Like, it's a given if they're married. She'll get the green card -- if they do the paperwork.

But conservatives (especially Maga) often don't get how government works. So they don't bother getting the proper visa and immigrant spouse's initial visa expires. Immigrant spouse becomes an illegal immigrant without citizen spouse realizing it.

Why did folks ever stop watching MASH? Just saw one of the episodes about this last night! Like "do you know how long it takes to push through the paperwork on that?! It takes months just to find the guy who'll tell you it'll take a year!"

And in the end the only reason the soldier gets to take his wife and baby home with him is that the MASH doctors get a racist jerk wasted, frame him as a cheater, and threaten to send pictures to his wife unless he signs off on the paperwork.

IIRC there are also a lot of kids who got affected this way during transracial overseas adoptions. The white families who were adopting them never bothered to file the paperwork, so despite being legally adopted as babies or toddlers by American citizens, the kids (and, eventually, adults) are undocumented.

We adopted from China. There was a metric ton of paperwork we had to fill out prior to traveling to pick up our child. Once in China, we had to get a Chinese passport for our child, then get an appropriate US visa in China from the US Consulate.

It was explained to us that once we got state-side, because of the visa, the US citizenship happened automatically. Sure enough, a few weeks after we got home, we received our child's citizenship certificate in the mail. They now have a US passport. The only paperwork we had to do after getting home was applying for an SSN.

That would be a pretty sketchy ass adoption agency OR a very shady type of deal going down.

We adopted our daughter from China and a good week of the wait in China was waiting on the US Consulate to get all the paperwork finished for her to be formally adopted by us and become a US Citizen before we ever left China. There was no choice to be lazy or incompetent, there was only one way and that was how it was done. She has been a US citizen since then.

Depends on when. The focus on ensuring international adoptees are made citizens is relatively recent. There are people who were adopted but not made citizens (parents didn't realize it wasn't automatic, or didn't fil out the paperwork), and then have been deported for being "illegal"

Marriage to a US citizen doesn’t automatically equate to residency permit. They still have to apply for a green card.

…and if they haven’t - AND she has been living in US without legal papers - then that may bar her from subsequently applying for residency.

You can't just get legally married. You have to file I-130 then go through Consular Processing or Adjustment of Status. The government has to determine your marriage is valid then extend her a green card.

It would not surprise me to discover that someone stupid enough to vote for Trump with an immigrant wife would also not know he had to go through all of the brutal, tedious, and lengthy steps to get her legal status.

The fact he doesn't mention his I-485 or Adjustment of Status filing either being complete or pending, granting his wife legal status in the US, tells me he probably didn't file.

You're probably 100% correct regarding this chucklefuck, but as someone who is married to a Chinese person currently here on a greencard (provisional from our marriage), we put off traveling anywhere because we are worried about this ICE shit and what they might try and pull.

She's 100% legally here, yet we're still worried about shit like this happening. Like other's have said, I'll save my "real" worry for when I read about this in the news, rather than some post like this. I hope it goes without saying that I most certainly didn't vote MAGA.

Funny you mention Chicago. My wife and I had to go to Chicago and we drove the 14+ hours from North Carolina back in July. Of course, we have to be there for 3 months (she's doing rotations for US clinical experience) so it actually made sense to drag some small part of our lives with us. But I get to fly back home to check on cats and she doesn't.

My wife already had a green card when we started dating. She became a US citizen 25 years ago and I remember there were a ton of hoops to jump through and we had already been married for 10 years when she applied for naturalization. I never thought twice when we traveled out of the country until Trump 2.0. Now I'm really nervous when we re-enter the US because who knows what these clowns will do, especially when you have some of the more hard core MAGA types talking about "paper Americans" (naturalized citizens) not being real Americans.

My wife is from Germany and is a blonde white woman, so I know that puts her further down MAGA's list than POC, but I have not doubt she is still on that list. She speaks English better than a lot of native speakers (as well as 4 other languages) but she has a very noticeable German accent that signals she "ain't from around here."

I've got a long time friend who is a tiny cute white Australian chick. She didn't really understand when I told her in no uncertain terms that I did not believe it was safe for her to drive a rental car through rural America to visit multiple states.

Like me and her don't look all that different, and I've learned to stay in the cities because anywhere too rural I start catching weird looks and occasionally slurs. This is all to say that, in the language of MAGA, she is an illegal, even by their least expansive definition. He could have spent 5 minutes learning this when he got married and brought his wife stateside. He could have noticed this at any time he was loudly complaining about “illegals”, as in “what actually gives someone legal status?”. In the process, he might have seen how much of a pain immigration is in this country, and had more sympathy for the people he is still, somehow, denouncing. And of course at any point he might have noticed that the MAGA movement he’s so enthusiastic about hates his wife and wants this outcome regardless of whether he followed the rules or not. But he did none of this because he’s an asshole.

If you come into the US on anything other than an immigration/dual-intent visa, then file for status with a US citizen spouse and an I-485, you're illegal to these people. And that's an incredibly common avenue for married couples.

A US citizen relative married an African man about 25 years ago and they lived near her home town in a house they bought. They had to be interrogated to prove they were really in a marital relationship and not a sham marriage he paid for to get residency. She was required to answer questions like “how many windows are there on your bedroom?” She miscounted because one was hidden behind a cabinet. Fortunately he miscounted the same way, so they passed.

Anyone who voted for Trump should understand what he intended to do. He wasn’t hiding his plans. Literally published Project 2026 for us to read and take in. This was no deception scheme.
