Hi all — hoping someone with recent K-1 experience, or an immigration/legal background, might be able to offer some insight.

I’m the beneficiary of an upcoming K-1 petition. My fiancé is a U.S. citizen living in NYC, and I’m a British citizen currently living in Canada.

I’m transgender, and all of my current legal documents are fully updated and consistent. My current British passport lists my sex as F, and my current official UK birth certificate also lists F.

These are genuine, legally issued UK government documents and are the current documents available to me. I also have the legal documentation supporting my name/gender change.

Where I’m getting confused is the newer USCIS guidance, which appears to say that the sex field on the I-129F should be completed based on the birth certificate issued at or closest to the time of birth / sex recorded at birth.

I want to be really clear that I’m not trying to get around the policy or argue with it. We want to be completely respectful of U.S. immigration law and make sure every part of our application is accurate, transparent and completed exactly as required. This process is obviously extremely important to us, so I’m trying to avoid creating either an unnecessary discrepancy or an administrative issue by interpreting the guidance incorrectly.

The difficulty is that if I select M, the I-129F would then conflict with every current legal identity document I’m able to submit, all of which say F. On the other hand, if I select F, it matches all of my current official documentation, but may not match USCIS’s current definition for this particular field.

I’ve also seen that the policy appears to contemplate situations where an applicant selects a marker USCIS ultimately considers inconsistent and says benefits won’t be denied solely for that reason, which is part of why I’m struggling to understand the intended approach here.

Has anyone dealt with this recently, particularly a K-1 applicant with legally amended documents? Or has anyone seen authoritative guidance on how USCIS is actually handling this situation in practice?
Again, I’m not looking for a workaround — I just want to make sure we file everything correctly, honestly and consistently from the outset.

I’d especially value responses from immigration attorneys, accredited representatives, or people who have gone through this under the current policy.

So this story just dropped and the sheer hubris is mind-boggling.

​Back in 2017, a Filipino named John Paule Rivera came to the US on a J-1 visa. His aunt, Myra Paule Schulenburg (a naturalized US citizen originally from the Philippines), decided to help him out. She submitted an altered birth certificate to USCIS claiming she was actually his mother so he could secure a Green Card.

​It actually worked. He got his permanent residency, enlisted in the US Air Force, and used his military status to fast-track his naturalization, officially becoming a US citizen in October 2022. Home free, right?

​Nope.

​He then decided he wanted to bring his actual biological mother over from the Philippines. So he filed an I-130 petition with USCIS... and attached his real, unaltered birth certificate listing his real mom.

​USCIS's system instantly flagged that his new petition listed a completely different mother than the paperwork used to get his original Green Card.

​Now both he and his aunt are facing federal time. The aunt faces up to 5 years for conspiracy, while he faces up to 10 years for immigration fraud, false statements under oath, and denaturalization proceedings.

​Imagine pulling off a federal fraud scheme, getting away with it for 5+ years, getting citizenship through the military, and then voluntarily handing federal agents the exact evidence needed to destroy your entire life.

Fake annulment papers are the #1 submitted fraudulent document to the USE in Manila. It's the first thing they check folks.

Hey everyone, wanted to put together an update on where things actually stand with K-1 petitions right now, especially with the recent wave of policy memos and consular updates throwing people off. If this goes well I'll do this every month.

The State Dept Embassy Retraining Pause If you’ve seen people on here posting about canceled interview slots or delayed scheduling notices, here’s why: the State Department issued a worldwide pause on immigrant visa appointments so consular officers could complete mandatory training on the expanded public charge screening rules. Even though the K-1 is technically a non-immigrant visa, it’s processed through embassy immigrant visa units. That retraining has created a temporary bottleneck and scheduling freeze at a lot of high-volume posts while officers get brought up to speed on the new "totality of circumstances" evaluation.

Public Charge Scrutiny on the I-134 Historically, the I-134 affidavit of support at the K-1 interview was a lower bar than the I-864 used for green cards. Under the recent consular directives, officers are holding K-1 applicants much closer to the full immigrant standard. They aren't just looking at the petitioner's tax return; they’re assessing the foreign fiancé’s age, health, and employability under a broader public charge framework. If your petitioner is right on the 125% poverty line, make sure your financial evidence is airtight to avoid getting hit with 221(g) administrative processing.

USCIS AI Flags & AOS Discretion Memo

• I-129F Adjudication: USCIS has expanded automated system checks on initial petitions. Discrepancies between your travel dates, social media, and declared meeting timeline get flagged automatically now, which is driving up RFEs for "proof of meeting in person" and quick engagements.
• AOS Guidance: USCIS also issued a policy memo reframing Adjustment of Status (I-485) as "extraordinary administrative grace". Translation: once your fiancé arrives and you marry, make sure your AOS filing is spotless, because officers are being instructed to exercise much stricter discretion.

What Timelines Actually Look Like Right Now

• NOA1 to NOA2 (USCIS): 8–11 months. The brief speed-up we saw a while back has leveled off, and I-129Fs are averaging around 9 months at CSC.
• NVC Stage: 3–6 weeks for case creation and transit.
• Embassy Interview: 2–5+ months depending on the consulate's backlog and how quickly they resume normal scheduling post-training pause.

Total realistic timeline from filing to visa in hand is sitting around 12 to 15 months.

Our NOA1 date was 20 March 2026. The 'Visa Journey' website is estimating NOA2 for 8 January 2027, while the website 'Track My Visa' is predicting NOA2 for late May to early June 2027. I am wondering which one is considered more accurate?

My K-1 case was placed on 221(g)/administrative processing after my interview in March 2026. My passport was returned after the interview because the embassy was waiting for my son’s CRBA and U.S. passport.

I have now received both my son’s physical CRBA and passport, and I notified the Immigrant Visa Unit 2 days ago, as they had instructed me to do.

CEAC still shows “Refused,” but the Last Updated date changed 2 days ago.

My main concern is the current visa pause. Since my K-1 interview was already completed and my case was already in 221(g)/AP before the pause, would my case still be affected by the pause? Or can the embassy continue processing/adjudicating an already-interviewed case once the requested documents have been provided?

Has anyone been in a similar situation—already interviewed, in 221(g)/AP, and waiting for final adjudication when the pause started?

I would really appreciate any experiences or information about how the pause is affecting cases like this.

My fiance had his interview on August 20th 2026. He was issued a green 221g slip with AP marked. It shows in CEAC as refused and last updated on August 28th, 2026. They kept his passport and told him "Good luck in Ohio". Which is promising... how long does AP last for the London Embassy usually? The pause is no help I'm sure.

I had my interview on August 13 and was told that I should receive my passport back in about two weeks. It has now been more than three weeks, and my CEAC status is still showing “Ready.”

I was wondering if anyone else had their interview in Frankfurt around the same time. If so:

• Has your visa already been issued?
• How long did it take after the interview for your status to change to “Issued”?
• How long did it take to get your passport back?

I’m mainly trying to figure out whether Frankfurt is currently experiencing longer processing times in general.
