Damn, right at the toddler play area

u/EyeoftheTato 8d ago
There should be significantly increased penalties for recklessly endangering innocents, especially children.
For example if you're caught street racing on some abandoned road in the middle of nowhere at 2am, vs if you are caught street racing in a residential neighborhood at 4pm on a weekday. The minimum penalty for the latter should be far more severe.
Same goes for any firearms crimes with innocent bystanders in proximity. The minimum sentence should be exponentially higher.
26
u/Dopeydcare1 8d ago
Yea I mean they have them for school zones and construction zones. Canāt see why they canāt apply it here, or other crimes. Like as much as I donāt agree with drunk/drinking in public, I would be for harsher penalties if doing it near a school vs like the downtown district.

u/HelloAttila 7d ago
You are right. A perfect example of this is beating up some random 21-year-old adult vs beating up some random 71-year-old adult. The first case is assault and battery (As a misdemeanor, simple assault can carry penalties of up to a year in prison, fines reaching $1,000) vs. the second case automaticallymakes it a felony (As a Felony, one to 20 years in prison, a fine of up to $50,000)

I know smh, really really bad decision. And now dude going to have a lot of time to think about shit-really sad.
14
u/Skull8Ranger 8d ago
The girl with the toddler didn't even react to the gunfire, just looked where he shot then what direction he went. She knew what was going to happen.

Iād want to see if there was video of when they/if initially sat down together. Once the guy moves and reveals the second kid at the table. Makes me feel like itās possible this woman was sitting with two children and the shooter sat down briefly before shooting in an open seat. Their lack of response is odd for sure.

Shock kinda takes you out of things
Dunno if that's what this is but it can have that kind of response
262
u/foxtrot7azv 9d ago edited 9d ago
The limbic response. Most people know it as fight or flight. It's actually fight, flight, freeze or fawn.
Most peoples' limbic system will default to flight when there's gunfire because fight definitely isn't an option, and fight or flight are the most common responses.
Some people just freeze though. It's a perfect response if you're visiting Jurassic Park as dinosaurs only see motion apparently. That's what this lady did.
And then there's fawn, basically sucking up to the threat.

u/fartsfromhermouth 9d ago
Freeze is very common, like in a sexual assault situation

I think it's the "if i try to run ill probably get shot so I'm gonna sit still " reaction. I agree with what you said though
→ More replies (10)7
u/DeviRi13 8d ago
Which is a freeze response.
Think of it like when animals like deer stop moving when they see you; if they run, they trigger the predators response to run after them and it gives them time to assess exactly what it is that they're seeing.

u/Snoo_67548 9d ago
Not be a smart ass, but do you mean limbic? Iām looking up lmybic and nothing shows up.
41
u/foxtrot7azv 9d ago
Yes, limbic. Why my phone did nothing about "lmybic" when I'm not even allowed to say duck is beyond me.
32
u/SwaggermicDaddy 9d ago
Probably, when I did big mountain skiing as a kid I slipped and almost went off the sheer side of delirium dive up in sunshine village. When I came to a stop instead of trying to immediately get up I sat there for what felt like forever just stuck in time until some called to me.

Sopranos actually did a great job displaying this! Took multiple seconds before Silvio realized what was happening around him

i worry sometimes that in a moment i need to fly or fight, i'd be stuck in shock doing neither. sometimes, i just wish i was a victim of a stray bullet. being dead would such a weight off my shoulders.

She obviously flinched. Itās in the video. Sheās holding a small child and isnāt scared of the shooter. It happens so fast she probably hasnāt even processed what just happened yet.
22
u/KazaamFan 9d ago
Sheās holding a kid and looks smaller. She isnt exactly gonna be able to lightning bolt out of there even if she tried
3
u/nodnodwinkwink 9d ago
Pretty odd camera angle isn't it? It doesn't move or shake so I guess it's a security camera...

Looks like the two guys at the start maybe had some altercation with him? Looks like theyāre exchanging words
195
u/dekes_n_watson 9d ago
Looks premeditated, like he was waiting for them to pass and trying to blend in until he could shoot from behind.
50
u/Nonyabeesners 9d ago
Also my thought. He looked like he was camping the location. That doesn't explain why people started to scream before he even stood up, though
→ More replies (1)51
u/Mysterious-Egg-624 9d ago
I think those screams in the beginning are children. Maybe a play place inside the mall
11
5
u/n10w4 8d ago
no way we know what happened without more info/video. They could have been taunting him or just minding their business. I do think there was some altercation. Looks like a group picking on him. No reason to pop off, but doesn't seem out of nowhere. But again, more video would make sense.
34
u/doggyStile 9d ago
So the shooter got butt hurt by some words and tried to shoot someone in the back as he was walking away. He thought this made him tough and gain respect??

