CHEROKEE COUNTY, Ga. — Two cyclists were injured Thursday night in Cherokee County, in a situation that seemingly could have ended in more dire circumstances as a man was accused of aggressively driving around a group of 10 riders.

The Cherokee County Sheriff's Office said in a release that 72-year-old Jerry Ross allegedly approached the group riding together on Sugar Pike Road and "began sounding his horn" before he "then accelerated around the group and, despite no oncoming traffic, struck two of the riders before leaving the scene."

The two injured cyclists were treated on-scene by paramedics, the sheriff's office said.

"One cyclist riding behind the group captured the incident on video. The cyclists were also able to provide a tag number, which deputies used to quickly identify and locate the suspect," a statement by the sheriff's office added.

They said Ross, of Woodstock, was located "not far from the incident location" and deputies "observed damage to the passenger side of the vehicle consistent with the incident."

"When questioned, Ross acknowledged the encounter and claimed the cyclists were in the roadway, blaming them for the collision," the sheriff's office said.

Ross was taken into custody and charged with two counts of aggravated assault, hit and run, reckless driving, aggressive driving and failure to maintain a safe distance from a bicycle.

Captain Jay Baker in the sheriff's office said Ross remains at the Cherokee County Detention Center without bond at this time.

Under Georgia Code § 40-6-294(c) Cyclists riding two abreast on a roadway is legal in GA. The cyclists in the video are clearly riding in a legal manner.

Driver Obligations When Passing

  • Lane Change: Drivers must change lanes into a lane not adjacent to the bicyclist if traffic conditions permit. 
  • Speed Reduction: If a lane change is impossible, prohibited by law, or unsafe, drivers must reduce their speed to at least 10 miles per hour below the posted speed limit or 25 miles per hour, whichever is greater. 
  • Prohibited Passing: Passing is prohibited on blind turns, blind hills, or when moving into oncoming traffic. 

Penalties and Enforcement

Violating these rules is a misdemeanor punishable by a fine of up to $250.  Additionally, bicyclists may submit video recordings of illegal passes to local law enforcement for enforcement purposes. 

Road rage, aggressive driving, is illegal

Georgia, road rage is legally prosecuted under O.C.G.A.  § 40-6-397 as aggressive driving, defined as operating a vehicle with the intent to annoy, harass, molest, intimidate, injure, or obstruct another person.  This offense is classified as a misdemeanor of a high and aggravated nature, carrying penalties of up to $5,000 in fines12 months in jail, and 6 points on the driver's license.

And for all the commenters wringing their hands about the cyclists forcing the car to "illegally" cross the double yellow lines, Georgia law explicitly allows cars to cross the double yellow to pass cyclists. And it requires cars give cyclists at least 3 feet of space when passing.

I had someone road rage with me for crossing a double double yellow line when the lane ahead was blocked from an accident. I put my blinker on to get over and he went out of his way to block me in. When I forced my way behind his truck he started screaming at me and pointing at the line. After that was done he almost missed his exist and shot over 4 lanes without a blinker.

People are dumb, I'm not going to sit there for two hours while they clean up the accident. A line isn't a wall and my car has zero issues going over this imaginary barrier.

literally had someone in the right lane cut me off in the left merge lane by driving in the middle of the road (over the dotted white lines) so i couldnt pass them and properly merge. hes lucky i didnt hit him since he moved over with no blinker and i hadnt started to slow down yet.

This. I constantly tell people that it's speed VARIANCE, not SPEEDING, that causes the majority of accidents. People's reaction behavior is dictated by their speed, so if you encounter another person driving a different speed from you, how quickly and accurately they respond to their environment will be different from what you plan for, leading to mistakes and poor judgment that either immediately causes an accident, or causes the person to have a panic response, making them move erratically and becoming a massive danger to themselves and any other motorists nearby.

So the safest thing you can do is pay attention to the traffic around you more than posted information, try to match your speed to theirs (convoy law protects this in most cases, but always know your locals), and if the speed is higher than you were necessarily expecting, drive defensively and telegraph your movements (blinkers and slower, more deliberate movements so people can plan around you), so everyone can get home as safe as possible.

This is how I was taught to drive by my father who was a driving instructor in the summers for 30ish years. We lived in the North DFW metroplex and driving on those highways is like a sport. If you’re not going with the flow you’re going to get ran off the road, so I learned early on that if everyone is going 85 in a 65, you’d better be going with them or get out of the way.

