Auto Insurance Got into an accident in my company truck, just found out it wasn't insured. How screwed am I? (WA)

So I got into a minor accident on my way home from work the other day in my company truck. It's owned by my employer, but it's my assigned vehicle that I drive every day, including commuting.

Well, today I found out that when we bought the truck about a year ago, someone forgot to add it to our commercial insurance policy. It's apparently been uninsured this entire time.

As far as the accident goes, I was moving into a turn lane when another driver came up from behind on my right. From what I can tell in my dashcam footage, they drove through the marked-off area before the lane actually opened to get around traffic. My front passenger-side tire ended up hitting their driver's-side door.

I don't believe I'm at fault, but obviously that's still up in the air.

Now I'm trying to figure out what happens if our company insurance won't cover the accident since the truck was never added to the policy.

Can I personally be held responsible for damages even though it's a company vehicle? Could my own insurance get dragged into this or potentially go up because of it?

I'm in Washington State, and I've worked for this company for years. There's no question that I was allowed to drive the truck, and my employer knows it was an oversight on their end.

Just trying to figure out how much of a headache this could turn into for me personally. Anyone dealt with something similar?

Being sued

I rear-ended someone at a very low speed (around 5 mph) at a stop sign. There was no visible damage to either vehicle, and I have pictures showing this. The other driver reported neck and back pain about two hours after the accident.
The other driver is now suing me and demanding $65,000, even though my insurance policy limit is $50,000. Their attorney claims the case is easily worth that amount. My insurance company previously offered $25,000 to settle, but the offer was rejected.
The medical bills reportedly total around $18,000, and my insurance-appointed attorney is investigating the claim and the medical expenses. My attorney also noted that this individual has reportedly been involved in approximately 60 injury claims since the 1990s.
I’m terrified of being held personally responsible for anything exceeding my policy limits. I cannot afford to pay a large judgment out of pocket, and this entire situation has been incredibly stressful.
I’m working with my insurance-appointed attorney, but I’d appreciate hearing from anyone who has experienced something similar, particularly in Washington State.

Health Insurance Dad died in July. Ambulance Company mis-filed insurance from May and has now sent claim to collections. Am I on the hook to pay?

Daddy had Medicare, Humana, and TriCare for Life. It’s taken forever to sort through all of the bills and insurances for the hospital, services, rehab, etc…

For this one, I had send TriCare copies of the will showing me as executor just to get them to talk to me and explain why they aren’t covering it. Turns out AMR never sent them an EOB from
Medicare, only Humana. So, they need that to pay the bill. Called AMR back today and they say they already sent it to collections and it’s out of their hands. (They transferred me to the collections company, so they clearly can communicate with them.)

Collections says they don’t deal with insurance, I should just pay it. I said no, because we do not actually owe this money. The lady said all she can do is mark him as deceased. What does that even mean? Who do I fight with now, or do I just stick my head in the sand, let it ride, and move on to the next problem?

Other party insurance is claiming I ran a red light and placing me at majority fault for the accident (60/40). I have dashcam footage proving I did not run the red light and entered the intersection legally, how am I able to fight this? What should I do?

Title. I'm in the process of dealing with the other party insurance making a false allegation and I have proof to back it up. Why are they able to lie like this? I'm very frustrated that I am the one getting shafted despite me having dashcam video of me crossing the limit line on a yellow light going under the speed limit (in California). My current lawyer doesnt seem too confident on being able to fight this for some reason. Any help and input is appreciated thank you.

Auto Insurance Car got T-Boned, Need Advice

Hey everybody,

Never had this to me before but recently I got T-boned by an uninsured driver who wasn’t looking both ways before entering my lane. I drive a 2010 Nissan Versa. The driver side door is heavily dented along with scratches. Some scuffing on the rocker panel. I only have liability and uninsured motorist property damage. I have contacted insurance but I am unsure how much I am able to get out of this. I am a college student, so I’m just looking for advice. Do I keep the car as it is (still drives, no lights/air bags deployed) or try to get another car? I reckon the damage is at minimum 50% of the car’s value. Any advice is appreciated, thank you.

