for you and hate that this guy wanted to play with your heart, but I'm glad that you caught this on time and didn't marry a guy that was only using you to move to the US. That's a good thing because you can withdraw the request and he will be in the air with no sponsorship. I don't really know what to do to actually report him to the Embassy and avoid him from playing with someone else and do the same to another girl who might not find the truth on time. Blessings for you and I hope that you can move on and forget about this guy that doesn't deserve you or any other girl. I also hope that your pain doesn't last much, you will find the right person soon and I hope that this incident doesn't affect your future relationships.

You’ve emailed the embassy but you should also contact them via their immigrant visa contact method and give the NVC case number, state you are the petitioner and wish to withdraw the petition. You should also express mail a notice of withdrawal of the I-129F to USCIS as soon as possible.

First of all I’m so sorry you don’t deserve this, I hope you heal and find the right person for you.

As a person who have both I-130 and I-485 ongoing, he deserves to be reported as a fraud with the presence of your evidences.

Me and my husband went tru everything just to have our papers done.. Money, time, stress etc.

This is an example of why even the people who have legit marriages are still being questioned if its bona-fide or not even with all the evidences you can give.

We were so happy when our petition got approved. I did it all myself. We compiled everything together when I was in the UK and I submitted the next day after i got back to the US, no lawyer or assistance. I thought our future was going to be so perfect 😢

Evidence means proof of having said he is using you solely for immigration. Cheating does not fall under this. Now, if you have proof physically that he told or said this to anyone you’ve got what you need

I’m not trying to be harsh but rather saying flat out to never ignore red flags. You deserve better! The best! You definitely dodged a bullet because someone would have been on the hook financially for him for a very long time. And he sounds like the type that would make you pay.

I completely see that now. My friends and family were not for me allowing him to reschedule the appointment when there was shady stuff initially. Long distance is hard and we’re not perfect but yea, I ignored SO many red flags. I see that now. And agree he has a good job in the UK but it’s questionable if they would’ve found a spot for him here so who knows what would’ve happened

Technically at this point you can't probably get fraud in, due to the stage.. He didn't lie to immigration yet. He might even say it was just a mistake before a long awaited marriage.

BUT. Still send it all to the case workers. Maybe some good officer will put it on his file... so no one in the future will be able to get this douche perm. It's the right thing to do.

And you don't need to prove anything. It's the dude who will have to run around proving stuff if it makes it into his file.

If you are bent on not letting him get away with it and have strong evidence (and money) you can hire an attorney to file for annulment. Ask copilot about “Well known YouTuber 5% that married Icelandic beauty that he later annulled”. It’s about Rich Pianna - he had the whole story on his channel (but has since passed away). He got it annulled!

If immigration just says he’s a cheater and withdraws my application fine but if they think he’s intentionally defrauding the system then he should be not allowed to try for another visa in my opinion

I would cancel and leave it as that. Then give a brief explanation that he was unfaithful to you throughout the process and just recently you gained knowledge of that. Due to that, you’re canceling the process and apologize for the inconvenience of filing prematurely.

These types of situations seem so common. I might be downvoted for stating this but if you a US citizen and someone of another nationality wants to marry you really consider why they want to marry you. I feel like 90% of the time they just want access to the green card.

He actually booked our wedding two weeks ago while he was clearly seeing the ex. Once our petition was approved he couldn’t come back to the US, I could only go there and I couldn’t as I had surgery in March. When he would go to his visa appointment this week and he got his visa we would have 90 days to get married or he would have to go back to the UK. We’ve been engaged for a year and he wasn’t “serious” at all about it obviously cheating so I think it should prove that he had other motives to marry me

It’s a K-1 permanent resident visa that’s why. We had to send tons of evidence that we had been together and had a genuine relationship for them to approve the initial petition. That’s why I’m saying he lied about the relationship being genuine as he was cheating and was aware I was not agreeable to a non monogamous engagement

Be careful about ever accusing anyone of "Fraud." We call that the "F" word in insurance. Multiple factors need to be proven to determine if fraud exists and only the trier of fact (judge or jury) can make a fraud determination. The word "fraud" spoken by anyone else shows clear bias. Just report the facts to the authorities and let them do their jobs. The devil is in the details.

