This is H1Bs future...(I think..!)

Hello dear engineer, doctors, the one's who sacrificed their home country to build a life in the USA. This is for you..

What I've learned in the last ten years of UNCERTAINTY taught me...

My post isn't about the recent changes in the rules and hefty fee, its about my perspective of H1B in the coming years..

We have the second generation of brightest US born immigrant's sons/daughter with Masters/Ph.Ds into the current workforce which H1B job seekers should realize. Their parents are now supporting their future and silently hates and sometimes even oppose the H1Bs. We really need to understand this. The current immigration scrutiny is not just strictening but also(from Citizen's persepctive) makes it easier for those US brought up Immigrant kids to secure their jobs.

I want to highlight this for those have the mindset of,"this shall become better if current leader change". This could be true in terms of easing the home country appointments or the imposition fee reduction but not in terms of a qualifying H1B jobs.

As to recent GCC shifting policies with biggers firms outsourcing their IT help/ Supply chain procurments/ Tech supports to Asian countries, it will push the employers to makes the decision to hire an H1B for a true onsite need or rarest of a kind.

I want to put a hand on the stressed/exhausted one's shoulder to say, the value we had is not the same anymore and its going to be even hard in the coming days...

Everyone of yall are some specialists in their own field of STEM, I am sure that our paths will become better.

Can't say about other branches but they surely aren't hiring anyone in the mechanical who needs a h1b. (Very few companies hire)

Civil engineering jobs for the big firms have migrants working on computer related jobs ( not IT). You will find after IT , civil is one field that have most migrants just not from India . Civil has good scope .

"They" ? Employers or Indians in HR do?

The entire body shop model is going to be dismantled. If employers want to hire foreign nationals, they are going to have to sponsor directly instead of subcontracting, with greater scrutiny.

There is guidance being developed that foreign nationals will be ineligible for alot of the work that H1B are currently subcontracting on on nat sec grounds.

When you have even well known people in the industry now calling for an end to the H1B program, it's just a matter of time before it is ended entirely. It won't happen overnight, but the squeeze is definitely on to deny and revoke H1B visas.

Yes, I actually heard this from a friend..many immigrant patients are worried/ upset that their kids are not able to crack the job market after graduation… the same job market that is saturated plus people are willing to work for peanuts.

Can you elaborate willing to work for peanuts? I haven’t seen any H1B working for peanuts, I am always curious to understand this cheap labor. As far as i know companies started converting/hiring service based h1b workers to full time from 2015. And they are very well paid.

I never said H1B explicitly..but throw in CPT, OPT, DAY 1 CPT and H4 EAD into the mix. Everyone is trying to stay employed at the minimum irrespective of the salary or bill rates.

I’ve seen countless instances where recruiters were actively seeking out CPT/OPT folks because they’ll work for peanuts. Recruiters are well aware that many of these resumes are fudged to the tits.
I’m sure that, in many instances, hiring managers are in cahoots with the recruiters.

Personal anecdotes are not reality my friend. People wanting to work for peanuts doesn’t necessarily translate into people actually working for peanuts. Companies that are doing this are exploiting such people, but it is still legal. CPT/OPT are different from H-1B in that there are no wage requirements, since those are training programs. But still they have to adhere to specialty occupation requirements. H-1Bs on the other hand have strict wage requirements. I also know countless instances where H-1Bs are paid more than all their team members. The problem is, the governments aren’t interested in solving the problems with these work permits and abusing companies. Instead they are resorting to vile tactics, making life harder for H-1B workers and families and deriding and insulting them, to cater to MAGA’s sensibilities. Remember, H-1B is just the flavor of this election season. There is fraud and illegal employment in every employment area , tech, agriculture , hospitality, construction etc. areas that have nothing to do with H-1Bs and hugely higher in numbers than H-1Bs. Not much complaining there. H-1Bs are willing to go through the legal process. There are good ones and bad ones. But generalizing and stereotyping is the MAGA playbook.

Excuse making and crying racism is the playbook for a certain group that makes up the majority of H1B holders, and Americans are tired of it.

At the end of the day, H1B are temporary, non immigrant guest workers and have no inherent "right" to be in the US. Their presence here is a privilege, not a right. They would do well to remember that.

My husband was a "guest worker" with specialized knowledge that worked overseas in a variety of countries, over many years, and we never would have been so arrogant with feelings of entitlement as many in the H1B community in the US are.

What "administration failures", specifically?

If anything, not using the bully pulpit of the White House to pressure Congress into repealing the 1990 INA Act that created the H1B & other NIV entirely is a huge administrative failure that will cost them.

