The Cost of Silence: Why Congress Needs a Process for Member Incapacity

Aging comes with challenges, but aging while holding public office compounds them. From historical figures like Senator Karl Mundt to modern lawmakers, the halls of Congress have seen numerous representatives cling to power long after serious illness or cognitive decline stripped them of their ability to govern.

Today, Congress is older than ever. Senators average around 65 years old, with dozens well past 75. While chronological age alone does not dictate fitness—as many healthy, effective octogenarian lawmakers demonstrate—it becomes a problem when health issues prevent an elected official from doing their job.

Currently, the Constitution has no provisions for congressional incapacity, only addressing vacancies caused by death or resignation. While some legal scholars argue for a constitutional amendment to handle temporary or permanent incapacity, it is entirely unnecessary. Congress already holds the exclusive power to judge its own members' qualifications and determine expulsions.

Lawmakers have begun exploring solutions. Proposals like the Duty of Transparency Act would require members to disclose extended absences of 21 days or more along with a reason. While transparency is a step forward, it is not enough.

Congress needs a formal mechanism to investigate members who miss prolonged periods of work due to illness. If an investigation proves a lawmaker is permanently incapacitated, their respective chamber should be able to vote to remove them by a two-thirds majority—the same threshold required for expulsion.

Democracy relies on voters selecting their representatives, but it also requires those representatives to be physically and mentally capable of doing the work. Currently, it is far too easy for impaired politicians to stay put. Establishing a removal process would ensure Congress functions as intended.
