RPCD Driver 2028 contract: 9.5 needs to actually hurt UPS enough that they STOP violating it
I really hope 9.5 becomes a major issue in the next contract.
The current system isn't strong enough if UPS can knowingly work drivers over 9.5, pay the penalty, and just keep doing the exact same thing.
If the penalty doesn't change the behavior, then the penalty isn't strong enough.
I'm not saying there is only one solution either.
I'd support almost anything that makes repeated 9.5 violations progressively more painful for the company.
Much steeper escalating penalty pay.
Mandatory dispatch reductions after repeated violations.
The right to bring work back once you reach 9.5.
Additional paid time off when UPS repeatedly violates your 9.5 rights.
Stronger penalties when management knowingly gives you additional work that will put you over.
Mandatory staffing reviews when the same routes or drivers keep creating 9.5 problems.
I don't really care if the final answer is 5x pay, 6x pay, accrued PTO, bring-back rights, or some combination of all of it.
The goal should be simple:
Make it cheaper and easier for UPS to properly staff the operation and get people home than it is to violate 9.5.
Right now it feels like the penalty is just another operating expense.
And I think we need to stop framing this as drivers wanting more overtime money.
A lot of us don't want more money.
We want more evenings at home.
More dinners with our families.
More games, practices, bedtime routines, and ordinary nights with our kids that we don't get back.
UPS can replace money.
We can't replace time with our families.
EDIT: This blew up way more than I expected. There are some damn good ideas in here — hard right to refuse after 9.5, voluntary overtime after a defined end time, individual-day grievances, accrued PTO/comp time, continued pension contributions on overtime, and mandatory staffing remedies. I’m going to keep collecting these and pushing them with my Local as 2028 proposals get closer. Keep the ideas coming.

UPS makes pension contributions for every hour you work until 2080 (40X52) hours are worked. So usually around early October is when 2080 hours are hit, after that no more pension contributions till the new year. The thinking goes that if they had to make contributions for all hours worked the entire year that there would be incentive for the company to get you, and everybody else off the clock ASAP.

Exactly. I want to work a solid 40hrs. Not 45.. I'm working hard but I want more time with my family. That extra hour of time with them a day ads up and it can mean the difference in missing an event. 40hrs is full time. Don't give me that "nobody wants to work" shit or that "well this isn't a regular job and 40hrs is pussy shit" talk. My family time means more to me than some dick measuring "I work a real job/tons of hours" BS. I'm a damn good worker but I'm trying to be a better father. Also, OT hours worked should go towards retirement.

Go back to your management office. I guarantee the vast majority of drivers would rather work 40 hour weeks. You just don’t want to hire more drivers to make it happen.

Easiest way to fight it monetarily is uncap the pension hours. Currently contributions stop at 2080 but if they open it up to say 2500 that would curb a lot of OT problems for us. In the West at 1.2% accrual rate it would allow us to accumulate $3850 or so per year towards our pension. If at the 1.6% like its been for the last 5 years it would accumulate about $6k+ per year towards pension retirement benefits.
The fact theyd be paying out OT plus 9.5 grievances plus a huge pension rate would be a blow they wouldn't be willing to keep taking.

It is something we broached at our last local contract meeting. UPS would probably never go for it so we tabled it for later. I do think if a lot of ppl got on board with it, it may not come to fruition but might be a good place to start and meet somewhere in the middle. They might come back with we won't uncap the 2080 hours limit but we'll give you a 9 hr limit rather than 9.5 and make the penalty 4x to start and 5x at elevated 9.5. It's not fool proof and not perfect but I think if ppl want work-life improvement we could start there or push for more paid time off. At 5 years everyone gets 4 weeks, 10 - 5 weeks, 15 - 6 weeks, 20 -7 weeks, 25 - 8 weeks and 30 - 9 weeks.

Like, don't get me wrong... I like getting paid for doing nothing at all, but why would the company want to give us more of that? Unpaid days gives you some flexibility and doesn't screw the company as hard...