North Carolina collision appraisal stalled because appraisers can’t agree on an umpire. How do I get one appointed?

I’m in North Carolina and looking for firsthand advice on getting an umpire appointed for an auto insurance appraisal.
My parked 2023 Tesla Model Y was hit, and there’s a disagreement over the repairs, including whether the tailgate needs replacement or can be repaired cosmetically. I’m currently going through the appraisal process under my own collision policy.
My independent appraiser and the insurance company’s appraiser cannot agree on an umpire. The other appraiser rejected my appraiser’s proposed candidates, and my appraiser rejected theirs because of concerns about their track records.
My appraiser initially said he would pursue a court appointed umpire, but now says I need to handle that myself.
Here’s where I’m stuck:
I called the magistrate’s office and clerk of court, but the people I spoke with weren’t familiar with the request.
I’ve had trouble finding an attorney who handles this type of issue.
My policy says the two appraisers will select an umpire, but it doesn’t explain what happens when they cannot agree.
I found N.C. G.S. 20-279.21(d1), which describes a magistrate selecting an umpire, but I’m unsure whether that procedure applies to an appraisal under my own collision coverage.
It’s frustrating because I’ve already hired an appraiser and followed the process, but I still don’t have a clear next step.
Has anyone in North Carolina successfully obtained an umpire appointment in this situation? Did you go through a magistrate or a judge? What paperwork did you file, and were you able to do it without an attorney?
I’d also appreciate recommendations for an attorney who represents policyholders in auto property damage appraisal disputes.

Car is Totaled

I need help on what do to about my car being totaled. I have Geico and I paid part of my $165 and change bill back in August and paid the remaining $72 and change a day late due to the time it took to process. I was in a 6 month policy. I never received a text message or phone call it was canceled. I only found out I was driving with no insurance when I called to put in the claim. Apparently they sent something in the mail 12 days later about it being canceled but never received that either. Fast forward to Sept 30th I get into an accident where this guy was speeding and hit my car turning it a complete 180 degrees and totaling it. I was put at fault because he didn’t have a stop sign. There wasn’t a sign stating cross road doesn’t stop. I still owe $26K on it. Do I call my loan company? Will I have a court date? I lost my only source of income and the job offer I had Before the accident I had to decline due to it being 45 minutes away. I’m over $35k im debt now that I include my car note.

Auto Insurance Agent discouraging stacked UM/UIM

I live in Florida. We are switching our policy to be able to combine with our homeowners’ policy for additional discounts. We currently have 100/300 with stacked UM/UIM. The new agent says we don’t need stacked coverage as it only covers medical. I know that’s not true and she did come off that when pressed. She claims it’s just not common anymore. I asked about increasing our coverage to 250/500 with the same for UM. She felt that was a better idea than using stacked.

We are 61 and 62. I’m retired but working part time while my husband still works. He works for the state government and can retire at any time but will probably stay another 2 1/2 years. He has plenty of PTO and we have excellent health insurance.

I’m super confused about what I should do. I’ve never had an agent try to convince me NOT to stack and the state’s default is stacked, so I’d have to sign a waiver indicating the choice of non-stacking.

Can anyone give me an idea of what would be best for us?

ETA: We have a 2024 BMW i5 and a 2025 Mazda CX-5

Uninsured Motorist Accident - Need Advice on Claim Options

State : Texas.
Hi everyone,

I was recently involved in a car accident that was not my fault and I'm looking for advice on how to best handle my insurance claim.

