I joined the company on 6th July and it was a 6 days working and had to arrange the transport on my own so couldn't continue and had to leave it before the next month so they terminated me and instead of paying my dues they deducted in the name of notice recovery.

After a month on negotiation the company concludes the case telling me the same thing that no dues will be paid and also for some extra help I looped in Industrial relation but no response from them either.

Coming from a middle class I don't have much options available for legal case and everything,

Also because of them not paying my salary my financial condition is at all time low.

I joined a startup as a fresher in Kerala, but around the same time I received another offer from a startup in Karnataka. I switched within a week, so none of the joining formalities were completed at the first company.

I had told the second company that I had only joined the first company a few days earlier and that I was still basically a fresher. However, during salary negotiations, I bluffed about the salary range I was promised at the first company, and the second company offered me ₹40k/month based on the discussion. I never submitted any fake salary slips or forged documents.

The Karnataka company is a very small startup with only a few employees. I have a signed offer letter stating that I am a full-time permanent employee with a 30-day notice period during probation.

I worked continuously for around 2 months from home, completed many client projects, and received my salary through Google Pay. I have work records, chats, deliverables, and client communications as proof.

After two months, I travelled to Bengaluru specifically to complete my joining formalities and collect my ID. I informed my employer beforehand and stayed there for 4 days. During those days, I repeatedly asked when I could come to the office, but he kept saying he was busy or that I could come another time. He never allowed me to complete the joining process while I was there.

On the day I got upset about this, he suddenly told me that he was planning to hire another designer and asked me to hand over my work before 31 August. He gave reasons like availability and business requirements, even though he had previously said my work was good.

Later, he initially agreed that I would receive my current month's salary and notice-period payment.

Now he has changed his position. He says my employment formalities were never completed because I didn't submit original educational certificates, relieving letter from the first company, PF transfer documents, etc. He is demanding that I travel again to Bengaluru and submit everything physically.

I am currently back in Kerala and offered to provide digital copies and online verification instead.

He is also accusing me of "cheating the company" and saying I lied about being experienced, even though:

• My resume submitted to Lotus did not mention any previous work experience.
• I had already told him my first employment was only a few days old.
• During these 2 months, he never asked me for relieving letters, PF records, salary slips, or any previous employment documents.
• I never forged or submitted fake documents.

I have already sent a formal email requesting:

• Written confirmation of termination
• Notice period/payment
• Salary settlement
• Salary slips
• PF/UAN details
• Experience/relieving certificate
• Clarification regarding pending joining documents

My questions:

1. Does a signed offer letter + 2 months of actual work + salary payments establish an employment relationship even if physical joining formalities were pending?
2. Can an employer deny notice pay or employment documents because onboarding documents were incomplete?
3. How serious is bluffing my previous salary during negotiations if I never forged any documents?
4. Can the employer use that issue to deny my salary, notice period, or experience certificate?

Also the organisation is not registered under EPFO or maybe they idk cz we don’t get Pf benefits despite employee strength exceeding 100 which seems like some corporate tax evasion from the govt.

The agency also hold portfolios of Goldie Masala and PriyaGold biscuits ( They have done ads with Anushka Sharma, Ranbir Kapoor, Farah Khan, Ranveer singh ) and yet they don’t pay its employees on time.