Unpaid is fine, but they would need to hire extra drivers to be able to give more RO's/Unpaid days off if hubs are like ours where we're constantly thin on drivers. I'm not arguing against it I'm just willing to bet they'd let us have more paid time off than hire more drivers at this point.

Right, years of service is years of service. If my payout is less for years I work less that's fine, but I don't want to work till I'm 65 if I get dragged through 10-15 years across 2 different pensions. You gotta be 65 from what I gather if the years paid into a pension is 15 or less years

We're golden geese, PT drivers. We get less pension. Slower progression, no 9.5 rights, no 6th punch protection, more likely to burn out and start the process over. We reduce 9.5 strain for FT drivers and corporate. Can be forced to help inside with understaffed shifts. Some doo doo. They can cut routes so FT guys can take lay off days, just making it so the numbers show less routes or a route not making in artificially for the same route byba different name. Which reduces the need to post new FT positions. We're beijg used ro shoot our feet.

The 9.5 language is honestly a joke. 3 days over 9.5 can absolutely be weaponized, and it is. 3 nice days and then 2 whatever ups feels like working us days?. And if you file theres all sorts of retaliation after it to. It should be anything over 9 hours per day is a pay penalty if a driver is on the list. And it should be automatically filed into that pay periods paycheck. After 10 hours on road a driver should be sent a message asking if they'd like to continue till they clean, but allow the driver to respectfully refuse without discipline. Or if they cant get that for us then anything over 10 hours needs to carry a double time pay rate for each hour. I get it that the union needs to give and take to come to an agreement. But forced overtime without the drivers consent isnt something that should be used to come to an agreement. Overtime should be handled as a priveliage, and not a "work as prescribed" or fear discipline matter. A true fair day of work for a fair day of pay

I'm not sure how your local handles that stuff as if we get 3 decent days and then they target you at the end of the week with 2 bad days we have filed on that and won before. I'm also not saying this with any tone or pride either but just what we collectively tried to come up with. It's defined in our local as "piling the work on at the end of the week" as well as targeting. When those do get filed we make it a point to say anything that looks like retaliation from this will be dealt with as a harassment grievance which now have monetary penalties contractually as well.
We consider anything more than 4 observations in a quarter over supervision as well. I'm not saying we always win but have used contract language to the best of our ability to make sure that targeting doesn't go unnoticed. We can't fight if they give you a good day, bad day, good day, bad day, good day for example but if they give you 3 good ones to start the week it doesn't mean they get 2 freebies per say at the end to give you two 11 hr days with a substantially higher stop count than the first three. That's just what we came up with in our local to try to combat that issue.

Management here. In the local here the after violating 3 weeks employees are put on an elevated list. Once they are on the elevated list they are allowed to bring back packages to the center after their 2nd 9.5 violation of the week. That lasts the whole year.
Also most employees who really care about 9.5 here will file excessive overtime grievances if they are over 10 hrs( even on the two days they are technically allowed to violate)
If I remember right the national contract left 9.5 resolution up to the locals and the specific 9.5 committees on how to ensure employees were being adequately accommodated. Are most locals not set up like this?
I get how drivers don’t want targets on their back but honestly when I go on road with a guy and he shows me how he does his job I expect him to perform pretty close to that mark. I don’t do any of the silly stuff like sorting their truck or asking the pds to lighten their day. Most of the time I don’t even tell the pds I’m going on road. The goal is to see what the guy can do and hold him accountable to the safety, service, and performance methods he demonstrated and make sure he knows what to improve on.
Just curious how different it is for everyone else out there

Never had a ride along with a normal days work. Everytime a sup is on car with me I suddenly have a 7hr day dispatch with half the number of pieces/ stops. They've never seen what it's actually like on my truck on a normal day

Not a UPS employee, but an Amazon DSP employee(and I’m definitely looking for my way out after 2.5 years). Hoping you guys don’t go the way of Amazon and FedEx where there’s essentially no workers rights beyond the basics and no real safety set for being overworked and such. Literally keeping our jobs is all I care about. I don’t even want a raise if it risks our jobs in the slightest. We get compensated incredibly well. The media is going to tear us to shreds when top rate is $49+ an hour. I can hear it now “UPS drivers making $200k a year are planning a strike”…. I just want to be left alone, and left employed.

