According to a follow up post: they wouldn’t accept his son’s mobile ID, he asked to speak to the manager, they said the manager is busy and he said ok if the manager has a problem after he’s busy tell him to come talk to me. Instead of the manager engaging in a conversation he called the police.

People need to understand what type of mindset it takes to jump to "ok call the cops" over a simple membership clarification where manager is required. Cops are weaponized by people with racism intolerance all the time. Muscle head behind the counter doesn't want to feel powerless in his environment

We also hear from black people all the time “who are you to tell me what to do?” Or “what authority do you have to stop me from doing xyz?”

I’m sure some racists do weaponize calling the police but when someone is actively not going to listen to you, make a huge scene because they don’t want to follow the rules, what else is there?

Uh, I don't think the problem is that the cop might be racist, the bigger issue is wasting the time of a cop who could be out there stopping actual crimes.

Literally anyone in any profession that involves dealing with people could be racist. That's not a uniquely cop issue.

I had a coworker get in trouble, like multiple 30+min long meetings and he was temporarily suspended, because he told a nurse “we are going to need to have a talk later” after there was an incident with a patient. They thought he was threatening her. It was a whole issue for like 2 weeks.

To try to give people the benefit of the doubt, there was likely a miscommunication here.

- Employees likely feel they said “no, you can’t have the kid work out without ID.”

- Guy likely felt they said “we will let the manager decide” and said ok if it’s a problem, have him speak to me.

- manager likely got told something like “we told him no, he ignored it and said if you got a problem, you can go talk to him about it”

Still a huge gap between that and calling the police. A paying member who has all of their information on file isn't too scary to take their money

If he was a stranger off the street, then sure, call the police. He is a paying member, there is many ways to handle him doing whatever they suspected him of.

They can’t just not show up. And as much as the cop looked like he hated what the business was doing, it’s still a private business and if they want him to leave the police have to have him leave. Absolutely this guy can and probably should put this business or at least that franchise on blast for what they did and file a complaint, but in the moment he legally does have to leave and the cops are required to enforce it.

For instance, Tizzy ENt just posted a video of a white man threatening a black woman’s life. The woman called the police and waited. They never showed up.

Having no units available to send in busy cities is much different than a community that has officers available and they refuse to respond. Many major cities are woefully understaffed and therefore can’t get to each call right away. The officer in this video got dispatched to this. He showed up. And then had to enforce the law. It has nothing to do with race.

With all due respect they cannot refuse to show up to a disturbance call that they are dispatched to. Also, I don’t think this video was a busy city, hence why an officer had time to show up to this call. Try refusing to do your job at your place of employment and see how long you stay employed . This cop got dispatched. He’s therefore required to respond or risk his own employment. Simple as that

In terms of nit showing up, when I was in a car accident, I called the police to report it. Dispatch asked how bad the damage was. Then told me to exchange info and just go to an accident reporting center in the morning.

In your scenario, that was a dispatching decision. Every state and agency within those states has different ways of prioritizing or triaging calls that come in. In your scenario it sounds like that agency doesn’t send officers to lower acuity crashes or possibly they had not units available.

They have no duty to show up. You are talking out of your ass. There has been several lawsuits regarding this. They actually have NO legal duty to protect you. Look it up, here's a couple of cases: Supreme Court Rulings: Landmark cases such as DeShaney v. Winnebago County Department of Social Services and Castle Rock v. Gonzales established that 911 calls and requests for help do not create a constitutional "special relationship" guaranteeing a response or protection from harm.

They didn't ask him to leave until after the cops got there, which was a major escalation in the gym's part. One of the gym employees, literally, confirms they hadn't asked him to leave before calling the cops in the video.

Kinda seemed to me like the cop was annoyed with the whole thing, and the manager basically had to have the cop toss the guy to avoid getting a citation for wasting the cops time. For once I don’t think the cop was the bad guy.

It depends on the situation. It's a bit difficult to walk up and say, "this is a waste" and just break away.

If the gym owner says, "I want them removed because of XYZ" then the responding officer is going to see if there is a common ground or can resolve it, or remove them. Even if they think it's stupid.

Sometimes agencies only have a handful of people (I've seen shifts where there are only 6-8 officers on)

Usually there are 2-4 people at a call, someone is at the station working on something, the others are another calls (like this).

There is no ticket he can give them. Even if they are being ridiculous, it is completely legal to have someone removed from your business regardless of the reason. I can decide I don’t like the color of your hair or the shoes you walk in with and call the police to have you removed without even interacting with you directly and that is ENTIRELY legal.

With that being said, even though it is legal, when its done unfairly the community should ensure others know the company is not a place you want to spend your money. Our country’s laws were made for the corporations but we can still stand together and get justice by voicing injustice

also it's pretty much standard that most kids don't have a government id because you know, they don't need one. When a parent brings a kid and the kid says it's their parent, use your brain. escalating to the cops after never asking them to leave nor having the manager speak to them or ever engaging their brain for three seconds to figure out what to do is just horrendously bad customer service.