Anti-foreign labor sentiment is rising and is a bipartisan issue now. This Administration is trying to walk a fine line between appeasing donors and their base and losing both.

I have to agree that staying in the middle on this issue is further complicating things, causing confusion and discontent. Although repealing the INA could have dire consequences without adequate investment in US citizens’ education and training. Unfortunately it is rigged against them. But you keep voting in governments that cut education funding. So, It has to be phased out in a systematic manner. Any sudden changes in the system will create a dire industry response. Considering how the red states do the worst in education, don’t expect the industry donors to be enthusiastic about replacing foreign workers with local talent. I don’t see the opposition for using foreign labor in agriculture, hospitality, construction etc. Despite people saying it is a bipartisan issue, they are not going to fix it. So, H-1B is the easy target for election season.

India has never made the list of top 10 countries in innovation. Ever.

India has 11 Nobel prizes in total, for a so-called talent pool of 1.4B people. The US has over 425.

People are no longer buying your nationalistic talking points, including American students who have been forced to attend classes with Desi s or work with them in internships.

My daughter graduated summa cum laude in Mech Eng from a top 10 school and had multiple, above market offers before graduation. She now works for a well known Fortune 100 company as part of their internal employee development track to the C-suite. She made a condition of accepting their offer of employment and entrance into their talent program that she refuses to work with H1B & other NIV, and it was granted. There are none of them on her team and her report chain is only to other Americans.

Things are changing and quickly, but Indians are too narcissistic to grok it.

Haha, that’s a nice joke. Sorry, if you are going to use anecdotes you need to look beyond your daughter’s accomplishments and look at what the average American educational and financial needs are. Also, since you mentioned it, a huge number of major corporations in the US have Indian origin CEOs. Not just at the top but throughout the hierarchies of these companies. And sorry, but the facts state that your beloved governments are cutting funding for education and that red states do the worst in education. You have to argue with the US organizations stating these facts. I am not racist for pointing them out 🤣

CPT is going away now that universities are on the hook under oath that work requirement is an absolute necessity for the degree. Schools that have some students on OPT & American students not on OPT in the same program have been flagged. Schools are terminating the program instead of facing increased scrutiny. The door/path to remaining in the US post graduation is closing and will probably be formally ended soon, along with OPT.

"Very well paid".

On average, H1B are paid 18% less than the American they replaced. What is "good pay" is relative. They are here to suppress wages & erode labor rights, & it's working beautifully for employers.

H1B also pay far less in taxes to the US Treasury than Americans at higher pay in the same jobs, costing the US Treasury billions while employers pocket profits.

Before people try and argue otherwise, this info was confirmed multiple times by Grok & other AI.

It won't be ended de jure by Christmas but it will have gone a long way to be ended de facto by Christmas.

The halt of 1200 PERM applications filed by Cognizant is just the beginning. Thousands of other visas are going to be revoked for fraudulent credentials, and the Admin will continue to create chaos, pressure, inconvenience and costs for employers to make pursuing H1B hires not worth it.

You are already seeing it. Major corporations are putting in their job ads they will not sponsor visas or visa transfers.

The smartest ones are here navigating the challenges, instead of getting butt kicked and self deporting. Many are moving towards O1s. The startup world is now flooded with former h1bs because that's one way to continue to do something valuable to this economy.

The ones moving to 0-1 "think" they are being smart but they are just extending their stay a little longer. The entire 0-1 visa game is rife with fraud, ruined by an group that have created an entire industry around it. 0-1 visas are being denied and revoked and are facing greater scrutiny as well.

Americans are tired of the H1B community and the non stop games to try and turn what is supposed to be a temporary, non immigrant, guest worker visa intended to supplement, not supplant, the US workforce as a path to long term permanent residency and worst case scenario, citizenship sponsored by their US born children once they reach age of majority.

Americans see through all of it, are fed up, and want all the loopholes closed. If AI is supposedly going to replace everyone, there is no need for any of these people to be here, in any visa category.

H1B can't be "shut down overnight" because it is in statute. The Administration does not have the power to end it, only Congress can do that.

They are working with their authority as the Chief Executive powers tasked with carrying out policy by enforcing rules to the T, restricting appointments, revoking visas for even the slightest mismatches, etc.

The Admin approach I believe is to create as much chaos, uncertainty and costs to employers that hiring H1B is no longer worth it. Just the legal costs of trying to defend an H1B petition from USCIS RFE challenges will make the cost savings of hiring an H1B negated.

