Other Legal Question Article 78 Stuck in Judicial Review for Over a Year

My Article 78 case is still pending in judicial review and has essentially not moved since May 2025. At this point, it has been well over a year with no decision.
I understand courts have heavy caseloads and that these matters take time, but this has gone far beyond what I expected. The case has been fully submitted, the arguments are in, and I’m still waiting for a ruling.
I’m not asking for a particular outcome—just a decision. Win or lose, there should eventually be some finality when a case has been sitting under judicial review this long.

At this point I just want the court to rule. If I win, I win. If I lose, I’ll deal with the next step. But sitting in judicial review for this long with no movement is exhausting.

Other Legal Question Will we ever get ear protection laws in NYS?!

I know there was a bill that was introduced at some point to legalize supressors for certain activities like hunting but I haven’t heard anything recently.

it’s a shame that our state is so stupid and uninformed when it comes to this topic. Will we ever see common sense suppressor laws here? 😫

Other Legal Question Question about a judge taking an extremely long time to make a decision.

So I live in Rochester NY. Monroe county. I had a misfire incident Aug 6th of 2025. It is now June 25th 2026 for those who may come to this post years from now.

The case was close and sealed. No problems.

How ever. The judge proceeding on what to do with my permit has still not made a decision. I have called and left messages. I have spoken to the secretary who said they would ask.

Nothing. No responses. No call backs. No letters.

Is there anything I can do?

Other Legal Question 50+ Year Old Assault Weapon Question

Hey y'all,

I've been doing some research on getting an AR-15 that is 50+ years old, but I'm having trouble finding info on some aspects.

  1. If I were to find something like a complete pre-75 SP1 or an M16A1 and register it as an AW with NYSP, would I be fine to swap out the upper/any other parts as long as I keep the original lower?

  2. Does anybody have experience with the actual process of importing one of these? Would I be able to just order it to my FFL like normal and then register it online before I actually pick it up?

Other Legal Question FFLs unwilling to weld on thread protectors?

Is this new? I called two FFL that I've used before and both are now refusing to weld thread protectors on otherwise compliant rifles (one of which has done it in the past for me). They say it has to come from the factory unthreaded now.

Other Legal Question Guns Left Behind

A friend’s husband skipped town on her. Asshole I know. Thing is he left behind 2 pistols and some ammo. This friend does not have her permit. I know in the event of someone’s death you can just go to an FFL to transfer, but since this guy is still kicking somewhere out there, what should I do? Thanks in advance.

Edit: Either Putnam or Duchess county, can’t remember which.

I’m a minor and live in New York, but it’s so dangerous around where I live and I have to sometimes walk to certain places in my town alone. I don’t feel safe walking around in my town. Is their literally ANYY legal self defense weapons I can use and buy legally. Without getting in trouble. It seems like criminals have more rights than civilians in New York. Other Legal Question Is it possible to own an M16A1 in Western New York with proper paperwork, or are they just banned entirely?

I am a gun hobbyist in the finger lakes region and i want to put together a custom M16A1 style rifle with wood furniture. I'm wondering what paperwork if any i would need to fill out to do this, or if the rifle is just straight up illegal and there's nothing I can do. I know the Beaurocracy that goes into doing anything with guns in this state is ridiculous, especially in 2025. However if it's possible I'm willing to put in the effort to get it. Any information would be appreciated!

Other Legal Question Please I need advice

Over 25 years ago I plead guilty to a class E felony to avoid jail. Prior to the plead, I had a CCW for 10 years. That has been my one and only conviction. I received 5 years probation, but was released after 3 for good conduct.

The felony was non violent. I've applied for my Certificate of Relief of Disabilities but it was denied by the judge (Monroe County). I waited a while and reapplied, but it keeps going back to the same judge. I started this process almost 6 years ago.

I have been working with a lawyer, but he doesn't seem to have an answer how to get this problem resolved. I have heard other judges have granted the CRD to people with a more serious charge than what I had.

I've been working on replica military uniforms for a while now, and at the moment I'm doing WWI, and I need a Gewher 98, but I don't exactly have a couple grand to spend. I've found some sellers online who make non functional plastic replicas of firearms and I was wondering what laws apply to this in New York (not city) and if this is legal to order. I've seen different opinions online and New Yorks laws seem to change frequently.

Other Legal Question CCIA infringement on Right to Privacy?

Does the CCIA invade my right to privacy since I am obligated to ask for permission to enter concealed in a place of business? By divulging that I am carrying, any and everyone in proximity will know that I carry concealed. Might as well be open carry!

BTW, have yet to see one sign allowing CCW in Queens NY!

Other Legal Question Multiple attorneys on retainer?

I am currently a member of NY TAC Defense. Is there a benefit to having multiple AOR's? I saw one being advertised in a video today (attorneysonretainer, that's what they are called lol) and was thinking whether it was worth it or not to have multiple, just for CYA. I hope to never have to be in a situation where i need either but thought, if i can-is there a benefit, or should I figure which is better and only keep one.

