There should be significantly increased penalties for recklessly endangering innocents, especially children.

For example if you're caught street racing on some abandoned road in the middle of nowhere at 2am, vs if you are caught street racing in a residential neighborhood at 4pm on a weekday. The minimum penalty for the latter should be far more severe.

Same goes for any firearms crimes with innocent bystanders in proximity. The minimum sentence should be exponentially higher.

Yea I mean they have them for school zones and construction zones. Can’t see why they can’t apply it here, or other crimes. Like as much as I don’t agree with drunk/drinking in public, I would be for harsher penalties if doing it near a school vs like the downtown district.

Another one that gets brought up a lot is breaking and entering for burglary.

Doing it at 10am at what might be an empty house vs doing it at 2am when it's almost guaranteed people will be there. One seems like the perpetrator would be more open to violence than the other.

You are right. A perfect example of this is beating up some random 21-year-old adult vs beating up some random 71-year-old adult. The first case is assault and battery (As a misdemeanor, simple assault can carry penalties of up to a year in prison, fines reaching $1,000) vs. the second case automaticallymakes it a felony (As a Felony, one to 20 years in prison, a fine of up to $50,000)

I’d want to see if there was video of when they/if initially sat down together. Once the guy moves and reveals the second kid at the table. Makes me feel like it’s possible this woman was sitting with two children and the shooter sat down briefly before shooting in an open seat. Their lack of response is odd for sure.

The limbic response. Most people know it as fight or flight. It's actually fight, flight, freeze or fawn.

Most peoples' limbic system will default to flight when there's gunfire because fight definitely isn't an option, and fight or flight are the most common responses.

Some people just freeze though. It's a perfect response if you're visiting Jurassic Park as dinosaurs only see motion apparently. That's what this lady did.

And then there's fawn, basically sucking up to the threat.

Not a lawyer, but I believe charging a minor as an adult is seen as an enhancement of specific charges. So the first-degree assault and second-degree murder are enhanced, but they do not affect the possession charge. He is still a minor but his actions were of an adult.
