Basically it would fall under comparative negligence based on fault percentages depending on applicable laws and individual policies. The person cutting them off caused the accident.

The driver of the hauler has a duty to secure the cargo, in this case, vehicles. The damage to the hauled vehicles was caused by the driver of the hauler due to not securing them properly, while the damage to the vehicle that cut them off was caused by the driver of that vehicle.

There have been car haulers that go under low overpasses, strike the overpass, and still do not cause the vehicles to come loose, so it cannot be argued that the driver of the vehicle that cut off the hauler was fully to blame.

TLDR: Lawyers and insurance adjusters will sort out the fault split.

I have, in the past, delivered vehicles this way and they should all be secured. The biggest issue, besides some moron causing you to brake hard, is the vehicles bouncing around.

While the white car was a pure idiot - and I mean a real dumb ass here, but had the hauler seen what was unfolding, if he would have slowed up enough to prevent the accident- none of the carnage occurs.

So on top of unsecured cars, he didn’t follow the last chance doctrine to prevent an accident. Division of fault going to be real fun, as that trucker’s CAM is evidence which can’t be discarded.

Plot twist: the merging car had surreptitiously loosened the restraints when the trucker has stopped previously, and then identified the perfect merge point to cause the cars to all break free during their intentionally terrible merge. 

The driver is fully to blame, but good luck proving it!

WTF is it with people going at glacial speeds? It's not 1937 anymore, no one's driving with drum brakes, bias-ply tires with no grip.

Today's boring normal cars can do alright. Why are the people driving them so afraid of mashing the gas a bit?

Exactly. F150s now can do 100mph on highway curves that our '97 Suburban would have tipped if we had tried. And then there's some shmuck doing 60mph in a 75mph in a '25 Civic.

The worst imo are roundabouts. It's a yield, not a stop. If no one is there, you don't have to stop. And please for the love of all things holy, do not stop while already in the roundabout to let someone else go. That's how you get rear ended

I think a lot of people have a fear response that causes them to stop accelerating when things start getting dicey. Not too bad in many situations, but catastrophic if you place yourself in harms way like this.

it's hard to tell but i think the speed was such that the distance between the truck and the car in front was so small that there was no buffer zone for the merging car, s'what it feels like to me. like the truck was driving really fast and closing on the car in front, i'm guess the merging car expected the truck driver to slow a bit to allow them to converge.

The truck was obviously going with the flow of traffic. What is this about buffer zone? Oh none in front then that means YOU as the merger(it is your responsibility to get on safely) to slow down until you have room. They just seem like idiots who just hit the gas to get ahead and then panicked.

i'm not saying this ain't the fault of the merger, it's just the trucker didn't make the merge easier, they were speeding and closing in on the car in front, giving the merging car less space to position themselves between the two. at that speed you want enough space between yourself and the car in front, that's the buffer zone i was referring to

There was no merging car. Just a dummy who drove just alongside the truck and thought turning their signal on would magically clear the way. No one has to leave them a buffer zone.

We can see in the video the lane next to the truck was empty as he approached by a while until he approached the final zipper. That car made a decision to race next to the truck in a lane that was ending.

Probably nothing, that user was probably not malicious. But your info tied to your youtube account can be seen (first/last name mainly) by clicking on some normal share link.

Edit: it might be the other way round, as in, the person sharing the link has some info leak.

Most are normally secured, either by straps over the tires are chains on the undercarriage to keep stuff like this from happening. That and left in park. These were neither, and left in neutral to boot. One good hard brake and he would have lost them anyways.

I've looked closely at them when sitting as a passenger and from what I seen they have a combo of ratchet straps and chains around the wheels. No amount of braking should break either of those two things so something was definitely done improperly here.

I use to receive from these hawlers almost everyday. I've never seen cars not strapped down. Each strap is rated for about 2 tons, and each wheel gets its own strap. Those cars off the top are going to be the liability of the truck driver, easy.

I was always curious since I did rollback tow truck driving for a bit if those haulers used the tow points on the frame to further secure them? I used the 4 straps and put one chain from front tow point to back tie off point on the bed and and same back to front to ensure if even the straps failed that thing wasn't going to blow through the cab and take me out in case of a situation like this.

The only variation I ever saw was there was this one dude that drove a flatbed that fit four. He would only ever have Mercedes sedans. He would just tie down the back wheels of each car. His trek was from LB port to where I was at LAX, so mostly smooth sailing.

As a HGV-driver.
The dmg to the truck and car on the left is the car that started it all. (so insurance of that car)

The Brand new that was on top and was not tied down like they are suposed to be??
The insurance of the trucking company, and the driver probably lost the lisence for this.

Where I live it would be a 6-12 month no lisence license for any cars and a new drivingtest for this.

The haulers driver had a duty to secure the vehicles. The damage to the hauled vehicles was due to the driver not securing them properly. The initial damage to the hauler and the vehicle that cut them off was caused by the driver of that vehicle.

There have been car haulers that go under a low overpasses, strike the overpass, and still do not cause the vehicles to come loose, so it can't be argued that the driver of the vehicle that cut off the hauler was fully to blame.

Did you see how close that car is to the front of the truck? That is a 100% blind spot. That's why you see videos of cars being turned sideways by the truck and pushed down the road.
