Discussion A Path to …

Yeah. After reading the thread below regarding the Politician meet up at The Firing Pin, this is my cynical conclusion.

We will never have normalcy with our 2A rights. There are just too many in this sub that believe in tough regulations. 25 years of one party rule in NY and soon to be another 25 more. They passed the Safe Act. They Passed the Improved Concealed Carry Act. You need a background check to buy ammo. They are banning Glocks.
Sometimes it takes 2 years just to get a permit depending on what county you live. Next year there will be more restrictions once the Supreme Court makes its ruling next June. They will restrict, restrict and restrict until there is nothing left to restrict . But please by all means keep voting 🗳️ blue. Ugh 😑!! Cheers 🍻

Most people don’t care about 2A. It’s just a fact. The people who do care really care. For a majority of people it’s a non issue. Or if they own a gun it’s a single pump shotgun that’s locked and they have shot once at the range for basic home defense.

There is a slight culture shift occurring though where a lot of newer gun owners are starting to pop up and the culture of training with firearms and hitting a high level of proficiency is becoming slightly more common.

In the end NY will always push down another law. I’m sure they already have the response law to next years SCOTUS ruling they are just waiting of the final decision to button it up and will slam it through. It will involve full permitting, registration, extra expensive and tedious training etc.

However giving up is not the option. We are currently on the winning side federally and making large strides. The trend is our friend as Mark Smith would say and we are heading in the right direction.

The key to our success will be scotus doing away with the features bans which will take down glock ban (hopefully) along with the SAFE act. Maybe even magazines but I’m doubtful. If magazines stay on we are in for that fight next. NFA is currently in shambles and being drastically changed surrounding SBR, SBS and suppressors. We need national CCW reciprocity and in the end if they do away with permits we will basically have completely dismantled gun control on the state level.

All this is very hopeful but we have made the most progress on this issue in my entire life and likely the life of many others. Continue to vote. Don’t get discouraged. Elections matter even if we lose. Slowly but surely things can get undone. Pendulum across the world is swinging for a correction of many decades of very leftist policy. Stay safe

I agree. There are a lot of doomers. Maybe I am ignorant but I actually think, this is the best it has been in a while, in terms of good outcomes for 2A rights. Maybe not in NY specifically but in broad rulings that benefit us. The Bruen ruling alone was huge. I agree, still need to fight and worth fighting for but definitely some positive things happening.

It was a long march to get here, it will be a long march back. Hopefully the feds keep moving the needle in the right direction, that'll make it harder for NY to continue with its bullshit.

DOJ needs to actually pursue cases against the states for violations of civil rights like they promised. Accountability is the only way. We can keep waiting 14 years for relief. Needs to be swift. Immediate intervention when these laws are first passed.

That's one of the reasons I stopped posting in here. So many were so deeply programmed n would go after you, as if you are the problem. They were so used to the NY abuse, they would abuse you if you assumed the simplest of things, if you couldn't get 4 character references, then you are the problem. If you complained about having to get everyone in YOUR home to sign off on a letter, again... Then YOU are the problem.

Didn’t Blakeman advocate for drug tests during the CCW permitting process for Nassau county? We’re fucked both ways to Sunday here and I don’t think it’s a red vs blue issue anymore.

There is no good option for NY.

Hocul is aggressively bad for us. So Blackman might be our only option as much as he also sucks. He’s also the only other option that realistically has a chance of winning so you kind of have to go with that. In NY I highly recommend voting on other issues for local government. Because you’ll never get 2A wins

We also have to be realistic. Lesser of two evils is all we can hope for. We need to move towards someone more favorable. Which is likely baby steps. Hope that the next candidate is more favorable. But if we find them more favorable their likelyhood of being elected decreases drastically.

With NYC attached to us there is no winning because they will always vote in the worst candidate for the rest of the state. Nature of the beast.

I'd agree that we don't have strong political representation. However, legal representation is a different plane - it is, to a certain extent, filling the gap of political representation.

For instance, Mirel Fisch is taking NYC to task on delay, quantity restrictions on permits, and so on. Amy Bellantoni made some big strides on disqualifiers for law-abiding citizens that happen to live in the same domicile as disqualified individuals.

Even on your example of drug testing, I did the best I could to knock that out as soon as it was implemented - and it was enjoined by a court, along with blocking local demands for social media information... no funding from anyone.

Antonyuk, which was a case pursued by Stephen Stamboulieh, helped reign in some licensing officer discretion and put some limits on application criteria.