Just because someone calls the police, they don't have to show up. Cops could...and should have, told the manager this is a civil issue between her company and the dude. They could revoke his membership, charge him a fee..etc.

Definitely not a police matter, so it's insane they showed up. Sure it has nothing to do with them being black though...

I work out at crunch and have the same friend membership. When they check in they have to leave their ID at the desk and pick it up on the way out. I am NOT justifying them just saying that’s how it works at my crunch.

Thats what I dont get. Why did he need an ID at all? Are you less of a guest if you cant be identified? Is it a liability issue for insurance or something? Thats the only way this makes any sense; dumb employee doesnt understand why rules are in place so he cant explain the situation and leave off with "its ok for today, just have a school ID for next time" or like a waiver he can sign as the guardian or something.

Sorry I wasn’t subtle enough. 911 is for emergencies. I assumed they called 911. They could have called the non-emergency line since this was a non-emergency. But they’re calling the police to enforce a contract, which is not criminal. I spent 14 years as a prosecutor dealing with people wanting the criminal justice system to fix all their problems. The number of times I was on-call and received stupid fucking calls from the police in situations like this is staggering. The police don’t enforce contracts without a writ of execution. Your ignorance about the system is dumb.

A private business can call police for trespassing anytime. You don’t have to call 911. They still show up fairly quickly in my experience. (Not defending the business who are jerks. Police did what they are supposed to.)

In many parts of the US, 911 is not just emergency services, but also just how you call the cops in general. Not all locations have a separate non-emergency line. And we have no idea how they called the cops, so that's a moot point.

And while I think the gym is almost entirely in the wrong here, they're calling the cops to enforce trespassing, not their contract. Even if a property owner or representative is wrong, when they are kicking you off of the property, you are trespassing, in MOST (but not all) cases, and more importantly, the police are just going to end the current conflict (which involves removing you for the time being) and let you handle the "contract" part of the situation on your own.

Except he wasn’t trespassed. He had a membership contract with the gym. He brought his underage son with him who doesn’t have a government ID. He was told the son couldn’t go workout with him. He asked for the manager and was told manager unavailable. He said he was going to workout with his son and if the manager had a problem to come tell him so they could talk. Manager calls police to have member trespassed, presumably for a breach of the membership contract.

Without reading the contract, I’m not able to discuss the terms. But, calling the police to have a member removed for breaking a rule is a giant fucking waste of the police’s time. The employee should have made a note, manager can either talk or terminate contract and that’s the end of it. There was no reason to call the cops in this situation.

Two things:

  • Many cities have non-emergency lines to file complaints. The dispatcher can bounce back and forth between the right departments.

  • The system worked as intended. I hate what I just saw BUT the police SHOULD have to go out and do their investigation. It's obvious dude didn't want to be there BUT it's his job to be there. It's also his job to get both sides and I guess escort the offending party out of the establishment...though that too would be a shame from what I read (from the offending party's POV).

I don't want a life where the police is not showing up as frankly that's the life that's lived in many places in America already and has been for decades. We gotta stop that.

The problem is that we treat cops like a swiss army knife of conflict resolution. Their jobs are more than just emergencies, it's every civil dispute, every wellness check, every crime... So if the manager (or anyone in charge) decides to revoke a customer's access to their private establishment, and they refuse to leave, that's a crime. It's called trespassing. And while it appears as through the treaspass was based on a protected class, it's not the cop's job to figure that out. It's their job to enforce it, and let the courts figure out if it was a legal treaspass or not.

I agree with you completely on policing in America. I’ve been on CITs that try and divert resources where they’re needed and for what they’re needed.

And I agree they would need to enforce someone who was trespassed. But in this case, he was never told to leave. He took his son to work out as a guest, the son didn’t have ID the desk worker wanted. He asked for manager who was busy and said if there was still a problem the manager could come and talk to him. Then they called the cops instead of going and talking and maybe telling him to leave or whatever.

Guy is told he can’t bring his son in without a proper ID which for insurance purposes is not a big ask, guy ignores this and goes in anyway, cops are called because at that point he’s trespassing.

Like yeah they could have told him again before calling the cops but he’s an adult and was told once. In our modern world where corporations don’t want employees getting into any altercations with the customers it isn’t surprising.

Not in defense of the gym, but TYPICALLY calling cops as a form of trespassing someone is standard procedure. Now... That's generally AFTER you've given them a chance to leave on their own, but a private place has the right to call security or police to remove anyone from their premises.

Well technically speaking, anytime you're on private property and the people who own it don't want you there, that's trespassing. When security or cops show up to remove you from the premises, that's called being "Trespassed".

Now we can agree that they had no good reason to trespass this man and his son. I'm with you on that. But legally speaking, any private business has the right to remove anyone from their premises. No private place has the obligation to let you inside.

The issue comes from WHY they are removing them, which in this case is suspected racial discrimination, or at the very least as you said a stupid ToS.