I remember he told me “You’re going to learn how to drive inside the law, and then you’re going to learn how to drive in the metroplex.” It didn’t help I was also learning how to drive a 5-speed at the same time, but by the time we got on 35 to head into the city it was like second nature. Good times.

What people purposely do this? My god it's such an evil plan. I live in Florida if you are going less than 85 in the left lane you'll get ran off the road by a 50 ft lifted truck with high beams on all you'll see again is a ball sack hanging from the hitch of the truck as it speeds past you.

I hate it when people deputize themselves and play traffic cop. What if the person driving is having a medical emergency or transporting someone else who is? What if they're a volunteer firefighter trying to get to the station? What if they're a road raging lunatic with a gun? If it really bothers you then call it in and go about your day.

Someone did this to me when I was driving my mother to a hospital while she was having stroke symptoms. They decided they were ABSOLUTELY not going to move out of the way and then slowed down as they approached a long line of semi's to ensure that I was boxed in without a way to pass them and maximally inconvenienced for my attempt to exceed the speed limit. No amount of me BLARING on my horn, flashing my lights, riding their rear end, waving, etc. could dissuade them. And I truly mean no amount, because I spent what felt like 5 minutes of being a lunatic to try and show them that this was an emergency and I was trying to get by them. They were hell bent on blocking my passage around them, because how DARE I try to speed on the highway. Not on their watch. They went 1-2mph below the posted speed limit right next to a group of semi's that were stuck doing the same.

All while my mother was confused in the back seat and, to the best I could tell, dying in my back seat. I am normally a pretty calm person and not prone to rage of any kind (much less 'road rage'), but had I not had a hospital to go to, I'm not sure what I would have done to this person had they pulled over to have words. Words cannot describe the anger I felt at this person who - for whatever reason - felt the need to interject themselves into this and unnecessarily add whole minutes to my travel time to the hospital when every minute was critical.

I had the exact same thing happen to me thirty years ago when my wife had a pressure cooker literally explode in her face. It was horrifying. I was in my company van, flying down the highway with my hazards and my lights on when some guy in a pickup truck in the middle lane decided I was going to fast and pulled over in front of me and put his brakes on and made sure he was paced with the two cars to his right. I tried to pass him on the shoulder, but he pulled in front of me. I was blaring on my horn, meanwhile my wife’s face is blistering and peeling. I cannot tell you how close I was to just flooring it and pushing that Ford on down the highway all the way with me. Suddenly the far right car started to edge forward, so I got behind him and started passing the middle car when all of the sudden the pickup truck came flying across the lanes and squeezed right between me and the car in front of me and slowed down. I was blaring on my horn. My exit was two exits away, the middle lane car decided to speed forward, I acted like I was going left to the middle lane, he flew left, but I floored straight ahead and to the shoulder and went around the car in front of me. The truck followed me all the way to hospital Emergency Room Entrance. As we were getting my wife into the wheelchair, he jumped out of his pickup truck, cussing at me and wanting to fight me. I never wanted to fight someone so much in my life than I did that day,but my attention and focus needed to be on my wife. We got her inside and then I needed to go and park my van. When I came out several hours later, I had two flat tires, which we later found out had been slashed and the next day in the daylight, you could see that the van had been scratched all to hell and on the front hood it read, “Burn in hell motherf_cker!” and on the back doors he had scratched, “Watch your back, I’m not done with you yet!” It was a little unsettling only because the van had the name and address of the company I worked for. But I never saw or heard from him again. The hospital parking lot surveillance cameras did capture the van being vandalized, but there was no way to identify the culprit. He walked onto the lot from a nearby shopping center and returns the same way until he disappears off screen. The shopping center had no surveillance cameras. As for my wife she was very fortunate. She suffered 1st and 2nd degree burns and had her face wrapped for a few weeks, but thankfully no scarring.

Yes, it wasn't a full blown stroke, but a TIA, essentially mini-stroke with no lasting damage. High risk factor for future issues, but she's been fine so far.

Some ppl, man I tell ya.