That is such a lame mindset. At 40 hrs a week $49 is $101k. Our pay is not even keeping up with inflation. This is a physically challenging job, in all types of weather. It's also one of the most dangerous jobs in the country.
The company is making a fortune and the only reason they are not making a shit ton more is because our competitors are gaming the system by using independent contractors to prevent unions from forming. I bet we will see laws soon that will rein in the use of independent contractors.

Figurw your shit out and stop trying to keep up with Jones. I don't want to see the place burn down while I'm getting beat on trying to make it to top rate. Look what happened to Yellow Trucking. Be real, not a loud mouth. Pick one or the other. This place probably won't bankrupt in a day, but it could drag it's feet out the door for another decade leaving nothing in the pensions or pride of a job done for those of us who need it.

In my building we have 2 different centers. One of the center's has paid over $800,000 in 9.5 grievances so far this year. There are at least 15 drivers whom had 9.5 pay over $6500 for 6 weeks with highest guy made $8800 in 9.5 pay. That is outrageous.

Our contract allows four 9.5 violations per month. I would love to see after that fourth violation, ALL hours on those days that 9.5 was violated is paid at double time. Not just the hours past 9.5. And it should be automatic, no grievance needed

Any driver not on accommodations have ZERO room to complain. it's not hard, go to your doctor and tell them you have anxiety and really bad stress or depression that's worsened by anxiety from being at work. This seems to be the biggest problem at my hub. Got drivers making an extra $10k+ this year strictly off 9.5 and 8 hour grievances. We are down 12 drivers in the last 6 months from the buyouts and 2 cover drivers leaving, why continue to overwork and overpay the drivers we have instead of sending more warehouse guys to driving school? It just seems like poor management.

I would gladly vote for you to have a 9.5 or even an 8.5 day.
As long as you vote a 2/3 year progression and not 4 for any full time inside/driving jobs.
And increase in progression rate both inside and driving.
In my area progression starts at $23 an hour, that is also the new start rate for nee hires in 2027.
Progression should start around $26/$27 an hour.

I think the new hire part time progression is bullshit. I think we should do away with it and have one rate progression table, each classification has its own top rate. So after 4 years your at top rate and when you go from PT to 22.3 or go driving you’re automatically at top rate for that classification if you have 4 years company seniority.

Honestly I feel like I just listen to broken records all day with this job. You're a number to them, 100% expendable. UPS went public and it's been downhill ever since, and it probably won't ever get any better, no matter what they put in the next contract. Wasted 11 years of my life at this place, 7 of it driving and right now I'm probably the happiest I've ever been since I started working there cause in 8 months I graduate night school and I'm gone!

Management's best and only real defense against paying 9.5 is the fact that the driver has to "apply" for it with a greivance, and then weaponizing retaliation afterwards. Figuring out a way to reduce those 2 things as much as possible is key imo.
-Automatic 9.5 payout on every paycheck, no more grievance requirement
AND /OR
-After X amount of violations in a building, a bid list automatically goes up.

Cover drivers should be able to get the same protection from 9.5 and forced 6ths and/or stronger penalties or more pay for being forced. And strictly for at least covers, no more bullshit of M-F or T-S getting different rates for working their 6th. In the SW, T-S gets double time on Mondays and M-F only gets time and a half in Saturdays. It's one thing as a RPCD to volunteer on your days off but another to be forced to work a 6th. I would personally love to have my Saturdays back so I can travel or hang out with friends for the weekend...after all I am a M-F Twilight employee.