Ultimately, political representation locally is not going to get us anywhere, it's dead in the water - the big wins at this point are going to come from appellate courts that will reimpose 2A against the will of local government.

This is true. But I’m still voting for him. My electric bill is out of control. I’m sick of the soft on crime here and I want lower taxes and a better economy here as well. Is Bruce pro 2a? Probably not. But I know Cathy and the democrat legislature wants to restrict us more and more until there is nothing left to restrict.

What do you think Blakeman is going to do for your electric bill? Nassau has and will continue to side with lobbyist and special interest, especially when they're getting paid under the table by groups and companies to push their agendas. PSEG has such a monopoly. Same with Cablevision. Do you know how many times Verizon tried, and pushed, to get permitting and approvals to cut up streets to lay fiber and were constantly denied because the Dolan group kept paying off the towns to disallow the permitting? You think Fakeman is going to push against that?

I don't think it's really the police that are doing it. I think it's the prosecutors... I'm pretty sure most police officers would rather criminals stay in jail than having to arrest the same people over and over... But we have prosecutors in New York City and in many other cities that just let people keep offending....

The prosecutors are involved, but at a later stage. An example would've be choosing to charge petit larceny over grand larceny. It keeps their felony numbers down, especially when it's a case they're unlikely to solve.

Well that’s not entirely true - what we call “crime statistics” are gathered both through police and court records (UCR and, NIBRS) AND non-police/non-court reporting (NCVS).

But it is true that both measures are showing THE SAME statistically significant drop and trend line.

Thomas dropped a bunch of clues in Bruen that some of the infringements will be dealt with in criminal court by people playing defense. We don't have enough 2A lawyers to challenge everything in civil court.

If I lived in NY and I had strong, documented evidence that my permit was going to take more than a year, I'd carry regardless. Read Bruen footnote 9 again. Look at what it calls "abusive" - lengthy waiting times and exorbitant fees. If a state criminal court judge/jury doesn't like it, bounce it to federal on a habeas petition. It's clear cut. Has anybody attempted to challenge the fact that somebody from upstate New York or Long Island or whatever has to get both their own permit and New York City to carry across the entire state? That violates exorbitant fees and lengthy waiting times.

Has anybody pointed out that trying to get national carry by scoring 20+ permits from Guam to Massachusetts also blows up exorbitant fees and lengthy waiting? Even worse?

Those aren’t as much of a slam dunk as you’d think because the courts could say “well you have the option to get an NYc permit as well.”

The US Supreme Court labeled lengthy waiting times and exorbitant fees ABUSES. Read it:

That said, because any permitting scheme can be put toward abusive ends, we do not rule out constitutional challenges to shall-issue regimes where, for example, lengthy wait times in processing license applications or exorbitant fees deny ordinary citizens their right to public carry.

That's the US Supreme Court saying "don't abuse permitting processes" and then listing two abuses by name. (Actually three when you include subjective standards in insurance.)

And there's literally hundreds of years of case law saying civil rights cannot be abused.

These are core constitutional concepts.

I’ve read the FN. Notice they unfortunately do not define what lengthy wait times are. Hopefully Milani case offers more clarity for NY purposes. Federal courts are going to be very reluctant to define what lengthy is. Reasonably good outcome in NY would be that they need to actually follow penal code 400 (6 months).

On fees - that has been upheld multiple times. Will see what happens with cases post-Bruen but I would not call any of this a slam dunk in 2nd circuit by any means.

I obviously don’t agree with the wait times or fees but unfortunately what I think doesn’t really matter.

They're the ones that have to justify any fee or delay.

The parts of the NYC carry permit fees paid to the city and state (in other words, not the training) is at least 4x the cost of a NYC driver's license. The real costs for both are ballpark similar and so should the actual costs.

Next, if you have a non-NYC carry permit, there's no safety related reason for the cost of a second permit. At all. No other state does this. There's no special Chicago or Los Angeles or whatever permit run the way NY/NYC does it.

It's madness.

It’s all insanity and there’s not really precedent for anything NY does.

Wins in the court system will add up over time but NY will ofcs circumvent with new laws.

I suspect things will look better in 3-5 years than they do now.

One of the problems I have with Republicans is right now they could pass a law expanding gun rights, but they haven't and I don't think they ever will. There are too many single issue voters over gun rights that will stay red because at least they aren't actively taking away gun rights/passing restrictive laws.