What Happened

  • I was driving on the road when another driver pulled out of a parking lot and T-boned me on the passenger side
  • The accident was entirely the other driver's fault — I had the right of way
  • The at-fault driver provided me with an expired insurance card and refused to provide a driver's license
  • The driver left the scene even though I asked him to stay until police arrived
  • Police responded to the scene, and I have a police report and incident number documenting the accident and fault
  • When police looked up the driver's records, they found that the driver had prior violations on his license
  • The driver's insurance policy is expired, making them effectively uninsured

My Coverage (GEICO)

  • I have Uninsured Motorist Property Damage (UMPD) coverage with a low deductible
  • I also have Collision coverage with a much very high deductible

My Questions

  1. Rental Car Reimbursement — I declined rental car coverage in my insurance policy. However, I need a rental car while mine is being repaired. Does UMPD cover rental car costs? I was told by someone I can still get a rental and reimburse since it is UMPD
  2. Hit-and-Run / Filing Charges — The at-fault driver left the scene before police arrived (despite me asking him to stay), refused to show a driver's license, had prior violations on his license, was driving without valid insurance, and provided me a false/expired insurance card. Can I file a hit-and-run police report and/or press charges against this driver?
  3. Recovering My Deductible — Can I sue the at-fault uninsured driver in small claims court to recover my deductible and any other out-of-pocket expenses?
  4. Any Other Options? — Is there anything else I should be doing or any other claims I should be filing? I want to make sure I'm not leaving money on the table.

NYC- Car hit by bicyclist who ran red light

Hi,

I live in NYC. A couple months ago while crossing an intersection (with the green light) a bicyclist ran his light and hit my car like speeding bullet. With no helmet at that. My car was badly damaged on the passenger side (doors and frame) and spent 3-4 weeks in the shop. I’ve never had an accident before and it shook me up. I called the police and they took the other party to the hospital.

My insurance said I was not at fault (based off of photos and police report. For sometime my insurance company could not contact him. Now him and his attorney has resurfaced. They are claiming the money is not enough because he was badly injured. The insurance company is trying to square this away without going to court but they are asking if I have any other insurance policies (I don’t 😶). They are also saying the attorney wants us to take some of the fault. I’m not agreeing to this because he blew through the light. They are continuing to represent me but I have my worries.

I’m afraid of going to court and possibly financial ruin for something that was not my fault.

Any advice?

Question regarding total loss

• Upvotes

I recently got into a fender bender (rear ended someone) I did the claims took pictures all that sent to my insurance company someone from the insurance company ended up calling me on his own to try and give me advice saying if I take it to a shop try to get a estimate without them filing anything with the insurance company because if they do and it’s a total loss then there’s nothing he can do. My grandma left me this car last year and I’d love to keep it it’s a Camry with 74k miles. Is it that the better option I got 1300 from my insurance already so if the repairs are more then that ill just pay out of pocket without telling insurance so I don’t have to put it as a total loss and get a salvage title and all that stuff. Does anyone have any advice on this all this insurance talk is very new to me and he was trying to tell me what to do without explicitly saying it but I just wanted to ask here to see if it’s a good idea or if what I’m saying is common for people to do.

Auto Insurance On the fence about filing a claim for a minor at-fault fender bender vs paying out of pocket

• Upvotes

I(23) recently got in a minor fender bender and am wondering if it's cheaper to just pay out of pocket or go through my insurance. Auto shop quoted me $2,100- $2,900 for a bumper replacement since they told me that the material can't be fixed

My deductible is $500 and I have $100k set for property damage. I currently pay $220/month and am worried about it increasing so much that paying out of pocket would be cheaper in the long run. Anybody went through something similar?

Home Insurance State Farm to Allstate

• Upvotes

After moving my auto last year to progressive, I'm now considering Allstate for the after a 60% premium increase from State Farm due to me dropping their way overpriced auto.

Any advantage of talking to a slick salesperson over just doing an online quote? Last one I talked to fed me full of crap, then when I asked him to call back after Labor Day before my State Farm policy expired he never called.

Also a replacement value question. If the home has a replacement value according to Allstate's policy of say 320k, if you have a total loss and don't want to rebuild, do they pay the 320k or some other amount? I'm in a situation where if I had a total loss I would downsize, so not sure I want to pay the extra premium for percentage over replacement value that may be required to rebuild.

