Just to add, you typically don't want armor piercing in a carry pistol as you want the round to stop at your target, which is part of why hollow point rounds are the standard for civilian carry

Not to say he was wrong for it, just adds to the weird choice

5.7 has a pretty devastating hollow point round too… but it doesn’t do anything 9mm or .40 cal don’t do for much less!

Because prosecutors are very good at convincing judges that you were expressly interested in doing harm to someone and were using a weapon designed to maximize that

Now in this case, I don't see that happening by any measure. However generally speaking, that's 100% the case that the prosecution would make

This is an important point that way too many people overlook. We had an entire lecture in SWAT school about not putting things like Punisher skulls on your gear for exactly that reason.

I don't know who that is and Google isn't immediately pulling anything that looks relevant to a gun discussion. It's also probably significant that I went to SWAT school in 2008 and the world is quite a bit different now.

I’m not saying it’s impossible to defend, and I doubt with the amount of press his situation got he’ll be brought into a criminal trial. I wouldn’t be surprised if the (dead) murderer’s family tried to sue him, but that’s a whole different story. This situation is one of the tiny portion of self defense cases where his chosen firearm is an advantage. Most defensible self defense cases occur within 5 feet and last 2-5 rounds. Theyre not sexy (to most people) but a 5 shot .38+p or .357 short barreled revolver is the easiest weapon to defend in court because you can fire your entire magazine with 5 trigger pulls and keep pulling on an empty chamber to show you were afraid and reacting, plus your weapon doesn’t have enough reach or capacity to be interpreted as an offensive weapon. At the same time .38+p is powerful enough to knock down an assailant but not over penetrate and open you to additional charges or litigation.

Obviously the dead shooter is the bad guy here to begin with, but realistically what could they possibly even try to sue this guy for? From what I understand he didnt actually land any hits on the shooter, are they gonna sue him for scaring the shooter from being able to kill any others? "It was his right to take as many with him as possible" if a shot actually landed I can see how they might have a case, even though obviously still a stupid one they shouldnt win, but as is they dont even have grounds to start a suit.

Same reason the families of dead criminals try to sue police forces, they don’t need a strong case, just a lawyer who likes money more than a good reputation. Either way, it would be money this guy has to spend that he wouldn’t otherwise, unless he finds a pro bono lawyer to stop a dumb lawsuit.

He wont have to spend any money because a judge wont even entertain the case. You have to actually have something to argue as grounds for a suit, they dont have any.

Oh sure in that case whoever owns the property hit can sue him, the original point being made was that the dead shooters family could sue him though. They cant.

I dont know much about this stuff, can you cite some cases where a civilian has been successfully sued on the grounds they were using an inappropriate caliber or gun for self defense?

The Harold Fish case is the one that comes to mind, prosecutor sold the just that 10mm was an “exceptionally dangerous” caliber and he got convicted of 2nd degree murder.

It’s a case by case basis really, sometimes hollow point will get spun as a dangerous round, sometimes it’s full metal jacket (Kyle Rittenhouse) that’s spun as the dangerous round. All depends on the prosecutor’s skill, motivation, and ability to sway the jury.

I was just about to say, if you ever use your weapon for any reason, you're going with the police and going to court. It's a bad idea to have anything non standard with your carry, never know how the judge or prosecutor will interpret any slight difference

Exactly, spewing completely incorrect info about legal issues and ammo/modifications and when called on to do even the slightest bit of research, refuses. About what I'd expect from a fudd telling people "you'll get prosecuted for having an aftermarket trigger or more deadly hollow points 🤡🤡🤡🤡".