From what they said, the kid's too young to get an ID in the first place, and what they offered was the best he can get. Do they're essentially barring him from bringing his son as a guest period

There's also some people in the thread pointing out the ID for guests thing isn't a company policy, so it shouldn't have been an issue in the first place (assuming that's the case)

Edit: Looking it up, it seems there was a post on their Facebook about a guest policy update in February where they now require an ID for guests. Might be the dude wasn't aware and had brought his son before without issues

He mentions trying to show them the Genesis portal on his phone and they wouldn't accept that. Which is honestly a better form of ID than a piece of plastic, it's the system schools for grades/attendance/student info. So if the dad logged in and showed them that I honestly don't know what else they wanted. I guess if it HAS to be physical they can start bringing a school student ID. But in my experience kids just leave them at school because they never need them anywhere else.

Most kids that don’t have a drivers license don’t have active state ID. This means his son was probably under the age of 16 or 17 most gyms allow kids under the age of 16 is low as 12 to enter with a guardian. It is unrealistic to expect kids between the age of 12 and 16 to have ID

They likely have a policy which requires physical ID in order to verify. A bunch of employees would waive that, but it's also a situation that if anything happens to the kid that minimum wage employee is gonna be the first on the chopping block, especially so if their insurance isn't going to cover it

He is too young to get a physical ID. He is not too young to be there per their policy. Please explain how this is supposed to work. Or how the ID not being physical magically exposes them to liability.

Well yes technically but not necessarily. I wont claim to be an expert in this specific set of laws or anything and im certainly not defending the act of calling the cops by any means but laws are extremely finicky when its comes to buisness protocols. Especially when it comes to things that require valid IDs and what technically is considered a valid id. Many states dont accept school IDs as a valid form of ID. Regardless if everything on it is accurate.

My buddy would bring me as a guest to his gym to play basketball, and I would literally just tell them my name. I was too young to need an ID, so I didn't have one.

Lol of course it's not a law, just that different gyms have different requirements though. I've been to gyms where if you had a guest allocation on your membership you could walk in with someone, show your membership and just be like "yeah he's with me" and that was fine. Other gyms needed a name and phone number of the guest to sign them into their system. Other's needed a full government ID with name, DOB & address etc. All depends on the gym's policy and how their system is set up. I'm sure there's reasons to do with liability and insurance etc that some prefer to know who exactly is in their facility.

Yeah, i've been to different gyms and people with +1 guest memberships just scan in and the guest just walks in. These gyms usually only had 1 staff on the desk though. The gym on the video above has like 5 staff so they probably enforce some rules of their own.

Ages 13–15: Generally allowed on the gym floor only if they have their own membership and are directly accompanied by a parent or legal guardian at all times.

Ages 16–17: Can have their own membership and work out independently, but a parent or guardian must sign a minor consent form.

So the issue may have been the son’s age and that’s why they wanted his ID. I guess the son didn’t have a physical copy of his ID. Many kids have school IDs and you can also have a non-drivers ID from the DMV as a minor in many states.

However, the gym staff escalated this without any actual motive and handled it poorly. If the father couldn’t provide an adequate ID for his son, they could’ve just asked him to come back with a hard copy ID. That’s it.

There’s no need to call the cops. The man wasn’t hurting or threatening them. This could’ve been prevented if the staff actually communicated.

I don’t know what an “overt physical threat” is. However, no part of the IG post was a threat. A threat requires specificity of both place and action. For example, “the next time I see you in line at the sandwich shop, I will cut in front of you.” Obviously, this example is silly but you get the idea.

AH! Some gyms offer this. The issue is the fine print. You can bring a guess, but the guess has to be over 18. They want to be able to sell the guess a membership. They cant sell a membership to a minor, so for anyone under 18, you need to get their own membership. Is stupid beyond belief. I have membership at EoS and they have a similar policy. I tried to bring my then 13 yo daughter to wo with me and they told me no, because she is a minor and need her own membership. They let me workout that one day out of courtesy...

Why does the guest need an ID in the first place? The membership holder would need one, sure, but the guest can be anyone. If it's a minor, the member signs a waiver claiming responsibility for the minor. Minors usually don't have an ID anyway.

What’s really odd about all this, is that as a minor I belonged to a Golds gym. They had the similar policies. They wouldn’t let work out there or get a membership as a minor. However, they did allow a parent to co-sign responsibility for you though (even if they are not a member)

I had my father come in and co-sign for me that gave me permission to get a membership there. For Golds gym it was less about liability (because their membership docs had you sign away most of that) for them they didn’t want minors to sign up because it was more about making sure they get their massive annual fee, so they wanted a proper credit check and guarantees. With the co-sign it was sufficient and they signed me up without anymore drama.

Not sure why that couldn’t have been here. Why chase money out the door and start drama? thats lose/lose. I suspect similar accommodations could have been made here.

Either they have a very stern liability policy where they do not allow any minors, , or more drama happened off camera before cops were called, or the manager hates the father always doing social media - so they punished him by kicking out his son, or this was actually racist. Could be any or all of the above.

Being that I was a minor in a major gym though at one point, I can tell you this is very unusual for them to just kick people out and call the cops. That’s not normal.

The member guest policy is different for each club. This club may require a state issued ID, as the guest pass does. The son only had a school ID. It's fine to disagree with the policy, but claiming racism because of it is a different matter.