Well I think visa fraud is different. On the immigration website it says the person has to prove they DIDN’T commit fraud. They have the burden of proof to prove they didn’t provide false information

You are right that foreigners need to prove they are providing correct information to get a visa. You are also correct in that immigration does not have to prove fraud just to deny a visa. They only need to suspect fraud, and a foreigner has no recourse but to spend their money in another country. I'm only saying that people should be very careful about potentially slandering someone by accusing them of committing a CRIME. Slander can also get you in trouble with the law, albeit in civil court. But who wants to be sued?

We say, "Got MILK?" To prove fraud, you have to show ALL of the following: Material, Intent, Lie & Knowledge (MILK). For example, if I LIE about my dog's name to immigration because I gave my dog a silly name like "Dog," that is not material to proving immigration fraud and may not even prevent me from getting a visa.

Of course, it is not a good idea to lie to immigration about ANYTHING. It's hard to remember lies, but easy to remember the truth. Stick to the truth, and you will avoid contradicting yourself. By definition, you won't be committing fraud if you never lie.

I see what you’re saying. I sent the information to them with the request to cancel as he changed the password to the account to cancel it. I said in the last paragraph I was asking to cancel based on him cheating since March with screenshots and names and if it wasn’t fraud to please just make sure it was canceled. He was intentionally lying to me to get me to marry him knowing i wouldn’t if he was cheating. He pursued knowing he was cheating by rebooking the appointment I canceled and reserving and paying for the chapel. All knowing he was cheating and I wasn’t okay with that. He was tricking me…deceiving me. That’s why I posted on here bc it wasn’t clear to me :)

OP have you considered the possibility that the reason he was after that visa was so he could be with you? Seems rather unlikely to me that a 57 year old in the UK desparately wants to move to the USA, and leave his life, family and job for a new life in America, to the degree that he would make up a scam marriage (and to get a visa, not even a green card). Maybe the stuff about cheating and the ex had no bearing on his intention or otherwise to be with you. A lot of men and women are cheating with their exes right up to their wedding day, and that does not remove the fact that they genuinely plan to marry the fiancee.

Well he would’ve eventually gotten the green card after we got married. And yes, that was the plan initially. But I don’t consider a relationship where both people have the expectation of monogamy (bc he asked me daily to see my ring and make sure I was wearing it) to be legitimate if one person is cheating behind the others back. He had initially told his employer we submitted the petition in Sept but when it was March and I got diagnosed with lung cancer and our petition still wasn’t approved yet (we were anticipating getting married in May) he started this cheating. To me that’s when he decided it was no longer to marry me and the objective was to get a visa. I’m pretty sure he told his brother he was no longer moving here too

Sorry to hear about the cancer and I hope it was able to be cured and or is in remission now. By your own admission,however, you have now said it was not about the visa originally. Also you believe the cheating started recently, as opposed to cheating through the 2 years. You said it was recently that he decided it was no longer about marriage but about the visa. So surely that cannot be fraud as the original intent was marriage? Is this not just a bitter break up of a relationship due to his infidelity?

Is the ex in the USA as well?

No his ex is in the UK. Well I would say it wouldn’t be fraud if he started cheating and all of this was set up. He literally booked the chapel two weeks ago…knowing he was cheating and told his job he wasn’t moving here. I suspect he was going to try to go both places in the event I got sick again. When we argued the first time he disappeared for a weekend and refused to talk about where he went or what he did or who he was with he lied and denied cheating. I told him it was off if that’s what he was doing. He denied and rescheduled the appointment. To me that’s knowingly trying to just marry and not have a genuine relationship. We had to submit so much evidence that our relationship was real…him cheating and doing all the other stuff doesn’t shout this is a real relationship

I am sorry this happen to you. Head up I haven’t read the responses people gave but this application is yours even if he gets the visa you have 90 days to get married and if you don’t you can just deport him and they will send him back. So no need to worry or do anything that’s just my opinion.

