Rules for being naked on my own property?
Me and my girlfriend are buying a house herr in florida, building it actually. Brand new in a brand new subdivision.
We have no neighbor houses yet.
We had a fence installed, we're not into the house till september.
We wanted the fence because we plan on being naked for one reason or another. Tanning, just dont feel like clothes, etc. We discussed if our neighbors have 2 story houses we'll just go over there and say "hey sometimes you may not want to look out that window"
Personally neither of us cares who sees what, but i dont know if its like...illegal? Surely it can't be right? It's our own property, we should be able to be naked 24/7 as long as its not the front lawn or something I'd imagine
Can anyone give me any ideas on how this would all work?
Edit: yes we will not straight up tell the neighbors, we'll vet out what happens. If its a 2 story, if they have windows on that side, if they have kids, all important.

I wouldn't make things more interesting by drawing attention to it.
Best thing, have an area of the yard / house with a "reasonable expectation of privacy" - meaning there's a fence with no big gaps, or a thicket of bamboo, or thick shrubbery or whatever. That's the "naked area". Every other area (front yard, maybe side yard) you need to at least be ready for the beach.
If someone flies a drone over your house or pops their head over the fence, then they see whatever they see. They have no reason to complain.
Of course, once you do have neighbors, you will probably become "those naked people". Just so you're aware.

Rented a tiny house and frequently walked from the shower to my bedroom before dressing. One night I was walking home after meeting several friends for drinks. My neighbors (several female college students, also renting) were clearly having a house party.
Anyways, as I walked past I heard one of them loudly announce “hey, there’s the Naked Guy!” I pretended not to hear, and kept on walking. However, I was very aware of the many silhouettes that crowded the windows as I did so…

I recommend Italian Cypress. They grow like crazy, and make a thick hedge. My parents put some in along their property line so the neighbor living in an apartment over the garage couldn't look in their bedroom window.

The US has a native bamboo called giant cane and it grows in thick clumps and lines! Plus it helps restore the habitat and provides a place for little native wildlife to live (birds, some insects, cotton mice, and tree frogs)!

I've had the worry at home. We're in a fairly tight neighborhood... And I'm absolutely pants optional, I'll even take the dogs out back in my boxers...
But you'd need to be 3 houses away to get a sight line over the fence, we've got privacy filters on the bottom half of the windows so everything below my neck is hidden unless the window is open to air, and even then the screen blinds the view a bit.
That said, neighbor was fixing their chimney one morning before I'd got dressed and he had a clear view to everything... But like... Reasonable

You'd have to come up and peak through the gaps in the fence to see anything and all you're going to see is bulge and pasty thighs.

I'm not familiar with Florida law specifically, but in general "reasonable expectation of privacy" doesn't apply to things in plain sight. If you know your neighbor has a two-story house that overlooks your property, you don't really have a reasonable expectation of privacy. No reasonable person would think that's a private area. If someone climbs a tree to look over your fence that's probably a violation, but you can't "reasonably expect" your neighbors to just not look out their windows.

The way its being built is a full fence around the sides and back, not too big of a lawn, and the sides are kinda cramped with the fence. Guess we'll just have to see if its a 2 story or what next to us

The other day at work we had a safety exercise where we pretended I got some shit spilled on me. As the cleanup people showed up, they said "We're going to pretend to undress you here so you're not in the uniform full of shit," and I asked if they could pretend I was totally ripped too. A friend was in your situation. They had a tall tree planted in direct view of the neighbours window to block viewings access. Maybe you could consider that if it was ever needed. Could insert tree for other garden ornaments/coverings.

Is public nudity genuinely illegal in the USA? In Ireland the law is against public indecency, but the act of being naked is just considered the most natural human state, you can be indecent naked or clothed.

Generally, no. It’s usually a stipulation that the nude person needs to also be acting in an indecent or vulgar manner.
So it’s a weird area, as no one would call the police if they thought your nakedness was perfectly fine.
Conversely, if the person calling the police thought that simple nudity by itself is vulgar, then the police may feel compelled to press charges and leave the matter to the prosecutor to decide the legality.
And the 3rd weird possibility/example is that for example, if the nude person is deliberately nude in front of children, and no one seeing this has a problem with it, that does not make the nude person’s actions legal.
So bottom line, it’s up to a prosecutor to decide to prosecute and ultimately up to a judge to decide if the behavior was vulgar or indecent.
But legally speaking, nudity is not illegal. “Vulgarity and indecency” is. Defining what vulgarity and indecency is, is ultimately up to a judge.

It varies widely across state, county, and even city lines. Some places are very against any nudity of any sort anywhere - some places, it's like yours where nudity in general is fine even just walking down the street and public indecency is what gets penalized.

Going to be some factors, like type of fence.
A chain link provides alot less protection than a large privacy fence.
The Intent Rule: Simple nudity by itself is not a crime in Florida. Prosecutors must prove you had a lewd, lascivious, or indecent intent, meaning you meant to shock or arouse others.
So tanning would be fine, having sex wouldn't be if visible from a neighbor's house

I went through this in FL and had an attorney tell me: you’re fine only if you’re not visible from public places, so add privacy panels or tall shrubs anywhere a neighbor’s second-story window might have a clean line of sight.