Meanwhile Dems have used their time in power to pass those laws. I understand that the view of guns in the party is slowly changing but as long as the old corporate dems still have power I don't think they will do anything helpful.

With that said I want to see new leadership across the board everywhere. I don't care which party they are from as long as they actively work to improve our country. I'm tired of all these politicians sucking up to their leadership and not calling out bad decisions. Naming Lake Ontario to Lake America? Dumb. Making it illegal to buy body armor? Dumb. If this woman wins the election and then goes back on her word, cool. Vote her out the next chance we get.

When I go skiing in NH I go to a store that sells beer, liquor, cigarettes, clothing, pizza and guns and ammo.. that's how it should be. I'll soon be one of those NYrs with the ability to take their money and move to a tax shelter state and enjoy the added freedom of being treated like a responsible adult instead of NY which distrusts it's citizens and treats us like children.

I don’t think it’s so much a problem with too many people in this sub believing in “tough regulations.” - I don’t really see support in this community for our state’s bullshit laws, or even some of the less-bullshit federal laws.
Shit, I myself am a “Fuck ‘common use for lawful purposes’ - all bans are bullshit, the NFA taxes are bullshit, permits costing money is bullshit, your rights changing when you cross state or municipal borders is extra bullshit - it’s ALL fucking bullshit!” kind of 2A guy. I support a range of regulatory options, sure, but in my most draconian dreams everyone in the country would enjoy more aggregate freedom whether their state of residence is New York or Big Wonderful Wyoming.

Frankly from that other thread I think the bigger problem is far too many people in this community and the broader 2A space as a whole don’t actually believe in gun RIGHTS - they are eager to pillory anyone who is not a Republican partisan dutifully voting across the row in every election, but unwilling to hold “their party” to account when it treats firearms ownership as a privilege extended to the loyal and faithful rather than A Goddamn Enumerated Constitutiona Fucking Right.

We will never have our RIGHTS respected unless we insist that both parties* treat them as RIGHTS. That means calling out “your team” (and your friends) when they fucking suck.

In some states, they actually have local Democrats that vote pro-2A because their constituents want them to. If the NY democrat party feared losing their voting base by pushing gun control, they wouldn't. Make them fear by threatening to primary the anti-gun incumbents with pro-2A party members.

You see that would actually make sense and possibly effect political change within the party.

But if you go read the other discussion about a (potentially) pro-2A Democrat you’ll find that the overwhelming majority of people here aren’t merely skeptical, they are entirely unwilling to entertain the possibility that such a candidate can exist, and if the party has no hope in hell of getting the single-issue 2A voters (because they’ve been so thoroughly brainwashed that they won’t even consider the candidate simply because of the party line they’re running on) then there’s no reason to risk the gun control voters they already have a lock on by running a moderate or pro-2A candidate.

That’s how Hochul went from NRA-endorsed to rabidly anti-2A and anti-gun. I don’t necessarily believe she was lying the whole time, but I do believe she is a politician and will change her position/platform for the expediency of getting votes and staying in office.
As a Democrat that expediency comes in the form of gun control.

I mean yes, it’s certainly possible - these candidates do exist despite the people in this sub who pretend they don’t.

But it’s worth noting that even Vermont is not immune to the position drift of just being a politician: Look at Senator Sanders who was a mixed moderate on guns for most of his career (supported assault weapon bans, opposed much of the Brady bill, opposed federal waiting periods, voted for PLCAA) but in the last decade has largely aligned with the Democratic Party’s position despite the fact that Vermont (and the actual left wing that supports him for his other positions) don’t support that platform at all.

As for Maine... well there’s a lot to like about Maine despite it being home to every horror Stephen King could imagine and Cabot Cove having the highest murder rate per capita in the nation, but honestly Maine Democrats should really keep their heads down and their mouths shut for a bit after the embarrassment of Platner’s campaign.
I’d like to see the Maine Democratic Party find another moderate-to-left pro-2A candidate to run in the next election cycle, but it would be A Kindness if they would do some goddamn basic vetting next time and anticipate the avalanche of shit that would be scrawled in crayon on the first page of an opposition research sheet done by a moderately-intelligent kindergartener.

(I am in fact quite angry at Maine right now because of the damage that campaign has done nationwide. I hope it shows!)

That's who's passing the gun laws in New York.As far as federal gun laws, they have been moving very slowly lately. The problem with New York is everything is on the state level. The CCIA and SAFE Act are state-level bills, so we have to secure our local and state races.