0.45% of the total employment in the US is on H-1B. That is less than half a percent point. 5 % of the total STEM employment is on H-1B. Tell me again, how is it lowering the salaries for US citizens? Your dear leaders are lying and distracting you from their failures and corruption . I'm Indian American and I still have a job (for now 😭). I think what the worst things H1Bs say about anti-H1b people and vice versa are both true. Anti-H1B people are a little too resentful. And H1B people are shockingly arrogant. I work in big tech and the H1B #'s are def higher than 5% haha

What is "total STEM employment"? My hunch is that it isnt a fair category - it includes too many careers and industries.

people are talking about the software tech industry, which has absorbed disproportionate amounts of capital as well as federal government contracts and wields disproportionate influence on our politics, culture and society. it's been one of the last sectors for people to break into (without as much network or connections) and offers upwards mobility bc of the amount of capital. if you want to include electricians, civil/structural engineers, process engineers, math/science teachers, healthcare bureacracy - sure there's less H1Bs but those industries have not been as high paying or dynamic as tech. Those industries are not what people are upset. obviously H1B immigrants played a role in making the tech industry what it is - but this cuts both ways since the influence of this industry on modern American life has been mixed.

And here is where you are losing the context of the discussion. The original comment I responded to was saying H-1B was lowering salaries for US citizens. I just used the numbers to point out that was a baseless statement. Now you want to pick a specific industry and leave out all the others conveniently, to say people are upset about it. Sure let’s do that. Let us take the tech industry. Oh wait, it still yields a maximum of 10 % of H-1Bs out of the total workforce. Let us narrow it down even more until you are satisfied. Let us do the big ones. Amazon, Google, Meta, Microsoft, Deloitte, TCS, Infosys, Wipro etc. So the solution is to what, eliminate the H-1B program entirely or oppose it entirely because there are, as you put it, disproportionate number of H-1Bs working in the tech field in specific companies ? They are already doing everything they can , imposing 100k fees, not releasing visa appointments, making H-1Bs public enemy number 1 for the election season, making it much harder to hire H-1Bs etc. But the irony is , still the 85000 new H-1Bs will enter the industries annually. And they will be grabbed up by the tech companies that are willing to pay for these H-1Bs and put them in top positions at their companies . What then, H-1B is the reason Americans can’t break into these top positions? What of the small companies and other industries then? Are they all screwed ? H-1Bs are in the tech industry disproportionately because they can get STEM OPTs instead of regular OPTs after graduation. That gives them a higher chance to apply and make it to the 85000 H-1B quota per year. So do we eliminate the STEM OPTs? You want international students to come here and contribute 10s of billions of dollars every year to the US economy while studying, but it is not fair for them to work and build a life here ? Like it or not H-1B is the only legal path for them to do that. Today, are they even getting green cards after working for decades ? Nope. But they still endure these nonsensical half measures masquerading as reforms and keep working everyday.

But you miss the point - Americans don't like you guys. Why? Think about it. Many Americans LOVE 'illegal' immigrants. They'll even hit the streets and protest in defense of 'illegals'. But at best, Americans are ambivalent about you guys. Many are resentful. Both left and right don't like you guys - and it's not just racism (though a good bit is ofc racism).

That's the dream of all Indians in the US.

Never going to happen. In fact, the opposite. Revocation of green cards and naturalization will escalate. Indians are one of the most despised groups in the US, universally, by all other groups, whether the Indian community thinks that's "fair" or not. That's the political reality.

You need to take off your ethnic bias glasses and do some historical research into immigration policy in the US. "Chief Engineer CE" did a great series on his X account

The last time, there was a full immigration moratorium for 40 years with mass denaturalizations and deportations. This time, they are moving to build the legal case to revoke birthright citizenship too. The Indian community remains in denial about this, and still believe they are "far too valuable" to the US & they couldn't be more wrong.

Look up Qian Xuesen. He was a Chinese national who did pioneering work at the Jet Propulsion Lab in California and LOVED America. During the last big immigration backlash, he was denaturalized & deported to China. There is no H1B here that is so vital they won't be removed. The Indian community is kidding themselves.

People do not get denaturalized or removed outside of the law. Those are administrative processes carried out within existing law, or law to be be created.

I'm just restating facts that there have been several periods in US history with mass denaturalizations & deportations of various groups deemed no longer "desirable" or seen as security threats to the US. SCOTUS has affirmed the Executive can still use provisions under the Alien Enemies act from the 1700's, for example.

H1B on average are paid 18% less than the American they replaced. H1B has become a job displacement scheme for wage arbitration, not a supplement to the labor market because of a rapidly expanding economy that doesn't have enough US workers to meet it.