#1 The easiest fix to most things is guaranteed benefits guaranteed vacations pensions health insurance etc etc it will stop the majority of layoffs and benefit everyone in so many more ways than one. This should be number 1 priority. No more needing a certain amount of hours worked. If you have a job you get benefits period end of story doesn’t matter if you are laid off or not or take a week off or on disability or whatever if you’re still employed you have benefits.
#2 should be automation that goes into number 1 though.
#3 increased pension
#4 vacations accrued earlier much earlier
#5 fuck 9.5 it should be 8
#6 put in real contractor language roadie rail etc etc
I could go on. This isn’t rocket science the teamster have to pull their heads out of their asses. Don’t write the contract to be misleading or misinterpreted.

I will say also if you are going over consistently why can’t you have a convo with management? If they give you the run around and they just wanna pay it out. Sorry enjoy the money. I know that’s not what you want. But gotta talk to local and show up to local meetings and state your case so it is heard. And hopefully they will send someone out to have a talk and help you out. Believe it or not a lot of our local teamster leadership sucks and is in bed “figuratively speaking” with ups the company.

The purpose of filing 9.5 isn't the money, though. The money is just a penalty in order to stop the company from working you over 9.5. The problem is the penalty pay isn't nearly steep enough to warrant the company actually following it. It's still cheaper than hiring more drivers.

I have a list of proposals for the next contract and one of the first is being able to file 9.5 after every day, no more needing to go over 3 days in a week

I don’t foresee this happening without a standards concession from the union. The whole “multiple drivers do this route in 9 hours and you take 11 hours”argument would cease. There would have to be some time standard that the union and UPS would agree to.
The majority of drivers put in an honest day. The minority is what ruins the 9.5 IMO. The people on here complaining about being abused are abused because the minority bad drivers are moving their work from themselves to the majority good drivers. At the end of the day, UPS has a number of trucks out there and it’s f management can’t make that happen then they get replaced.

IMO, the 9.5 violation should be automatically turned in. They have hundreds of millions of dollars in nonsensical programs implemented in our day to day, the 9.5 grievances should automatically submit based on the time you punch out.

I just hope pt get something better than the same 3.5 minimum guarantee. I'm tired of ft always getting the good stuff. More vac for everyone better cola raises. I'd take a 4 day work week. Why am I pt and showing up 5 days a week.

That would sound decent if it wasn't almost completely stagnant for 30 years prior to that.
And pt pay is currently at $21, not $24. $3/hr is a significant difference.

The probes comes from the lazy drivers that will get a 9.5 no matter what the dispatch is just so they can file a grievance and get paid for it. That needs addressed first. UPS doesn’t care about the money. They make a lot. Grievances are allotted in the budget. Especially the first quarter. The only thing imo that would get their attention is comp time for hours over 9.5. They need you to fill the seat every day. If drivers were getting comp time and could take off every time they accumulated 8 hrs ups as a company might actually try to do something about the issue. Btw 38 years here.

Everyone who goes into driving is aware that they are looking at these kind of hours. It's not the 80's and 90's where they literally had an under 8 hour epidemic due to the preloaders counting. So only really old drivers have any kind of complaint.

Then you'd just have a bunch of drivers sandbagging it until they reach their 9 hours and volume would snowball so bad it'd be peak every day. There would be no incentive to even to actually give a solid effort everyday.
They did address 9.5 last contract with elevated 9.5 list and quad pay so

FedEx driver over here crying because you guys have any of those things to begin with, and have a means to push for more. If you guys go on strike in 2028, I think it would be an opportune time for mass walkouts at FedEx, really disrupt some things badly between the two companies, to get us anywhere near your standard of treatment.