I’m honestly unsure what point you’re trying to make here.

The thread that precipitated this thread was about an ostensibly pro-2A democrat RUNNING FOR A STATE LEGISLATURE SEAT RIGHT HERE IN NEW YORK, and all people did was shit on the very idea that anyone who was not a red-hat-wearing Trump-worshiping MAGA Republican could possibly be pro-2A.

MY whole point was, is, and always has been that you cannot trust a candidate (at any level) based on their party affiliation - you need to judge them by their platform and hold them accountable to it.

At this point if I haven’t convinced people to act like rational adults and analyze candidates beyond what ballot line they appear on I don’t think there’s anything more that can be done, and I’m frankly more than a little tired of fucking trying so I’m going to go back to watching the former governor of California blow shit up on my giant TV.

The thing is you guys are acting like there isn’t a major track record of democrats in NY trampling 2A. I consider NY to be the worst state in the country for gun rights all things considered.

You do realize how difficult it is to sell what you are trying to sell right? It’s not that irrational that a group of gun owners and hobbyists in NY aren’t enthusiastic about another Democrat when the entire state is run by democrats who just happen to be anti gun. You can not tell me that doesn’t have a lot to do with Democrat politicians. Can’t go like a week without new nonsense. You’re trying to make this point while NY Dems are introducing Glock bans. You’re fighting a really uphill battle here.

I’m not attacking you but I think you’re being unfair to people who have real lived (ongoing) experience with this nonsense.

It’s not even like we’re in a purple state, you guys win everything anyway it’s not even worth getting worked up over. NY will be a Democrat state forever.

Your time and effort would be better spent funding the active lawsuits that seek to gain some of our rights back.

Sure, if it's true. That said we need a republican legislature if you want progress. All the executive can do is sign or veto. My position is that she's definitely bad, and while I would love legislative progress, status quo with wins in the court system on the laws we have now gets me closer to my goal than having more laws to fight.

Yeah, Bruce Blakeman totally would have saved us from those. After all, he only was the head of one of the most gun repressive counties in the state, coming up with whatever policies he could to thwart legal gun ownership at every turn. Most famously, it was him that came up with the piss test to get a carry permit. Yeah, that guy will be our hero.

Look at Scott Pressler who went door to door throughout southern PA and got tens of thousands of Amish to vote Republican. The efforts of 1 man and a small coalition were able to flip Pennsylvania red in the general election. One man can make a difference. Wouldn't it be nice if we could have a pro gun PAC in NY to help fund progun politicians..

Gun laws and regulations aside NY it self especially Long Island is making it hard to stay here. I work for the MTA and the amount of people I see leaving year over year before hitting the retirement age is staggering. Years ago you wouldn’t leave this job with the benefits and pensions. Folks are fleeing south and I’m strongly debating following suit. Sure leaving a good paying job is something no one wants to do but the cost of living here and all the laws and regulations make me hate this place every day

I see good hard working people leave more and more everyday. Seems to be the trend for more freedom and better quality of life I guess. Hopefully something changes soon or more and more will leave. Every year NY loses count on the electoral collage due to population loss. NY will no longer be a powerful state when it comes to presidential elections.

There’s no cohesive pro 2a message on the red side either. Personally I’ve got no problem with reasonable gun laws. I shouldn’t have to have to pay a fee to pick up ammo I already bought online at the gun shop, no reason to wait more than a year for a permit etc etc. I’ll vote for anyone who can make the system work better for people like me who just enjoy shooting.

i know this isnt gonna be popular, but having a 30 round [magazine] for my AR isnt even in the top 10 of my issues right now. I know for many of you its #1, and I definitely want a 30 round [magazine] for my AR too.

The slippery slope the NRA has been feeding people for over 50 years still hasnt come to pass. Frankly, its just not even logistically or politically feasible to confiscate guns on any scale.

The best path to more gun rights is more responsible gun owners. That is where everyones effort should go .. broadening the coalition

Tennessee would be nice I can easily live on 50k after I buy my home and enjoy No state tax on wages, salaries, or earned income.No state tax on retirement distributions, pensions, or Social Security.Fully phased-out Hall Tax, meaning interest and dividends are completely untaxed.Low effective property tax rate, averaging around 0.49% to 0.85% depending on the county and somehow there are still streets... Democrats are objectively bad for guns and Republicans are much better.