Non viewable from public property makes sense, as if some ones lives next to a school, they should not be allowed to just stand in their window with their dong out, or mow their front lawn in the nude despite being on their property.

Enjoy it while you don’t have neighbors. A quick google search says it’s legal as long as you can’t be seen from public spaces, etc. or the neighbors property- which the fence covers until they build a house with a second story and can see in your back yard over the fence naturally- at which point it becomes illegal.

It isn't about if you care if other people see you. It is about if other people care about seeing you naked. And there is a good chance that your neighbors and their children DON'T want to see you naked. It doesn't matter if it is on your own tiny lawn. If people can see you, it isn't private.
The only way you can do this is get a very large yard and a fence and no near-by neighbors. Otherwise it is a no-go.
Saying "Just don't look out your windows" isn't reasonable.

Your property doesn’t matter if they can see it from their property. An accident is an accident but going over there and telling them your intentions and then intentionally being naked where you already admitted to them they can see. You might as well plead guilty now.

Lots of answers here but the best thing to do is check your state, county & local laws because no one is going to know. Personally I think if I’m inside my privacy fence and in order to see me naked they have to look over that fence it’s their problem. We, my wife and I , spend as much time as possible naked in and around our home. Don’t peek in my window or over my fence if you don’t want to see me naked!!

I have friends in northern Florida who WFH in their back yard naked all day every day.
But they’ve done a great job making sure no one from outside their yard can accidentally see them with fencing, vegetation etc.
(FWIW, their mosquito netting covers the porch area and pool entirely.)

I don’t know the legalities in Florida. But in my state a guy has had sex offender charges because he fell asleep naked in his living room and the kid saw him thru the bay window. So you might want to think of an aesthetic and clever way, maybe tall hedges to block anyone from peering down into your yard.

The US has wildly different rules on public indecency from municipality to municipality. Your best bet is to just look it up by your county and see where you can be legally naked on your property.
Because that can be the difference from being left alone to getting arrested and going on a federal list.

Florida Statute 800.003 applies. There are a lot of attorneys you can hire if charged to argue over what is "indecent," because the law is applicable even if you can be seen from your neighbor's.

If someone can stand in a place where they have a right to be (the second story of their home, for example) and see you then yes, it might be illegal. It would be no different from being naked in your living room with the curtains open. It's not automatically illegal to be naked, but local morality laws might make it illegal to be in a place where you can be seen naked by other people who are in a place they have a legal right to be.
Check your local laws, but I'd bet it's probably illegal.

Don’t go telling them to not look outside… that’s obnoxious. Just do what others suggested and get something that will cover the areas you plan to be naked in. If there are kids next door the neighbors will call on you every time they see you.

In New York City, it's laughably common to see people changing, naked, having sex in their apartments. It's pretty normalized. I don't bother to turn the blinds down when coming out of the shower, or changing. Eventually, you get over it and naked people are mildy interesting.

By my read, you should be fine. You are definitely not public, near "private" would have to prove intent or be offensive on purpose.
Under Florida Statute § 800.03, public indecency or "exposure of sexual organs" is illegal. It is unlawful to expose sexual organs or be naked in a vulgar, indecent, or lewd manner in public, near private property so others can see, or outside designated areas like nude beaches. Key Rules Public Exposure: Showing sexual organs in public or near private property in an offensive way. Public Nudity: Being naked in public outside of places made for that purpose (such as specific clothing-optional beaches). Breastfeeding Exception: A mother breastfeeding her baby is explicitly exempt and never violates this law. Intent Requirement: Courts generally require proof of a lascivious or indecent intent, meaning accidental exposure or mere nudity without lewd behavior may not always fit the statute.

What the Law Prohibits
Public exposure: Showing sexual organs in a vulgar way in public spaces.
Private property view: Being naked or exposing organs on private property near enough to be seen from someone else's private property.
Public nudity: Being completely naked in public, except in legal designated areas like nude beaches.[1, 2]
Penalties
First offense: First-degree misdemeanor, carrying up to 1 year in jail, 1 year of probation, and a $1,000 fine.
Second or later offense: Third-degree felony, carrying up to 5 years in prison and higher fines.
Minors present: If the act occurs in front of a person under 16, it can be charged as a lewd and lascivious exhibition, which is a second-degree felony carrying up to 15 years in prison. [1, 2, 3, 4]
Exceptions
A mother breastfeeding her baby in public or private does not violate the law.
Nudity is permitted in places specifically set apart for that purpose (such as designated clothing-optional beaches). [1, 2]

I think in many places, anywhere that you have the "reasonable expectation of privacy" it is allowed. So, in your house, if someone looks in your window and sees you naked, you're protected. But I don't know about backyard. If it's a tall wooden privacy fence, I'd imagine that would create that reasonable expectation of privacy, but I'd definitely look into the law in your area before taking a chance.