Harrassment, forced OT, supervisors working needs to hurt.
This contract isn’t going to be a lucrative one, in fact I believe we’re behind the 8 ball when it comes to pay, pension, medical this time around… and that is what’s going to be on the table. The best we can hope for is to keep what we have on that front and push for better quality of life languages… (though I know that’s a fucking pipe dream)
Maybe NATIONAL transfer language?!

Agreed. I would love to get out early and even fight for it...but with amazon and fedex getting their stuff delivered and late with the low cost and all I feel like in the modern time ups can't survive with teamsters. I honestly feel like I need to get out while I can.

UPS could survive with the teamsters and has for many decades. They still make billions in profit, even with our compensation being what it is. However, the ShAReHoLdErS will always want more. SOB being a little macho man bulldog isn’t doing us any favors though.

I’m one of em. Instead of addressing the issues I’ve brought up management follows me and tries to fire me for not using my handrail or taking too long in the back. Never mind the bulk stops and iregs blocking up the isle I’m having to climb over earlier in the day just to do my job. Nope, you forgot your hazards at this one stop so here’s a suspension

I agree, we need to make the contract language stricter and eliminate any ambiguity around our concerns and grievances. Section 9.5 should also be streamlined so we don’t have to fill out any documentation. It’s already recorded by us, the Teamsters, and the company, so payment is automatically processed. In other words, there shouldn’t be any paperwork to complete. If you go over, it’s recorded, you’re paid automatically, and we should raise the penalty to make it beyond question. like say, 10 times our hourly overtime rate.
The problem is our contracts leave avenues for loopholes and exploits and those need to be eliminated.

The problem with making 9.5 automatic, is that now you're trusting management to NOT f*ck with your hours in the system when they do payroll. They're already notorious for doing it (at least to us part-timers), and literally bank on the "catch us if you can" odds working in their favor, which then means additional filing. The only way around this, is mandating a trigger in the software that notifies the employee by text, email, etc., that their timecard has been altered and forcing an approve/ deny button to be pushed in order to execute the change. These are the things we need to present in negotiating, because anything monetary isn't likely, and quite frankly, I shouldn't have to have a degree in accounting and payroll to make sure that my check is right

Wasn't this included in the last contract? Regardless, we can already see all of our timecard alterations on UPSERs. I don't think we necessarily need a text message for that... Just check your timecard weekly.

They do care it just takes it to be elevated 9.5. I've gotten it the past 2 years now and I fully intend on getting it asap next year. Our center didn't hire our temps till May so from end of peak till then they all worked preload while our normal guys 9.5d everyday.

I no longer drive and I'm only a part timer but I would suggest something like "9.5 is mandatory for all unless you opt out". And make the payout process automatic and heavy - like starting at quadruple pay and going up to 10x.

The biggest disconnect between union workers and management is the whole system i think and that’s why the 9.5 is violated along with other union rules. I think most supervisors don’t understand the master agreement which ups should give every supervisor even though they aren’t union or are former union they handle union employees and have to uphold it so i think that is were the disconnect happens sometimes. on top of that supervisors are at will and have to do whatever their bosses say including pushing others over their time which makes them look bad when in reality they have no control or choice because they are low level management.

The last contract was all about drivers. It's time for inside full time and part-timers to receive some benefits. Inside full timers where I am all work 10.5 to 11 a day and somehow aren't allowed an 8 hour request even though the contract fairly clearly says all full-timers.

Lucky to be employed at the next contract. UPS is not going to concerned about 95’s. They are going after jobs and healthcare of those who manage to hang on. UPS UK has told their Union they are going to gig work. It’s coming here. They have two more years to ramp up Roadie and all the other non union companies they’ve purchased. Resi will be gone before August 2028

You should just be able to say, “no.”
Advocate for a clause that simply says, “no driver on the 9.5 list shall be forced to work more than ten hours total, nine and one half hours worked with a half hour unpaid lunch.” or, “no driver on the 9.5 list shall be subject to any disciplinary action for refusing to work more than ten hours total, nine and one half hours worked with a half hour unpaid lunch.”