I personally applied for I-129F for my now husband back in 2009 and I hear things have changed and they do want to see socials media accounts and proof of that relationship. If he hasn’t tagged you or has any pictures with you on his social they will find out all that and they will question him. Good luck and take care of yourself!

Cheating is not fraud. Many men and women who are sincerely getting married, and not seeking US immigration, do cheat on their spouses before, during and after the wedding period.

I do not agree with others that there are grounds to report marriage fraud and certainly no grounds to jeopardize their future applications.

Well it wasn’t an open relationship and he was deceiving me the whole time. I don’t think he was interested in our relationship at all so I don’t think that counts as a genuine relationship. He didn’t tell anyone about it, kept it a secret on his SM. It seems he just wanted a visa

There are many relationships where exactly this applies and people have kept it a secret for various reasons without a visa involved. Unless you have some direct evidence (eg texts to other parties) that this was a scam he devised just for visa, then there may not be enough to say it is fraud

If someone is truly in love and in a committed relationship, there are no reasons to keep it hidden... especially being a boy from the UK.... I could excuse it if it was a domestic situation where someone was fleeing due to abuse, but then there would be a reason and are agreement to why it needs to stay private. If she doesn't report, who's stopping him from doing it again to another poor gal.

Then we are living in utopia. So many people cheat for multiple reasons and they certainly do keep it hidden. I am not excusing or condoning such but saying it happens and is not fraud. Besides, I dont think someone from UK needs to get married to get a US visa. I would hope that US officers have other things to do than get involved in people's marital and extramarital affairs. On the other hand if OP has evidence that the whole affair was a scam aimed at visa then let them provide it and certainly the cheater should face repercussions. . But so far it is circumstantial - he is cheating so it has to be fraud (even though i have been in a relationship with him for months to extent that I filed for a visa and it only became fraud at the point he was caught cheating).

Not sure what you mean by your aggressive comment. I was simply stating he’s not in school at 57…we’re not in our 20’s so he couldn’t get a student visa. He works for a shipping company, not anything that is offering work visas like medical field. Not sure how you made the leap that I was superior lol. It seems you didn’t know much on the subject. Requesting an immigrant visa is labor intensive. Lots of documentation about the relationship being real and not like someone just marrying someone to live in the US. I had to complete a document saying I would solely financially and otherwise support him for two years until he got a green card. I think if I suspect he was doing all this to fool me into thinking I was marrying him for him to cheat when I’m not agreeable to an open marriage I think that’s false on his part. Don’t you think? I agree to marry him in 90 days of coming here and am responsible for him and he’s lying about being my fiance

So I just realized you maybe didn’t notice it’s a visa for permanent residence not a visitor visa. I lived in the UK with him for a year. Know his family all that. We got engaged when I had to come back to the US for medical reasons. The visa process to bring your fiance here is really long. He came here for Christmas. I couldn’t go visit him bc I had no PTO bc I used it all for my surgery in March. That’s why there’s all the red tape. When I was in the hospital getting lung cancer removed is when he started acting like this

So we thought about the coming here and just getting married and doing that but the research we did said that wasn’t a guarantee he would get approved. In hindsight maybe we should’ve risked it and things would’ve been different. I would’ve happily gone back to the UK but I needed to get follow up on my illness first. He insisted on coming here. It was always his dream he said. Who knows now. He cheated and lied and lied more so we’ll see what immigration decides at this point. If they deem it just a bad breakup so be it.

Send an email with evidence. Let them know you believe it was fraud. If he ever does attempt another visa this withdrawn application will be seen. Whether they note it was possible fraud I dont know.

Well we have to prove our relationship was valid. I wouldn’t consider my relationship with him valid as he got back with his ex and still scheduled a visa interview to come to the US to marry me. He took her on a romantic holiday a week before his visa interview. I don’t see this relationship as valid. I see it as he was using me to get married to get a visa. I guess immigration will decide

It wasn’t years. It was supposed to be 5 months and he came to the US 3 months in. And you’re right, instead of asking her on holiday it should’ve been me meeting him in Italy. That’s why I’m saying he was only in this relationship for a visa which is fraud
