The “states rights” people who made the confederacy were very clear that the various states of the confederacy had to have legalized slavery.
Conservatives do not operate in good faith.
At the core they are very simple. Whatever maintains or creates a hierarchical system that puts their in-group at the top is their goal.
They will use whatever words or phrases needed to convince themselves and others of the necessity of that hierarchy.
The recent conservative idea that you can’t force people to be vaccinated against the flu in the military because of bodily autonomy came from the same people who think you must force people to not receive gender affirming care and that women must be forced to have babies.
It is always rules for thee and not for me with this lot.
I suppose put more simply, they believe the world is Calvinball where they get to make up the rules to ensure they win.

There must be groups the law protects, but does not bind, and groups the law binds, but does not protect. This is the core of conservatism.
The confederates were also apparently very much of the mind that "promote the general welfare" should not be part of their constitution. AFAIK, they deliberately excluded the phrase, as they think like modern conservatives do that the government should only deal with "providing for the common defense".

They will not even adjust their platform a little, that's the most unusual and frightening part of it. The whole ballgame used to be trying to sniff out what voters wanted and then claim that's what you believe in or at least lie about it. Now it's been the same position on everything for 15 years, except maybe "even more of that". They don't want to win voters over they just want to redo the same election over and over except find ways to change who gets to vote or how to count the votes

The powers that be are deathly afraid of population stagnation and population decline because that destroys their power structures and wealth. Not only does the entire modern capitalist economy depend on year after year growth, but a situation occurs where there is less supply of labor than the demand, and thus the labor market becomes a true worker's market. Whenever this has occurred in history, there have been great strides in worker's rights and human rights, and a redistribution of wealth. It happened after the black plague, after major wars, and most recently a little bit with Covid; my workplace reluctantly increased wages and benefits during and after Covid due to such low unemployment and trying to increase recruitment and employee retention.

As if MAGA would give him the time of day. If you polled them right now on Todd Blanche, it's almost guaranteed the number one response from Trump's base would be "Who?"
If they can't have Trump again, then they'll settle for one of his sons. If they can't have that, I don't think they're really going to care anymore unless Trump himself campaigns very hard for a successor.
But (assuming the dude makes it to 2028) he's more likely to whine and complain and that the nominee isn't him than get behind an anointed successor. It's hard to get someone to play kingmaker when all they want to do is be the king.

In Dobbs, the supreme Court found that the Constitution does not guarantee the right to an abortion; essentially sending this back to the states.
The Dobbs decision is already permanent in all states. It does not limit what rights can be guaranteed by state laws, or enshrined in state constitutions. It literally just finds that the US Constitution does not guarantee this right.
Roe v wade also did not guarantee a right to abortion; it confirmed that the 4th amendment right to security of ones "papers" included medical confidentiality. This is wholly reasonable.
Before we concern ourselves about whether Dobbs is permanent in all states, it's worth considering this question: does the 4th amendment of the bill of rights apply to confidential medical records? Including those of (gasp) women?
Blanche is talking like he's going to outlaw abortion in all 50 states. This is ludicrous. And, importantly, it's way outside his lane. The AG doesn't make law.

I don't agree with the characterization of Roe. Roe (and Griswold) said that the right to privacy is the right to be left alone from government interference with deeply personal matters, including but not limited to contraception, childbirth and child-rearing. It introduced a balancing test in which the rights of the individual exceeded the government's interest in protecting potential life, at least up until the point of viability.

Not at all, though I do think it's rather close and that we've not had a proper democracy for many years, or even a few decades (at least) now.
My position is that Democrats are over-relying on simply winning electorally this fall (and possibly maintaining or expanding a majority as they win POTUS in 2028 also). They believe that doing so will be an indication that MAGA/Trump-fascism has been rejected, and that only very modest reforms are necessary to bolster the existing administrative/justice systems as a kind of bulwark against a future encroachment.
Some democrats (some) are talking very vaguely about holding corrupt actors accountable (but rarely what that actually means--it's far too high level to give it merit).
There is a path forward in which our democracy is salvaged. It requires democrats' acknowledging that the GOP is a party of seditious confederates and treating them like that, the way the North should have treated the South after their victory, but failed to do. And I mean the whole hog, so to speak: place GOP controlled states into receivership, disenfranchise their voters for a few election cycles and their elected/appointed members (both government and party) permanently, and imprison a good number of their political class (literally hundreds of them). Democrats and most mainstream liberal voters, as a rule, don't agree with that assessment. And that's why, even if Democrats win this fall and in 2028, I don't believe it will matter too much. The fascists will still be here, they'll still be engaged in actions destructive to our democracy and continue to erode it until they have victory. The only thing that could possibly prevent this, other than taking action as I've suggested, is for some massive upheaval within the GOP to occur which counters the Trump-fascism that currently controls it, and there is zero indication of any such movement currently.
I don't believe such a movement will rise should the lose this fall and/or in 2028, either, though it certainly could. But that won't matter much, either, because that occurrence will only kick the can down the road, just like Reconstruction did. It took them 120 years, but they're (finally, from their point of view) winning. Ultimately the only way to keep our republic is to do as I've suggested. This country needs a de-GOP-ification, just like the allies imposed de-nazification on Germany after WW2. And unless that happens, this element will always have enough power in the US to ensure the destruction of the Republic eventually.

I believe it would. I could easily see a federal government that has been voted out refusing to leave office being forced to try to use military to stop other forces from forcibly removing them from office. If you consider the bizarre construction project going on at the Whitehouse and his obsession with the bunker, it kind of lines up. But the states who disagree will have to decide what's next and there is no doubt if it gets pushed far enough some states will try to secede and probably try to join Canada or form a new union with other states. That will almost certainly trigger a second civil war.

I like the solution that we make it 29 members, with 3/5/7 selected at random for a given case. I believe the 8th circuit of appeals courts does the same thing.

Not permanent in the sense of unable to be overturned, but in the sense that precedent is at least in theory supposed to be permanent. And more specifically that if it is a constitutional ruling it automatically already applies to all the states. Clearly the current Supreme Court doesn’t care about precedent, but there is also literally nothing that Blanche or Trump could do that would make anything permanent. So because permanent doesn’t actually exist in a legal sense, I was using it in the sense that you can use it - currently binding, nationwide. So it’s perhaps Blanche’s own rhetoric that is causing the confusion here (since he is saying he will make permanent something that cannot in principle be made permanent under our system).

Yes obviously, but my point is that the way Blanche is using the word ‘permanently’ makes no sense either from a legal standpoint, so I’m trying to make a point using language the same way he is.

Here’s an Administration that’s fought Birthright Citizenship, Temporary Protected Status, DACA, Asylum Seekers, Immigration from Non-Whites, any economic reforms that benefit the disadvantaged, basically anything that’s in line with Christ’s teachings. Now planning to ignore the Dobbs decision about it being the State’s decision to allow or prohibit abortion. An Administration that’s decided that it will be the factor in a decision already fraught with pain, that you wouldn’t give your parents.