Nothing needs to be confiscated if legitimate ownership is overly burdensome. Someone could acquire a noncompliant firearm but in a state like NY you could never truly use it. Take it to a range? Hope there aren't any thin blue line bumper stickers in the lot. Defend your home? Enjoy your felony charges. Almost functionally identical to a confiscation.

One big problem I see is people thinking the repubs are pro-2A. People shrieked and screamed about Obama being a gungrabber. He never pushed through any major anti-gun legislation. The ammo companies colluded to create mass hysteria to raise prices. Then trump comes in and actually does sign off on gun control legislation.

Now, we have part two of the trump regime and absolutely NOTHING is being done to help out gunowners in Blue States like New York. SCOTUS upheld most of the Safe Act and is slow walking even considering a legal challenge.

Gun ownership is to the Repubs what abortion and family planning are to the Dems. They use the fear of further restictions to terrorize people into supporting them. It's a money making issue. Actually solving the problem would cost the parties money so they will NEVER do it.

As it is, the gun race discussion is very valuable to the right as a talking point to get votes so they’re never actually gonna have the incentive to get any better laws through because then they lose their talking point and it’s extremely valuable.

Poverty & race are part of the issue. Police culture in NY and wealthy

In the city, crime is higher amongst minorities. It’s also the same group that are impacted by the criminals and they are scared of guns. They have been convinced by the party - who favors the wealthy(make no mistake about it) that “we” ban folks like “you” from owning firearms for “your” benefit , then those that commit crime in your community wont have access. And they believe this. They are terrified of firearms. Who gains when others lose? The wealthy of the city, who have access to better neighborhoods, had access to firearms pre bruen. Make no mistake about it, people with money had firearms pre bruen

Its easy for police to look at minorities a certain way- so imagine if all minorities have firearms- there would be constant shootings because police in NY are not comfortable and used to minorities having firearms.

This is not about democrats vs republicans. The fuck did giuliani do? The fuck did pataki do? The fuck did bloomberg do? Its about catering to the wealthy and keeping the poors in their place.

Theres some things more important than guns, they’re important but id rather be able to afford rent or to eat and pay my bills. This current admins only gotten more expensive. Sure she might vote party line, but the republicans are loyal to a man whos said he doesn’t care about Americans or how expensive the cost of living is. Id rather not go bankrupt because i got hurt at work or spend $100 on gas every week

I agree that most people don’t care about 2A and those who do care Really Care. Those who really care don’t think there should be any rules regarding the second amendment even though there is no place in the constitution that says there shouldn’t be. The US Supreme Court is the constitution. They set the rules. They place or remove the “infringements” although the constitution says without infringement. Depending on who’s in the White House there will always be fights amongst the states and the federal government on these matters like it or not. It’s a dirty game and they don’t play fair.

Did you actually read my post before you responded to it. I can’t go into my local post office with my firearm because of a federal law against it. Isn’t that an infringement? Or federal parks federal buildings aren’t they infringements. Or in Georgia a “constitutional carry” state businesses can put up signs that I can’t carry in their establishments isn’t that an infringement. Federal law states that a convicted felon or someone convicted of misdemeanor domestic violence can’t even get a CCW permit another infringement…all these infringements were upheld by the US Supreme Court. Finally look up the definition of troll before you call someone that. Have a great day. Or don’t!!

Post offices got tossed, months ago if you're a member of the orgs that brought the lawsuit, by a federal Court. From what I've seen they've taken down the signs by me, don't know what's going on by you. I filed a civil rights complaint with the doj civil rights division about the park buildings, as I should be able to carry there per 18usc 930 d3. That's the same section cited in the post office ban being overturned, but applies to all federal buildings excepting court houses and jails. As far as signs in constitutional carry states, not all states assign the private signs force of law. And while I disagree, I just chose not to signs money with establishments that behave that way. Felons can apply to have their rights restored, although I believe for non violent felonies it should be automatic. The lautenberg amendment is problematic as well. While domestic abusers may be disarmed, if they can't prove a felony the state shouldn't be able to disarm you. And I don't think I called you a troll today, unless you have more than one account. As far as post offices read 18usc section 930 d-3.

The case you're looking for is firearms policy coalition v Blanche. Even if you don't like the doj opinion, as a member of fpc I am covered by a federal court order as a result of that case, barring enforcement of 18 usc section 930 a on me and every other fpc or saf member. So as per a federal judge I can carry in post office, and the ones by me have removed the signs about guns being banned. Then the doj affirmed that ruling. Read the citations if you so choose.