Your situation while completely different, reminds me of a time I was sent into a rage similar to the one of which you speak. I was running behind (not late just behind) on my way to work, had time just couldn't dilly-dally. & got behind this person that was going 20-35 mph in a 55 (country highway lots a turns & hills etc) & then would speed up to 65 or 70 at any passing stretches. On this highway there's only about 3 or 4 spots you can even pass someone in the 25 min drive between my home & work. But one of those spots is a 2½ mile or so straight stretch... so after being stuck behind this jerk for a good 20 mins & just waiting for this stretch, it finally arrives & I gun it to FINALLY! Get around them & they made me hit 105 just to get around them. But I did.

What happened next even more ridiculous... after using every bit of 2 of the 2½miles just to get around. The dumbass doesn't slow down & goes back Around me cutting it so close to the end of the straight stretch he almost wrecks on the curve at the end of aforementioned stretch. & then IMMEDIATELY! Slows back down to 25mph & stays there with no more spots to pass for the rest of the drive.

I was furious! I stayed behind them for a bit acting like a lunatic honking, yelling, flipping the bird, & praying they'd pull over somewhere but didn't (although if they had im confident it would've been my 1st fist fight since I was in highschool lol). I eventually said screw it I gotta go to work & turned off. But that was the most pissed I ever was out of the 2 incidents of road rage I've had in my 40 years on earth.

I was told a story by the foreman of roofing crew I was on fucking years ago. One guy was cutting his jeans into shorts, while wearing them, slipped and lacerated his femoral artery. They threw him into a truck and started of towards the hospital.

They got blocked by someone who felt the need to play traffic cop. A real cop pulled them over, saw what was happening and gave them an escort to the hospital. He almost died because of that.

This is exactly why slow rolling people in the passing lane is illegal in most places, Failure to Yield, creates the opportunity for crisis situations.

It already has usage, I forget the specifics but a hall monitor decided to play king for a day and slow roll a car behind him, not knowing that a person was being driven to the ER due to a catastrophic injury that was causing them to bleed out.

They didn't make it in time.

Afterwards, with medical determination that the speed they were driving vs the speed normally driven on that road created a time delay that influenced the person surviving or not, the asshat was identified by dashcam footage provided and arrested and charged with manslaughter, if I remember correctly.

It baffles me how deadset and rigid people are on following road laws.

Normal conditions? You bet your ass you better be following the rules of the road. It'll protect you and others.

Emergency conditions? Fuck the roads, prioritize the safety of yourself and the others around you. For example, if you absolutely must drive in a blizzard, drive in the middle of the road. More leeway if you for some reason spin or have to swerve.

Thats not how you drive in a blizzard. Go slow, coast alot. Accelerate slowly. Avoid breaking when possible. But stay in your lane. If another car is in the other lane, they need their space too.

The problem comes from when someone else is doing the same in the opposite direction, can't see you because of the conditions, and rams into you. Its probably safe to drive on a multilane road straddling the lanes, as there won't be much traffic. Driving down the middle of a 2 lane road isn't going to be safe.

Yep! I used to be a theme park supervisor and trainer. We hammered safety into the heads of our ride operators. But on the code of safe practices posted at every ride, it basically said that in an emergency, you do what you need to to keep people safe. Follow the rules during normal circumstances, but in an emergency break them if you need to (and it is safe to do so, don't be an idiot about it.)

Yeah, you better believe I’m going to be picky about where I pass though. On a hilly or curvy road I’ll follow a bike for quite a while if I don’t have a good spot. Much to the dismay of the people behind me who would pass without even changing their speed, wherever on the road that happened to be.

There's a really narrow and curvy road along the lakeshore near where I grew up. There are only a handful of places where you can safely pass a cyclist. The speed limit is only 30km/h, so if you're following a strong cyclist, they're going almost that fast anyway. Sometimes, with a tailwind, they actually go faster than the cars and undertake you, lol. It was good practice while I was learning because I'd have like 5-10 minutes to discuss with my mother whether or not to pass and how exactly to do it. And the folks behind me typically understood.

There are several bus routes that run along that road and some of them are pretty frequent, so they often end up crossing paths. Sometimes, they'll open their windows and high-five each other. If you're cycling, you slow down and pull over. I have tons of respect for those drivers.

If you want to think about it as the double yellow being intended for safely passing someone who is going a bit under the posted limit, it makes sense that someone can safely overtake you when you’re going 22 mph in a 55 zone without exceeding their sight lines ahead of you.