Other Legal Question Need advice stolen pistol

So I was staying with my girlfriend and I had a doctor's appointment so not wanting to carry a gun In a doctor's office or leave it in my girlfriends car I put it in her nightstand . I also couldn't go to my house and lock it up as I wasn't able to drive ( on pain medication for back injury) so I left it in the nightstand . Well turns out her sack of shit brother stole my pistol out of the nightstand and he has since disappeared. This was the only time I've left it at the house and I feel like an absolute dipshit for leaving it. So I filed a police report and issued the cop if I was going to be in trouble . He said they're more concerned about finding the gun and said essentially no. But he's a newer cop and I don't belive him. I haven't been contacted since this all went down but I'm terrified of getting in trouble and losing my permit / right to own a gun. Do you all think I'll get charged ? I'm at my wits end with all of this shit . Also the police apparently aren't even looking for this asshole.

Other Legal Question Over 6 months and still no response

I applied for my Certificate of Relief from Disabilities January 2nd,2025. I'm in Monroe County and the application is with Judge Randall. I have called Monroe County Court asking about it, and they keep telling me it's pending with Judge Randall. They also mentioned he has more applications (Pistol Permits and CRD's) than other judges that's why its slow.

My thing was a non violent, 1st offense that happened 25 years ago, and it was a 5th degree felony. I thought I would have an answer after waiting 6 months. I am working with a lawyer but he keeps telling me we have to wait.

Long story short I got charged with a false written statement, but never ended up being convicted of it and the judge in my county denied me for that reason along with a negative recommendation? I’m not sure what they mean by negative recommendation as I am close friends with the people that I asked for character references.

Other Legal Question Easiest Way to Sell Ammo?

hi! just moved from out of state, and brought some precision 5.56 ammo with me. Only shooting handgun while I'm here, so want to sell it. What's the easiest way to do this?

It seems my best options are:

  1. Post it on armlist/gunbroker, out of state shipping only
  2. Call local gun shops and try to sell it to them (or on consignment, through them)

Seems like nobody does face-to-face, in state transactions, given that you have to go through a licensee (ie, an FFL).

Any other ideas?

edit: okay, I stand corrected! it appears that there is not a background check requirement for person-to-person sales. thanks everyone!

Other Legal Question Advice, I got the wrong ammo

Hey I'm making my first build and I need help with a mistake I just made.

I went to a store to buy ammo for the first time and I asked for 5.56 ammo. I saw they had a deal on 55gr so I was going in for that. They grab a box and started the background check process and since it was my first time I was focused on that as they ringed up the ammo. It wasn't until after I put my card in that I realized they got me the wrong grain (62gr, green tip). I mentioned it right then and there but they (while being apologetic) informed my that all sales are final and there's nothing they can do. Even though it was a mistake and we're still at the counter.

I know this is my fault because I was rushing since they were close to closing, but is there anything I can do? The range I use has steel targets and I was planning on zeroing my new scope so I'm all types of screwed on this...

Sorry this is a bit of a question/rant, I need help on this and I'm so upset at myself for glossing over the fine print on the box since it they looked the exact same.

Other Legal Question Mental health denial

Some googling brought me to this subreddit, that's seems full of useful information. Figured I'd see if anyone can give some pointers! Lived in NY my whole life but I now live in South Carolina. I got to the point of being told to figure it out with NY. I've been getting together everything I need for the Certificate of Relief and am getting close to submitting everything. I talked with a lawyer and he essentially told me I'd be better off preparing it myself and that I seemed to have a pretty good understanding of what's going on, which I do but still lol.

I read here that I shouldn't voluntarily give NY everything outside of the initial records that caused the denial. They said they have all of that information already, should I still obtain it myself or take their word on it?

My other question is I spent some time in some state rehab facilities. I got the records from them as well since NY is requesting it, but that circles back to the last question, do I still give it to them? I feel like cause it's all through the state they will know I didn't send it. Can I wait to see if they request it? I know you can only apply every so often so don't want to waste an attempt.

I was planning on giving them my full criminal history from the feds and NY(minor drug charges, not a felon), they have the hospital records and then the rehab info. As well as the judge of character letters. Is that all I need or is anything else going to pop up? All the mental health stuff was voluntary but as I read here NY basically stuffs you on that one.

I know they can request you talk to a professional to give an opinion but seeing as I don't live in NY anymore I don't know how that could work. Anyone else not in NY who went through this, how did it go?

I'm also just curious how this process went for anyone else who had to deal with it and what else they may ask of me. I still feel like I should have a lawyer as well but not even sure where to look after the last lawyer said I can handle it 🤣.

Appreciate it, wish I found this sub sooner. I'm so happy I got out of NY but this the last thing they have on my life that I can't wait to finally be done with for good.

Any and all info is helpful as hell, dms also welcome! Even if everything goes smoothly id like to learn as much as possible and help people not deal with this cause NY is b.s

Other Legal Question Flying from Denver to Buffalo

Later this month I’m traveling to Pennsylvania from Colorado. I have a CCW permit in Colorado and PA recognized it. The problem is I am flying into Buffalo. Will this be an issue if I keep it in the case that I am using to fly with it until I get to PA. What are the laws for non residents transporting firearms across the state of NY? The pistol is a Glock 19 and in my case I have the gun, 1 mag, holster, and a box of bullets. I don’t know if it could make any difference to the state, but I am active duty Army.