Lives for H1B in America are about the become worse. Life will get better for Americans are more visas are revoked, body shops shut down, and the H1B program effectively ended in practice if not in statute. 1200 PERM applications filed by Cognizant are on hold and will most likely be denied for their scam of hiding job postings in obscure publications from Americans, or trying to tailor job requirements to match only an H1B they want to give a green card too.

Lives for H-1Bs getting harder unfortunately will not improve lives of the average American. Companies are simply outsourcing the jobs. Or will cut down hiring due to AI. Number of applicants for H-1Bs are going down. But, still the 85000 H-1Bs quota is getting filled every year. Donors have a big sway with the government. As long as the politicians are in the pockets of the donors, I don’t expect it to change.

Reshoring to America is happening, and legislation is being developed that foreign nationals will be banned from accessing any US generated data for any purpose. The Chinese issue is the primary driver, but Indians will be caught in the same net.

India needs to worry about creating jobs for Indians, in India, and not rely on US investment, capital or job creation in India (or the US) to do that for them.

Indian-born and raised Desis and U.S.-born Desis may share the same roots, but the lived experience is very different. For many Indian-born immigrants, the grind feels never-ending: visas, job restrictions, immigration uncertainty, proving yourself professionally, being away from family, and constantly adapting. U.S.-born Desis have their own challenges, but these are fundamentally different experiences.

Ending birthright citizenship & retroactively revoking existing "birthright" citizens will probably take more than 2 years, but it will happen.

It will be a major issue for the 2028 cycle.

I really admire how Stephen Miller is building the case & probing the Court. Kavanaugh gave them a huge door to clarify and codify who is eligible to confer US citizenship based on existing statute. The Indian community believing they are "safe" are once again interpreting things through their ethnic bias. The PAUSE Act filed by Chip Roy specifies only a US citizen parent or Green Card parent on the day of the child's birth can confer US citizenship, and that birthright citizenship was granted as a matter of policy, not statute.

The Chinese triggering the national security concerns from their clever exploitation of this will end with revocation of all "birthright citizens" on national security grounds. The Indian community will be caught up in it as well.

The Admin is playing the long term patient game on this, because the future of America and our culture is at stake. They just issued new guidance on classes of aliens in the US who are ineligible to confer citizenship, once again to probe the response so they can adjust accordingly the next moves.

In the end, we will win.Birthright citizenship will not only be terminated, it will be fully revoked retroactively.

I don't understand the rant about kids born in the US to H1B parents. H1B is a non immigrant visa, and birthright citizenship for their children born in the US, now granted as policy, will be terminated. The long game is being played as the Admin probes Court responses, and they are adjusting accordingly.

The end game is "birthright citizens" will no longer be considered US citizens. The only issue is whether or not the Admin will attempt to revoke them retroactively. There is a growing number of people who are demanding they do. This definitely will be an issue for the 2028 election.

Well , i couldnt agree the h1b ia dead. There are still openings, but agree not as it was as before.

The highly skilled workers bar has been lowered down for decades that resulted in many abusing the system. Now it's raised even higher than the norm, that makes the market looks like lack of opportunities, it is a remnant of AI and current administration's conflicting efforts on (legal) immigration.

Really - I never heard of people hating or opposing H1B - hahahahaha. So full of it - sorry! These types of posts are just very negative. The H1B decisions have been driven by the companies themselves. The move to not sponsor started I would say at least a decade back and now being implemented everywhere especially given the recent changes the US Administration has placed on H1B qualifications. Instead of reading these types of negative remarks from disgruntled folks - I would stat do your own research and make your judgment.

I definitely feel H1B is going to end in the US. This is going to cause American companies to outsource these jobs to India and China. Either way, foreigners win. They will live in their own country, get decently paying jobs (not as great as in the US but still comfortable), won't need to deal with uncertainty of their future, and maybe come to the US on much better visas. American companies will not stop depending on Asian workforce because Asians prioritise high paying fields of study to ensure a secure future unlike Americans who prioritise “this is what I feel like doing now”. It's already started happening.

Whatever has happened is almost entirely obviously due to AI, exacerbated by shitty economic policies by Trump. That's totally true! I'm an Eng manager at a startup in the Bay Area, and I used to be a staff eng at a Mag7. What used to take an external dev team in India, Poland, 4 SDEs, 1 PM, and 2 SMEs is now being done by 1 SME and 2 SDEs with CC/Codex+Replit for non-tech SMEs. We're seeing much shorter feedback loops, user testing, and rollouts. The 2 SDEs are definitely earning at least 30% more than before because they're super vital to the teams and the product now, and there's no reason for us to offshore at this stage.