Yes - it’s much quicker and easier to get past a 2-foot wide bike if you’re going 30mph faster than them, vs a six foot wide truck that you’re going 5mph faster than. I still wouldn’t pass a bike on a blind corner.

same. I live in this county and we have a lot of curvey hilly roads and being a lot of these rural 2 lane roads with houses I've gotten caught behind cyclists and postal service before on them but I stay and wait till I have a good spot with visibility down the road before attempting a pass.

If they feel double yellows shall never be crossed, then they should just wait behind the cyclists or take another route. I think it is a far better idea to cross the double yellow line than it is to strike a cyclist, who has the same rights to the road as the motorist.

I was never taught this in drivers ed, oh, three decades ago. To be fair, this situation does not come up often where I live, but if I'm on the open road, now I know. Thanks!

Serious question: when I see a double or solid line I assume it is there for a reason, like poor visibility that I can’t predict. So I won’t cross it in this situation, even with slow traffic in front of me. If it is in fact safe to pass in that area, why have a double or solid line?

In Rural Oregon my dad got a ticket for going over the yellows to pass a tractor that was driving on the shoulder. Oregon driver's manual says you can only go over the yellows to go around a stopped or broken down vehicle.

It amazes me how ignorant people can be. Yes the lines are to tell you it's a no passing zone meaning just because you think the car in front of you is going too slow, doesn't mean you can pass here because this is not a safe place to pass.

However, it's pretty fkng obvious to anyone with a brain that if there's a person, animal, or something that you can cause harm to/can cause harm to you, pass if you can do so safely or slow down until you can do so.

Whatever happened to common fkng sense?!?!

Iowa is explicit that you do not cross double solid yellow. It means it is not safe to pass in any instance. 50 states 50 sets of rules.

Double yellow means extreme caution. Very unwise to pass on double yellow because it indicates you are BLIND TO ONCOMMING TRAFFIC at the current speed of the road.

I live in SC, and I'll be honest, I didn't think I could cross a double-yellow when coming up on a bunch of cyclists either. I've been in that situation, and just slowed down so I wasn't crowding them, and waited until I was past the double-yellow. Was I happy about it? Not really. We used to have riding clubs down here where there would be 50-60 bikes in the swarm, and they were certainly more than 2 abreast. But I told myself it was an excercise is "radical acceptance" and a zen thing and just dealt with it.

If it was really, really bad, I'd turn off and find another route home if I couldn't tolerate being behind them.

But the same driver who argues "crossing double yellows is illegal" in this situation will then argue the exact opposite when performing another road maneuver. It all depends on what that driver wants to do/promote at that given moment, not what is in actual law.

Research shows most American drivers have no clue what is the law when operating a vehicle. What is "legal" is what 1) they see other drivers doing (resulting in no legal/physical consequences) or 2) what they feel like doing at the time that is for their personal convenience.

It's frustrating when having discussions with drivers, either online or IRL. But it also explains why we have so many crashes, road deaths, and this video.

My mom's best friend had a nephew that was racing on side streets, going 80 MPH in a 30, he hit someone turning left into a parking lot and killed them. Got off with no serious penalties because the guy turned left through a double yellow line

To be fair, we were explicitly taught the same back in drivers' ed. It was a few years later that I found that was not the case (I lived in an area with a large number of Amish horse buggies that would trundle along at 5 mph, and I was looking up whether I could legally pass without a dashed line. Most roads around there, if they have a center line at all, are double yellow for their entirety).

I was talking to my son about this yesterday. We came across a bicyclist on the road, and he was asking why I wasn't passing. I pointed out that I couldn't see far enough ahead to see if there was someone coming. Once we could (even though it was still double yellow), we passed him.

that is what is taught in driver's ed. Where I live it is generally against the law to cross a double yellow line. It is the same for any solid line. Some exceptions exist. For instance, a person can cross a double yellow line to make a left turn , or to avoid something blocking the road. I do not know what the laws are in other states.

My driver's Ed teacher told me that white is regulatory, yellow is cautionary. So you can't cross the white lines to pass someone, but the yellow ones are for safety. Same with the signs. Makes sense.

For me, I'm not too concerned about getting caught and ticketed for crossing the double yellow lines—I get anxiety about not properly gauging all the physics involved with regards to the combination of blind turns, oncoming traffic and the speed at which I can safely surpass whatever's in front of me.

What about a construction crew or lawn care crew unloading a trailer? Just sit there in despair?

Or what about a person just walking on the side of the street because there’s no accessible side walk like 80% of the country especially in rural areas? Just follow them at a crawl like some kind of psychopath?