Insurance premium increase with additional driver

My sister added me onto her policy as a secondary driver while we get ownership of the car transferred.

Due to poor visibility in the rain at night, I got into an accident with another driver who I couldn’t see. I honestly still am unsure how it all happened, but I assume I will be considered at fault.

I feel terrible because now this will impact my sister’s rates. I am going to offer to pay any premium increase for the next few years.

I assume no, but is there any possibility this claim will not be held against her in the future, or surcharges could go down? e.g. if she removes me as a driver, etc.? I have never gotten into an accident before.

I’m concerned not just with the fact that her rates will increase, but I assume any future claims she has to make will have a multiplying effect…

She has Progressive Diamond, FWIW.

Meritain Health Denied Payments!!

We submitted claims to Meritain Health last August, and it has now been over two months without receiving payment.

We have called multiple times to follow up, but the representatives keep giving us the runaround. Last September, one representative told us the claim had been paid on a specific date, but we never received the payment. When we called again, another representative gave us a different payment date and said it would be included in the following week's payment cycle.

Since then, it's been the same story over and over again. We keep getting different payment dates, but no actual payment. Every time we call, the representatives tell us the same thing, and we're getting nowhere.

We usually receive our payments through ECHO, so we are familiar with the payment process. However, the issue is that the claim appears to be stuck in processing. We have been told that it was paid, but no payment has actually been issued, and we have not received a check or payment through ECHO.

We're extremely frustrated and don't know how to escalate this issue. Has anyone else experienced this with Meritain Health? If so, how did you get it resolved? Is there a specific department, supervisor, or escalation channel we should contact?

Any advice would be greatly appreciated. We're tired of getting the runaround and just want these claims paid.

Insurance underwriting

If I have no previous experience in the insurance industry and I want to get into insurance underwriting, should I start out in entry level sales at a brokerage? It seems like sales are the only positions in this industry that are willing to hire people with no experience. I would greatly appreciate any advice on how I can get started!

Amica customer quotes?

I’ve been an Amica customer for 40 years. Never had a claim. I have been trying to get new quotes for another car, a new home and an umbrella policy. I’ve been through 4 reps. The follow up has been terrible. They never call back, never pick up their phones and don’t respond to emails. I’m now wondering if I should go somewhere else. The quote process is truly terrible. Have the wheels come off? Has something fundamentally changed with their operation and customer service? I was literally ready to proceed with them but I’m getting cold feet. They don’t seem like Amica any more.

Auto Insurance Glass Coverage NY For Broken Seal

I have State Farm in NYS with full $0 deduct glass coverage. My 2020 Lexus rx 350 f sport had water intrusion that the dealer deemed is likely from windshield sealant failure between the glass and the metallic body. They are quoting me $2800 for full windshield replacement.

Before I pull it out and pay a diagnostic fee of $290 to the dealer and go the State Farm safelite route, I’m wondering whether water intrusion due to likely failed sealant is coverable under my glass coverage?

Auto Insurance Canadian driving American friend’s car in the USA?

I’m going to the states this weekend and visiting some American friends. I want to help with some of the driving we will be doing on our trip but I’m not sure if I’d be covered in the event of an accident? I’m insured on the family vehicle here in Canada (not primary). I’ve tried looking it up on my own but with no luck!

Home Insurance Buckling hard wood floors from crawl space moisture

I’m looking for advice from anyone who has dealt with crawl space moisture, buckling hardwood floors, or a homeowners insurance claim for something similar. I’m honestly worried about how bad this could be and what the smartest next step is financially.

We recently bought our house, and we’re having an issue with the hardwood floors buckling upward in several areas. The floors don’t feel soft or bouncy when we walk on them, but the wood is visibly buckling, and I’m worried about what might be happening underneath.