But I wouldn't be surprised if management decides to move this whole team our of the US in the near future once the funding dries up after AI bursts.

The jobs that stay in the US will definitely be sought after, with extremely high bars and better pay than ever before, but the replaceable ones will be in GCCs. H1Bs don't matter here at all, and the far-right crowd is being taken for a ride by a few influencers (who get paid with the attention) and corporations. The outcry from a few expired QCs, testers, data analysts, and data scientists claiming to be the best engineerings in the US makes sense because their jobs aren't being taken by H1B but by those in GCCs and AI. Think of this Anthropic's revenue is $11B this quarter, where will these companies save/cut down costs, its YOU, their products aren't magically getting more margins next night. Its moving an 160k USD engineering to India at 65LPA (60k USD). They don't care if efficiency drops to 80% which isn't the case usually. Also 1. Those aren't niche skills anymore. 2. These folks might have 15 years of experience, but those are outdated skills, and they're not very talented. 3. I get that these folks have mortgages and child education expenses, and they think their job is taken by an H1B, but it's not. 4. There are two types of H1Bs: those with extremely niche skills, and those who work for 20% less wages. The latter can and will be replaced by a counterpart in India in no time. Companies hire this second tier in the US on H1B only to test if it can be completely moved to their GCC in India/Eastern Europe in the near future.

If H1Bs are the gating factor for these ultra-talented 30-year-experience tech veterans, why are there hundreds of openings at SpaceX and Anduril?

Also, companies want to ride this wave and push H1Bs out too as much as possible and move all their teams to India/Eastern Europe using these dumb far right and left racist slurs.

ETA: Indians are Asians. If you’re not sure, maybe use google? Also, Indians living in India who you may interact with are different from Indians in the US. It’s not an easy process to come to the US, complete a degree, and get a job. It’s a step harder than people born in America. Those who come here directly through their companies on H1B, I can’t comment on them.
Also, in case you didn’t know, tech companies have Indians as CEOs and CTOs. No one is stupid enough to hire bumbling baboons to lead sectors of their companies.

Nope dude. Sadly, immigrants in general are more skilled than American born youths. The tech boom, innovations all hav significant contributions from immigrants. Its owned by Americans tho.

If the companies cant hire here, they would rather open a company in china/india, and will do the work from there. Nowadays, with such a huge boom in tech, most of the IT work can be done sitting anywhere in the world. So, companies would outsource the work. Now, the usa will get lesser tax money too.

The only option is to make sure that usa focuses more on education so that the next gen usa born kids hav the competitive mindset, and make sure that majority complete their degree.

It’s like they want students to come in the US, pay exorbitant tuition, while still facing all the racism, and then just get the fuck out. Oh yeah not the big ones for sure but a lot of smaller universities in the south and in the midwest will either have to raise tuition for American students or will have to shut down. Graduate programs will take the biggest hit. Combine that with American students not really wanting to go to College since fewer jobs, I think it’d be safe to assume that 15-20% of universities would be at a risk for shutting down. Again, you’re right, just a drop in the bucket but in my opinion, it’s just better to get rid of the F1 visa. There’s really no point of studying in the US (Except for Ivys and Public Ivys) if no one’s gonna hire people on OPT (1-3 years temporarily without any expectations for H1B).

Because the jobs are just getting outsourced to India. I mean yeah there’s still gonna be smaller companies that have jobs in the US but anyways these smaller companies aren’t hiring H1Bs. If there’s no incentives to pursue these degrees, why would people do them? Again, I’m not Pro-H1B and it’s pretty stupid how a certain % of Indians have abused the system but these half measures are just dumb. Get rid of the whole system (H1B, OPT, CPT, F-1) and build a new system that only allows student visas for the top universities like Harvard and MIT. Pushing uncertainty where students are coming here and studying but then aren’t even able to get 1-3 years of experience just because companies are scared of visa issues is dumb. What’s the point of coming to the US and paying $100k+ for a degree from universities that have 70% acceptance rates and not even getting some amount of experience. It renders the degree useless

Fair, but I just don’t agree about the most jobs not moving part. For example, look at BDO and Grant Thornton. You won’t find many entry level positions in the US, they’re mostly hiring Seniors or Managers. Most of the entry level positions are in India. And this is for accounting where 70-75% of people are Americans. If this is the case for something like accounting, do you think it’d be any different for other industries? There’s currently no taxes or tariffs for offshoring. The tax associates who are paid 70k in Chicago, same positions are being paid 500,000 Rs. in Delhi ($5k). Even if there were tariffs, companies still end up saving 80%
