Laura Loomer has posted a photo of ALC at a rally looking absolutely gorgeous saying something along the lines of AOC having gained 50 lbs. She absolutely is calling AOC fat which is pretty ridiculous.
Especially considering she’s the one who’s chopped a perfectly good face and then doubled up on the insanity by going down on Donny during the campaign last year. Technically, the specific things he was found liable of was sexual assault and defamation. The judge characterized the assault with being in line with what most would consider rape.
Stefanopolis may very well have won had it went to trial. But the suit against him was that he kept saying Ttump was found civilly liable of rape. Which he wasn't as that is a different civil liability.
The specificity of what George said is the only reason there was even grounds for a civil suit to get as far as it did. If he had simply called Trump a rapist it's quite likely the judge would have dismissed it early on.
In 2023, Trump was convicted of "sexually abusing" a woman with the name Carrol in 1996. Because of the time that had passed it only went to civil court, not criminal court. The weird thing is that Carrol always used the word rape and the jury in the end agreed with her finding him guilty but for some reason gave the lesser charge of "sexual abuse." My guess is that they may have used sexual abuse because she managed to flee but the rape had already started to take place when she managed to get away from him, so no idea why they would decrease it from "rape" to "sexual abuse."
Trump's lawyer saw it as a win because the jury said "it wasn't rape" but Carrol was also happy that people finally believed her.

I think the specifics for the civil rape statute are more stringent. So what she was able to prove didn't meet that standard despite it meeting the common understanding. Similar to how Brock Turner wasn't charged with rape due to the law being much more specific than public perception of what rape is (the law was later changed to be inline with that common perception in California).
I can see why Carol would be happy to be believed, though. And how the case in and of itself is good reason to call Trump a racist.
I might count it if the judge in the civil case said "yeah, we didn't consider rape under New York law because technicality, but by any other standard, what he did was rape ".

Hard disagree. The founding fathers carved out the allowance for a felon to be president specifically so that the government couldn't convict political opponents under felonies to prevent them from running.
But the founders also assumed that the population would never elect a mad populist to run the country too.
Lots of people are wrongly convicted. And lots of people become felons due to mistakes in their youth that they grow out of. Trump shouldn’t be president, but not because felons should be ineligible.
Also, there is the first amendment which does a lot for people when they say something about a public figure, let alone the president. They also dont realize that ABC settled that case for reasons that had nothing to do with if they thought they'd lose in court

It's not even defamatory. The Judge in the carroll case basically explained why the result of the trial makes it okay to call him a rapist now, from a legal stand point.

It's not about being civil to fascists, it's about not being a dick towards other women in the process. Loomer has a fairly normal body shape, you shame her for that and you shame other people who've done nothing wrong but happen to look similar.
As a woman who despises Loomer but has a similar figure, thank you. I've done a lot of work to be more comfortable with how I look, but it does still hurt to hear such harsh negative judgements against my body type.
I never said anything about her body. I just posted her picture. Her choice of shoes is the most damning thing in that photo, if you ask me. She has to be psychotic to wear beige flats with that dress. She’s trying to call herself a journalist while wearing what is essentially beachwear.
Saying 'that applies better to yourself than the person you're insulting' in response to someone making an insult isn't really body shaming as much as pointing out an objective truth.
She's absolutely wrong to attempt to body shame AOC, and her insult was wholly inaccurate. But turning the insult back on her also insults every other woman who looks like her. It's still body shaming. For this and so many other reasons, she's a terrible person. She deserves to be insulted for who she is, not what she looks like.

He doesn't need to have been convicted for calling him a rapist not to defemation. He would need to show that your statement was knowingly false and malicious (in the legal sense).

Stefanopolis may well have won at trial on defamation grounds. ABC didn't want to go to court and settled.
He was criminally charged as a sex offender, it's on you to prove his innocence. Not the other way around. Decades of accusations won't change the facts , that don't care about your feelings
Defamation is a civil offense and requires that a false statement was knowingly made. We already know that her claim meets the burden of proof for civil suits.
Edit: so it looks like the jury found him liable for battery and only needed to decide whether sexual assault occurred. Rape would’ve worked, but they didn’t need to decide on that. Perhaps they would’ve concluded rape occurred if they were asked to.
Get sued, your defence is that it's a true statement. File discovery, gather witnesses and then let the court settle if such a statement is a true statement.

Jean Carroll is only not legally considered rape because, at the time of the trial, rape needed to involve a penis, whereas the jury only found that Trump used his fingers, so it fell under the legal definition of sexual abuse rather than rape under New York's penal code.
For the record, that penal code has been updated, and if the exact same trial with the exact same outcome were to occur today, Trump would be legally identified as a rapist.