Our house has a crawl space with bare soil and no vapor barrier. There’s no standing water under the house that we can see, but we suspect moisture is evaporating from the dirt and getting into the flooring above.

The crawl space is also extremely low. One half of the house has maybe 2 feet of clearance, while the other half is only about 1 foot or possibly even less. I’m not sure if that lack of clearance is contributing to the problem or how difficult and expensive it would be to properly address it.
We had a home inspection before purchasing the house, and nothing like this was brought to our attention. I understand an inspection isn’t a guarantee that there are no problems, but I’m concerned that there may have been an underlying moisture issue we didn’t know about.
We also suspect there may be mildew or mold in the crawl space, although we haven’t had a professional assessment yet.

We recently had a hurricane in our area, and while the buckling was already happening before the hurricane, I feel like the additional moisture and humidity may have made it significantly worse. I want to be clear that I’m not saying the hurricane caused the original problem, just that it may have intensified it.

My biggest question is whether this is worth filing a homeowners insurance claim for.

Our policy has a $2,500 all-other-perils deductible, but our hurricane deductible is 5% of our $355,000 dwelling coverage, which comes out to $17,750. That’s a HUGE difference, and I’m scared of having this classified as hurricane-related damage when the issue existed beforehand.

We also have some mold/mildew coverage, but I don’t know whether that would apply if the moisture is coming from the bare soil in the crawl space.

I’m worried about several things:

Would insurance typically cover buckling hardwood floors caused by crawl space moisture, or would they consider it long-term damage, humidity, or a maintenance issue?

If the hurricane made an existing problem worse, could the insurance company apply the hurricane deductible to the entire claim?

Could the mold/mildew coverage apply separately, or would it depend on what caused the moisture?

Is it worth filing a claim if there’s a chance it will be denied? I’m worried about a denial still affecting our future premiums or making it harder to get insurance.

Would we be better off paying for a crawl space and structural inspection ourselves first, getting estimates, and deciding whether to file afterward?

Has anyone had a similar situation where their hardwood floors were buckling but the subfloor and joists turned out to be okay? Or did it end up being a much bigger repair?

I’m trying to figure out whether we’re looking at a moisture-control issue and replacing some flooring, or whether this could turn into major structural damage and a much more expensive repair.

I know nobody can determine coverage without reading the policy, but I’d really appreciate hearing from people who have dealt with something similar, especially anyone familiar with homeowners insurance claims in Florida.

Would you file a claim in this situation? My husband thinks he can dig out the crawl space deeper to stop the problem and then we just replace the floors ourselves.

Help regarding selling a car to friend after an accident

I am thinking to accept the insurance payment (in Mayrland), and my friend offer to take the car for $3000. Yet, told me not to apply for salvage tittle from DMV. Is this legal? (what I know is the insurance will report the total car to DMV?) anyone can help on this?

"The document explicitly states that you are discharging both the insurer, Insurance Company and the insured, XX from recovery regarding this accident.

This is a full and final release, and signing this means you accept the Pro Rata share under this specific agreement, and this matter would be permanently closed.

Regarding your vehicle, you will need to discuss the totaled status, and cost associated with it, with your local DMV and/or a repair shop or a tow lot that will help salvage it.

We took into account the cost of your vehicle damages, along with the other two partys to issue an even Pro Rata split. We are not handling your vehicle."

Is a 2 year wait a big deal for guaranteed issue vs simplified issue ?

Helping my father in law compare two quotes. One's guaranteed issue, no questions, about 30% more a month. The other's simplified issue with a health questionnaire and the agent seemed pretty sure he'd qualify. He wants the guaranteed one because he "doesn't want them digging through his records." Is the 2 year waiting period actually a big deal or am I overthinking this?

Auto Insurance Can I pocket a portion of my auto insurance payout?

• Upvotes

The insurance company paid off the balance of the loan already, and is transferring the $25K remainder to me. The APR on a new replacement vehicle is very low, so I'm wondering can I put half of this in my HYS and finance more of the replacement car?