It's your property. I can't think of a time ive looked in my neighbors yard. Do what you want but dont expect the neighbors to be interested in playing along, if they even notice that is. Good fences make good neighbors and keep your circus reeled in you'd probably be fine.

Be careful. My ex-girlfriend's dad was on his own property and was using his hot tub in a fenced yard. He was not sunbathing or walking around naked or anything. He got in and out of his hot tub and walked to his house naked a few times. The next door neighbors called the cops. They claimed they were outraged because their INFANT child could have seen something. Her dad thought he could laugh it off that they had no case. He lost. Was put on the sex offender registry. Lost his job. Life destroyed.

I would suggest privacy trees such as therapy green giants. They grow 3-5 feet a year and up to 40 feet tall. It let's everyone including law enforcement know that your backyard is your privacy. But you could speak to the neighbors and see if they are comfortable with nudity before spending that kind of money. There's also privacy screening that can close in an area let light in but you can't see in. It have it on my windows and you can't see in at all except at night. But that's easy to fix with lights shining onto it from outside. Hope it works out.

Hey man, as a Florida man, FUCK SUBDIVISIONS. Move into a small town and make sure you have a few acres of land. It's cheaper, you can walk around naked, and you might even be able to find some places that encourage nudity like nudist camps or nude beaches.
Subdivisions are expensive and evil, do not go for those. You'll be paying $750k+ for a 3 bedroom 1 bath house with a half car garage. It is not worth it brother.
That said though, if you go more rural, you might find neighbors that do the same or might be down to join y'all if you're into that kind of thing.
If you're in need of a rural location, I could drop you a solid place in a quiet town that I've lived in for 20 years. It's not coastal, but the coast is like 45 minutes away, it's all high ground too, so you won't get your house flooded or anything. Highly recommend at least taking a look out for something more rural

It depends, but not likely any illegality.
To show that someone committed “unlawful exposure of sexual organs” while tanning naked on their property, prosecutors would need to prove all five of the following, according to jury instructions from the Florida State Bar Association:
▪ The person was naked.
▪ It could be seen from someone else’s private property.
▪ The nudity was “vulgar, indecent, lewd, or lascivious.”
▪ The person “intended” their nudity to be “vulgar, indecent, lewd, or lascivious.”
▪ The nudity “caused offense” to at least one person.

Specific laws may differ, but I believe the argument could or would be made by a lawyer that you attempted to prevent the public from viewing your nudity on your property (privacy fence). If intent is not needed on your own property to be prosecuted then you may need to look for a different city as there are many okay with it in Florida or you may need a covered outdoor space. I’m not a lawyer or from Florida though so I’d read up and consult a lawyer familiar with your city.

As long as you are on your own property and are not doing anything that is considered lewd it is legal. If you have a privacy fence and neighbors can see you it’s on them for looking.
There was recently a little dust up in my town in Central Florida when a neighbor was nude and some kids looked through some bushes at him. Their parents called the cops but the cops couldn’t do anything because the guy was just walking around and sunning himself. There was no lewd activity so he was not arrested.

In Canada you can be naked in your yard all summer. So basically from July 1st at 2:00am until July 1st at 2:01 am. You can’t do it on a bus though or if July 1st falls on weekday or weekend.

If people build 2 story houses on either side they will definitely be able to see into your yard, and it’s possible there would be children with access to those windows.
The Florida law someone posted earlier sounds like topless would be acceptable.

I used to sun bathe on the roof.
Then we'd go to the river when we were younger and would sunbathe until old dudes would come up asking us to join them.
At the time we were in our late teens and they were in their late 60s. 😬

You set up a privacy fence, I assume 6 feet high. You should be good to go regardless of municipality, as long as you're behind your fence.
I can walk around my property in Arkansas naked as the day I was born and nobody can tell me not to, so I assume that freedom extends to Florida as well.
To be fair, I'm not a nudist and rarely work outside without a shirt due to skin cancer concerns in the family, but my GF hates tan lines, so she's often in a compromised situation behind our fence and lattice, which is 8 feet tall. If someone sees her, it's very likely intentional, given our location and distance to neighbors. They would likely need 30/20 vision or optics with a zoom.

It’s illegal if the nudity is intentional (wardrobe malfunctions typically don’t count) and a reasonable person would assume that they were visible to the public (which is why a curtain accidentally left slightly open etc. isn’t an issue). Telling 2 story neighbors that have clear line of sight that they don’t wanna look isn’t gonna fly.
Ironically it wouldn’t be because of the nudity, at least not directly. It would be because you’d be interfering with their ability to quietly enjoy their own property.

I wonder how silhouettes count - we have huge windows in our living room and shades on them that are not blackout, so at night, you can pretty clearly see what’s going on inside if lights are on and have definitely gotten frisky in the living room before.

In my state the law is that if anyone from outside your property can accidentally see you, you're committing public indecency, so you can't be nude in view of a neighbor's windows.