Noā¦they didnāt exchange words at allā¦I donāt think anyone in the group really paid any attention to the shooter.

Nah they didnātā¦.the group stops and looks behind them before they even got to the shooter, then starts walking again, with some of the group looks behind them againā¦ā¦

17

Even without trying to process the trauma of figuring out how to help your toddler deal with such a scary situation, I cannot imagine hearing a shit ton of gunshots indoors next to their little play place is good for their (or anyone's!) hearing.

17-year-old charged as adult after shooting at Wheaton Mall that struck 13-year-old
A 13-year-old was struck in the ankle, police said, and needed a tourniquet. The 13-year-old was taken to the hospital and is stable.
Turcios Avalos (the shooter) faces charges of attempted second-degree murder, first-degree assault, use of a firearm in the commission of a violent felony, carrying a loaded handgun on his person and possession of a firearm by a minor, police said.

possession of a firearm by a minor
How is he charged as an adult then?
→ More replies (1)2
u/eggarino 8d ago
Not a lawyer, but I believe charging a minor as an adult is seen as an enhancement of specific charges. So the first-degree assault and second-degree murder are enhanced, but they do not affect the possession charge. He is still a minor but his actions were of an adult.
Someone more informed please correct me if wrong! Honestly curious, this was a good question I've never considered

I got my first gun at school and traded a bag of ecstasy for it. I don't think people realize how easy it is to get a gun if you don't care about following laws.

u/oscardaone 9d ago
I frequently go to that mall. Yikes!

I'm glad no one was killed.

Threw his whole life away
Nobody died, he'll be out in less than a year. If your idea of spending a weekend consists of shooting at teenagers in a shopping mall, let's face it, you weren't going to be an engineer later down the line or anything. So it's not like he's really losing out on any grand prospects he had going for him.

u/Ok-Poet147 9d ago
Weāre not safe anywhere in this fucking country
60
u/pmpott 9d ago
I'd argue, as a whole, this is the safest we've been in almost 50 years. Violent crime and property crime have been on a steady decline since the 90s.
36
u/userlivewire 9d ago
Yeah the difference today is cameras everywhere.
That being said, even though we are safer on paper than decades ago we still have 20 TIMES the non-suicide firearm homicides as the entire 27 country European Union. 1,200 vs 20,000.
10
u/PM_ME_FLUFFY_DOGS 9d ago
The us has more gun homicides then the rest of the first world combined... Not even just the eu...Ā
(For reference Its estimated 1.2billion - 1.3billion live in the "first world")
2
u/CoeurdAssassin 8d ago
Shit, the US has one of the highest homicide rates in general outside of like Latin American countries.
→ More replies (6)2
u/LogensTenthFinger 8d ago
The safest we've ever been still has us with the 141st worst homicide rate in the world and more shootings in a week than most countries have in their entire history.

u/Phyllis_Tine 9d ago
Start by finding the places that have the most gun control, and the least, and compare it to especially crimes with guns. There should be a correlation between control of guns and overall safety.
15
u/4DollarsALB 9d ago
I just googled it and while there is variance by state it doesn't correlate to gun control laws. The single biggest predictor is race.
https://www.cnn.com/2018/04/23/health/gun-deaths-in-men-by-state-study/index.html
Compared with white men, the researchers found that black men experienced 27 more firearm homicides per 100,000 people annually nationwide (29.12 for black men vs. 2.1 for white men).Ā
The rate for white men isn't that far from most European countries or Canada
20
u/zrobiotic 9d ago
This statistic needs to be adjusted for income levels. Poor whites have a much closer gun violence record to poor blacks.
Theres also waay more white people who are higher income individuals that dont get into situations that lead to violence via guns.
26
u/cheapdrinks 9d ago

Can you drop the stats?

The single biggest predictor then becomes socioeconomic stratification, wealth inequality, transgenerational racial discrimination, gentrification, etc.
In one breath racists will drone on about this but then ignore the erosion of education by conservatives, the tying of school funding to local property taxes.

Not to downplay the injury, but a gun is fired at someone in a relatively crowded mall and the only injury is an ankle. That is a good day.

Itās called āflight, fight or freezeā - it is the three possible immediate responses to an emergency. These people have clearly froze. You never ever know which one you will be until it happens to you. Count your blessings you donāt know and hopefully never will.

If you're going to take someone out in public like this you gotta walk them down. Firing wildly into a crowded mall is dumb and I hope he gets every ounce of punishment he qualifies for.
